Sec. 70-643.- Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Business center means a group of three or more businesses, including retail, restaurant, office, service uses, that share a common vehicular access.

Fast-food restaurants means restaurants where food and drink are usually previously or rapidly prepared, and food is served directly to the customer ready to be consumed on the premises or taken out. They principally supply food and beverages in disposable containers. They are characterized by high automobile and pedestrian volumes with drive-through facilities. Typically they include self-service and short stays by customers. They are usually located in separate freestanding buildings.

Overhang means the overlapping of either the front or rear bumper of a vehicle over a sidewalk, street, alley or right-of-way when a vehicle is parked in a parking space.

Parking area means an open space or an enclosed structure used primarily for the temporary storage of automobiles.

Quick-serve restaurants means restaurants where food and drink are usually prepared to order, orders are taken at a counter, food is picked up by the customer or served by waitstaff, and food may be consumed on premises, taken out or delivered. They may supply food and beverages in either disposable or nondisposable containers. They are characterized by moderate automobile and pedestrian volumes with no drive-through facilities. Typically they include self or minimal waiter service, and moderate stays by customers. They are usually located at in-line tenant spaces.

Supermarket means a retail store with a floor area greater than 5,000 square feet that offers for sale a complete line of food and domestic products.

Sec. 70-644. - General requirements.

All parking areas required by this article shall conform to the following requirements:

(1)

Grading. Parking areas shall be properly graded and shall include stormwater detention and/or storm sewers in accordance with the approved grading plan and drainage report for the property.

(2)

Surfaces. All areas used for parking and driving of vehicles shall have a durable and dustless surface, and shall be designed and constructed adequately for all-weather use.

(3)

Curbs or wheel stops. Curbs or wheel stops shall be installed where necessary to prevent vehicles from extending over streets or sidewalks, or from striking walls, fire hydrants, utility poles or pedestals.

(4)

Access. Parking areas shall have unobstructed paved access to and from a public or private street or alley, with the drive aisle a minimum of ten feet in width.

(5)

Maneuvering space. Drive aisles shall be unobstructed and free of other uses.

(6)

Demarcation. Parking spaces shall be delineated with pavement markings and other directional markings or signs shall be installed as permitted or required by the city to ensure the approved utilization of parking spaces, proper traffic flow and general safety.

(7)

Shared parking. Off-street parking areas may serve jointly two or more buildings or uses, provided that the total amount of joint use parking (together with any single use parking for the buildings or uses) shall not be less than the combined amount required for each building or use.

(8)

Forward entry onto public streets. Parking areas in business, commercial, multifamily and industrial zones shall be designed so that vehicles are not required or permitted to back onto public streets.

(9)

Lighting. All lighting in parking areas or drive aisles shall be designed to reflect away from adjoining residential property and minimize glare directly onto streets.

(10)

Parking space access. All parking spaces, except off-street parking spaces intended for the storage or display of vehicles, shall have direct access to a driveway lane or aisle.

(11)

Aisle width. Drive aisles shall conform to the minimum width requirements contained in Table A of this section 70-644.

(12)

Standard car spaces. Parking spaces shall conform to the minimum width and length requirements contained in Table A of this section 70-644. In the event that the parking spaces are designed and constructed at an angle not listed in Table A, the minimum required width and length of the parking spaces shall be calculated by the city planning department.

(13)

Small car spaces. A maximum of 20 percent of a parking area containing five or more spaces may be designed as small car spaces. No small car spaces shall be allowed in a parking area containing fewer than five spaces. Small car spaces shall conform to the minimum width and length requirements contained in Table A of this section 70-644. In the event that the parking spaces are designed and constructed at an angle not listed in Table A, the minimum required width and length of the parking spaces shall be calculated by the city planning department.

Location. The off-street parking required pursuant to Table B of section 70-645 shall be located on the same lot, tract or parcel as the building or use for which the parking is required. Notwithstanding the foregoing, in C-1 and I-1 zones the city council may approve the placement of required off-street parking on a lot or tract adjacent to the lot, tract or parcel containing the building or use for which the parking is required, provided that the off-site parking spaces are located not farther than 300 feet from the buildings or use they are intended to serve which shall be measured by means of pedestrian access from the building or use.

(15)

Overhang and buffer. No sidewalk shall be decreased to less than four feet in width by use of a vehicle overhang. No overhang is permitted into a sidewalk that is located within a public right-of-way. All buildings shall be separated from parking areas, drive aisles and maneuvering areas by a minimum five-foot buffer, walkway or landscaped area.

Accessible route. A route accessible for persons with disabilities, consistent with the requirements of the Americans with Disabilities Act; 42 U.S.C. 12101 et seq., as now or hereafter amended, shall be provided.

(17)

Off-street loading. Sufficient space shall be provided on any lot, tract or parcel for necessary loading and unloading operations associated with the use of the lot, tract or parcel, including space for ingress, egress and maneuvering of vehicles loading or unloading persons or goods. Vehicle loading areas shall be designed in such a way that loading and unloading operations shall not block or hinder traffic on any public right-of-way. All vehicle loading areas shall be located completely out of the public right-of-way and shall be large enough to prevent vehicles, including delivery trucks, from reversing into the public right-of-way.

Sec. 70-645. - Amount of off-street parking required.

The minimum amount of off-street parking spaces required for any structure or use shall conform to the requirements contained in Table B: Minimum off-street parking spaces required for specific uses, set forth below. If the amount of required parking spaces is based on the square footage of the use of the property, the square footage shall be measured by the floor area primarily devoted to the functioning of the particular use of the property and shall exclude stairwells, elevator shafts, hallways, restrooms, ornamental balconies, and space occupied by heating, air conditioning or other utility equipment.

Sec. 70-646. - Parking requirements for uses not listed in Table B.

For specific uses not listed in Table B: Minimum off-street parking spaces required for specific uses contained in section 70-645, the city manager or designee shall determine the required number of off-street parking spaces based upon the type of use, intensity of use, number of employees or residents, square feet of floor area, and/or similarity to uses listed in Table B. Any owner or occupant of a lot, tract or parcel for which the city manager determines the required number of parking spaces may appeal the decision of the city manager in writing to city council within 30 days of issuance of the city manager's decision.

Sec. 70-647. - Off-street loading and unloading.

Loading and unloading operations shall not block or hinder traffic on any public right-of-way.

Sec. 70-648. - Parking requirements to accommodate persons with disabilities.

The following requirements shall apply to any parking areas within the city. Additionally, all property owners and occupants shall be required to comply with the provisions of the Americans with Disabilities Act, 42 U.S.C. 12101 et seq., as now or hereafter amended and federal regulations passed pursuant to the Americans with Disabilities Act. In the event that the Americans with Disabilities Act, federal regulations passed pursuant to the Americans with Disabilities Act or state law impose more stringent requirements than those contained below, the more stringent requirements shall apply.

(1)

The minimum number of parking spaces required to be reserved for persons with disabilities shall conform to the requirements contained in Table C: Total number of parking spaces required to be reserved for persons with disabilities.

All parking spaces reserved for persons with disabilities shall be a minimum of 12 feet, six inches in width and 20 feet in length.

(3)

One out of every eight parking spaces reserved for persons with disabilities, but not less than one, shall be served by an access aisle which has a minimum width of 96 inches (2440 mm) and which is designated "van accessible".

(4)

All parking spaces reserved for persons with disabilities shall be identified with one vertical pole sign.

(5)

All parking spaces reserved for persons with disabilities shall be so located as to allow convenient access to the entrance to buildings.

(6)

A ramp shall be provided near parking spaces reserved for persons with disabilities to allow access to the walk serving the buildings.

Sec. 70-649. - Maintenance required.

Both the owner and occupant of property have a continuing obligation to maintain off-street parking and loading areas. The property owner and occupant shall be responsible for maintaining parking areas free of potholes, weeds, dust, trash and debris. The property owner and occupant shall be responsible for maintaining the parking areas adequately for all-weather use.

Sec. 70-650. - Storage use prohibited.

Required off-street parking spaces shall be available for the parking of operable automobiles, trucks or motorcycles necessary for conducting the business or use located on the property and shall not be used for anything other than parking, unless the use is associated with an approved temporary use permit.

Sec. 70-651. - Deferral of construction of off-street parking spaces.

The city council may authorize that the construction of up to 20 percent of the required off-street parking spaces be deferred from the date on which it would otherwise be required. The city council may set conditions as necessary to guarantee the providing of such deferred spaces whenever the city council determines the need for the additional spaces to exist. The city council may approve deferral only if it finds that the need for off-street parking is lessened due to unusual characteristics of the use, and the property owner or occupant has provided comparable data, deemed sufficient by the city council, to establish that there is not a present need for the additional parking. Land area required for the provision of deferred parking spaces shall be available and maintained in reserve and shall be landscaped pursuant to a landscape plan demonstrating the ultimate provision of the deferred parking spaces, which landscape plan meets all requirements of this section and shall require approval by the city council.
