CHAPTER 13

MULTIPLE-FAMILY RESIDENTIAL ZONES

11-13-010: PURPOSE:

The purpose of this zone is to provide areas in the City for medium density residential development. Three (3) zoning districts are provided for this purpose: R-2, R-4 and R-8. These zones are distinguished primarily by differences in lot size and setback standards. (Ord. 1992-14, 4-15-1992)

11-13-020: PERMITTED USES:

The following are permitted uses in multiple-family residential zones. No other permitted uses are allowed, except as provided by subsection 11-4-050F of this title:
   Accessory dwelling units (only in the R-2 Zone).
   Agriculture.
   Class A animals.
   Home occupations complying with the home occupation chapter of this title, except as specified in section 11-13-030 of this chapter.
   Internal accessory dwelling units (only in the R-2 Zone).
   Residential facilities for the disabled.
   Signs complying with title 15 of this Code.
   Single-family dwellings.
   Two-family dwellings.

11-13-030: CONDITIONAL USES:

The following are conditional uses in multiple-family residential zones. No other conditional uses are allowed, except as provided by subsection 11-4-050F of this title:
   Apartment dwelling group.
   Class B animals.
   Class D animals.
   Daycare center.
   Dwellings, five- to eight-family in R-8 Zone only (may exceed density standard established by section 11-13-040 of this chapter as approved by the Planning Commission up to a maximum density of 15 dwelling units per acre).
   Dwellings, four-family (R-4 and R-8 Zones only).
   Dwellings, three-family (R-4 and R-8 Zones only).
   Greenhouses, private with no retail sales.
   Home occupations, as identified in section 11-35-040 of this title.
   Private school or hospital.
   Professional offices (except in R-2 Zones).
   Public uses.
   Public utility installations (except lines and rights-of-way).
   Quasi-public uses.
   Residential facilities for the elderly.

11-13-035: MODERATE INCOME HOUSING:

   A.   Minimum Requirement: In the event an application for development is accompanied by a request for a planned unit development (PUD), or exceeds density standards for five to eight (5-8) family dwellings considered under section 11-13-030 of this chapter (Conditional Uses), a developer must provide or set aside dwelling units equal in number at least to ten percent (10%) of the total number of dwelling units approved for the development for moderate income housing subject to recording a deed restriction(s) to ensure the required number of lots or units are available for a qualifying moderate-income household; unless, at the sole discretion of, and by agreement with the city, the developer provides:
      1.   Open space;
      2.   A fee in lieu thereof determined in consideration of factors set forth in Section 11-28-270 of this Title;
      3.   Some other public benefit; or
      4.   A combination of 1, 2, and 3 above.
   B.   Exemption: Developments resulting in two (2) or fewer additional units are exempt from the minimum moderate-income housing requirements of this Section.
   C.   Additional Dwelling Units: The City Council may approve additional dwelling units than what is conventionally allowed in the underlying zone as an incentive to a developer to provide moderate income housing. (Ord. 2021-20, 8-3-2021; amd. Ord. 2024-06, 1-16-2024; Ord. 2025-38, 7-15-2025)

11-13-040: MINIMUM LOT AND SETBACK STANDARDS:

   A.   Minimum Standards: The following shall be the minimum lot areas, widths and main building setbacks in multiple-family residential zones:

*   Buildings shall not be built over utility easements that may run along the side and rear property lines, unless an exception provided from the zoning administrator with the consent of the City's Development Review Committee and other applicable utility providers in writing.
 
   B.   Class B Animals: Class B animals may be approved by the Planning Commission only if the area of the lot is twenty thousand (20,000) square feet or larger. Class B animals shall be limited to not more than one horse or cow and not more than two (2) sheep or goats for each twenty thousand (20,000) square feet of a lot.
   C.   Increase In Side Yards For Future Use: If a garage or carport is not proposed as part of the original construction of a single-family or two-family dwelling, side yards shall be increased by a minimum of twenty feet (20') to accommodate future garage or carport additions. 11-13-050: ACCESSORY BUILDINGS AND STRUCTURES:

   A.   Location: Accessory buildings, except those listed in subsection B of this section:
      1.   Shall be separated from the main building by a distance in compliance with applicable building codes;
      2.   Cannot encroach on any recorded easement;
      3.   An accessory building shall not be located closer than five feet (5') from a side or rear property line unless a special exception is approved by the Planning Commission to reduce these setbacks in accordance with section 11-3-045;
         a.   Exception: An accessory building which is less than ten feet (10') in height and under two hundred (200) square feet in ground floor area may be located within a side and/or rear yard closer than five feet (5') to a side property line so long as it complies with the other provisions of this Section.
      4.   Accessory buildings located to the rear or side of the main building shall not occupy more than twenty five percent (25%) of the rear yard or thirty three percent (33%) of the side yard;
      5.   Accessory buildings shall, without exception, be subordinate in footprint to the main building.
      6.   Any eave, or part of an Accessory building, shall not overhang or extend past a property line.
      7.   An accessory building may be located in a side corner yard or front yard of a lot; providing, that the building is of the same general design or style as and comparable in excellence of quality and construction to the main building, and in no event shall the accessory building encroach into the required front yard or required side corner yard beyond the nearest corner of the main building.
   B.   Animal Shelters And Similar Buildings: Animal shelters, hay barns, coops, corrals or other similar buildings or structures shall be located not closer than ten feet (10') from any side or rear property line and fifty feet (50') from any public street or from any dwelling on an adjacent property.
   C.   Double Frontage Lots: On double frontage lots, accessory buildings shall be located not less than twenty five feet (25') from each street upon which the lot has frontage. 11-13-060: BUILDING HEIGHT:

   A.   Main Buildings:
      1.   Main buildings shall not exceed twenty seven feet (27') in height.
      2.   No dwelling structure shall contain less than one story.
   B.   Accessory Buildings Or Structures (which does not include fences):
      1.   Accessory buildings or structures shall not exceed fifteen feet (15') in height unless an increased height is approved by the planning commission after review of a special exception application filed by the property owner.
      2.   Accessory buildings within one foot (1') of a side property line located in the side yard or front yard shall be limited to ten feet (10') in height and an increase in height of one (1') may be allowed for each additional foot setback from the side property line, but not to exceed the maximum height for such buildings unless as otherwise provided herein.
      3.   Accessory buildings shall, without exception, be subordinate in height to the main building, unless the main building is less than fifteen feet (15') in height. (Ord. 2005-11, 4-6-2005; amd. Ord. 2019-23, 7-16-2019; Ord. 2021- 01, 1-19-2021; Ord. 2024-41, 7-16-2024)

11-13-070: PARKING RESTRICTIONS:

   A.   Prohibited Location: Minimum parking required by this title shall not be located within the minimum required front or side yard setback adjacent to a public or private street in any multiple-family residential zone.
   B.   Rear Yard Location: Required parking for multiple-family buildings shall be located in the rear yard of the lot unless fully enclosed and covered parking is attached to, and designed as an architecturally integrated element of, the main building. (Ord. 1992-14, 4-15-1992)

11-13-080: SITE DEVELOPMENT:

Site development for multiple-family residential development shall conform to sections 11-7-050 through 11-7-070 of this title. (Ord. 1992-14, 4-15-1992)
