CHAPTER 24

SIGNS

10-24-1: SPECIFIC DEFINITIONS:

The following words and phrases, whenever used in this title, shall be construed as defined in this chapter:
A-FRAME SIGN: A sign constructed with two (2) sides attached at the top to allow the sign to stand in an upright position.
AWNING SIGN: A sign painted, printed, or placed on any portion of a cloth or fabric covering as an awning placed over a doorway or window to protect from weather elements.
BANNER SIGN: A temporary sign made of fabric or any non-rigid material with no enclosing framework.
BILLBOARD SIGN: A freestanding sign on industrial, commercial, or residential property that directs attention to a business, product, or service not offered on that same property.
BUILDING FACE: The visible outer surface of the main exterior wall of a building. The area of the face of the building shall be the total area of such surface, including the area of doors and windows that open into a surface.
CAMPAIGN SIGN: A temporary sign used by candidates running for political and elected offices and signs with political purposes.
CANOPY SIGN: See Marquee Sign.
ERECT: To build, construct, place, relocate, enlarge, substantially alter, attach, suspend, paint, post, or display. Normal maintenance, including refinishing, is not included in this definition, provided the sign copy is not changed or altered.
EXTERNALLY LIGHTED SIGN: A sign made legible in the absence of daylight by devices which reflect or project light upon it.
FREESTANDING SIGN: See Pole Sign.
FRONTAGE: The length of the sides along the street or any other principal public thoroughfare, but not including such length along an alley, watercourse, railroad, street, or thoroughfare with no permitted access.
HEIGHT OF SIGN: The height of a sign is the vertical distance measured from the ground plane to the top of the materials that incorporate the sign.
ILLUMINATED SIGN: A sign which has characters, letters, figures, designs, or outlines illuminated by electric lights or luminous tubes.
MARQUEE (OR CANOPY) SIGN: A marquee (or canopy) sign shall mean and include any roofed structure attached to and supported by a building and projecting over public property.
MONUMENT SIGN: A sign six (6') feet or less in height which is flush to the ground with low-intensity light fixtures only.
NAMEPLATE SIGN: A sign indicating the name or names of the person(s) or entity(ies) legally occupying the premises.
NON-CONFORMING SIGN: Any advertising structure or sign which was lawfully erected and maintained prior to such time as it came within the purview of this chapter and any amendments thereto, and which fails to conform to all applicable regulations and restrictions of this chapter.
OFF-PREMISE SIGN: Any sign which advertises products, services, or business establishments which are not located, conducted, manufactured, or sold upon the same premises on which the sign is erected or otherwise affixed.
ON-PREMISE SIGN: Any sign which advertises products, services, or business establishments which are located, conducted, manufactured, or sold upon the same premises on which the sign is erected or otherwise affixed.
POLE SIGN: A sign affixed in or upon the ground supported by one or more structural members, with air space between the ground and the bottom of the sign face.
PROJECT SIGN: A freestanding sign for multiple tenant projects.
PROJECTING SIGN: Any sign attached to a building or structural wall and extending horizontally outward from such wall more than twenty-four (24) inches.
REAL ESTATE SIGN: A temporary sign indicating that property or any portion thereof is available for sale, lease, or rent.
ROOF SIGN: Any sign that is erected upon or over the roof or over a parapet of any building.
SIGN: Any words, lettering, parts of letters, figures, numerals, phrases, sentences, emblems, devices, designs, pictures, trade names, or trademarks by which anything is made known, used to designate an individual, firm, association, corporation, profession, business, service, a commodity or product whether placed on the ground, rocks, trees, stumps, or other natural objects, or on a building, wall, roof frame, support, fence, or other man-made structure, which are visible from any public street, public highway, or public road right-of-way. For the purpose of this title, the word "sign" does not include the flag, pennant, or insignia of any nation, state, city, or other political unit, or a non-profit organization.
Further, it shall not include any official notice issued by any court, public body, or officer, or directional warning or information sign or structure required or authorized by law.
SIGN AREA: The area of a sign that is used for display purposes, excluding the minimum frame and supports. In computing sign area, only one side of a back-to-back or double-faced sign shall be computed when signs are parallel or diverge from a common edge by an angle of not more than ten degrees (10°). For signs that do not have a frame or a separate background, the sign area shall be computed on the basis of the least rectangle, triangle, or circle large enough to frame the display. Sign areas in the shape of a sphere, prism, cylinder, cone, pyramid, square, or other such shape shall be computed as one-half (1/2) of the total surface area.
SIGN STRUCTURE: Anything constructed or erected supporting a sign, which requires locations on or below the ground or attached to something having a location on or below the ground.
TEMPORARY SIGN: Any sign, banner, pennant, valance, or advertising display constructed of paper, cloth, canvas, light fabric, cardboard, wallboard, or other light materials, with or without frames, intended to be displayed out of doors for a short period of time. Temporary signs are restricted to ten (10) days before the event and two (2) days after, or a maximum of forty-eight (48) days per year.
WALL SIGN (OR FLAT SIGN): A sign with messages or copy erected parallel to and attached to or painted to the outside wall of a building.

10-24-2: ADMINISTRATION AND CLASSIFICATION:

   A.   The planning and zoning administrator is hereby authorized and directed to enforce all provisions of this title. All signs which require the issuance of a sign and building permit shall be inspected by the city at all reasonable times during or after construction.
   B.   Every sign erected or proposed to be erected within Fillmore City shall be classified by the planning and zoning administrator in accordance with the specific definitions of signs contained in this chapter. Any sign that does not clearly fall within one (1) of the classifications shall be placed in the classification that the sign, in view of its design, location, and purpose, most clearly approximates in the opinion of the planning and zoning administrator. If the sign does not approximate any of the permitted signs, the sign shall not be permitted.

10-24-3: GENERAL REQUIREMENTS:

   The following general requirements shall apply to all signs and outdoor advertising structures erected within the City of Fillmore unless otherwise provided in this title.
   A.   No person shall erect, alter, or relocate any sign or outdoor advertising structure within the City of Fillmore without first obtaining a sign permit from the city.
   B.   No sign shall be designed for the purpose of emitting sound, smoke, or steam.
   C.   No sign shall be placed, whether permanent or temporary, within the clear vision area as defined in 10-2-1 of this code unless the sign is a banner or wall sign affixed to and flush with an existing fence or wall.
   D.   Except as provided in 10-19-6, no person shall paint, mark or write on, post or otherwise affix any hand-bill, poster, advertisement, notice or sign of any kind or sort to or upon any sidewalk, crosswalk, curb, curbstone, park strip, street lamp post, hydrant, fence, tree, shrub, tree stake or guard, railroad trestle, electric light or power or telephone or telegraph or trolley wire pole, or wire appurtenance thereof or upon any lighting system, public bridge, drinking fountain, lifesaving equipment, street sign or traffic sign.

10-24-4: SPECIFIC REQUIREMENTS:

   Each sign shall meet the respective conditions:
   A.   A-Frame Sign:
      1.   An A-frame sign shall be temporary and movable. The sign shall be either:
         a.   Removed between the hours of ten o’clock (10:00) P.M. and six o’clock (6:00) A.M.; or
         b.   Placed outside for no longer than two (2) weeks.
      2.   Only one A-frame sign is permitted per fifty (50) feet of frontage on a public street.
      3.   The sign shall not exceed four (4) feet in height and sixteen (16) square feet on each of the two sign faces.
      4.   An A-frame sign shall not block any portion of a public sidewalk or road unless, for sidewalks only, a minimum of five (5) feet of unobstructed passing width of sidewalk is maintained.
      5.   The sign shall be at least ten (10) feet from any intersection and outside the clear vision area.
   B.   Awning Sign: An awning sign is a type of projecting sign and shall meet the projecting signs standards in addition to the following:
      1.   The vertical measurement of the front of the sign shall not exceed three (3) feet.
      2.   Shall project a maximum of four (4) feet and shall not project above the roofline of the building to which it is attached.
      3.   The entire area of an awning sign shall be backed by the building face.
   C.   Banner Sign:
      1.   A new business located in the GC, CC, HC, I-1, OR, or PQ zones shall be permitted to erect an on-premise temporary banner for not more than ninety (90) days from the first day of opening.
      2.   Existing businesses may erect temporary on-premise banners for not longer than thirty (30) working days in any given six (6) month period for any special events or promotions.
      3.   The city may erect temporary banners and attach special signs to city owned lampposts for the advertising of special events and holidays that benefit the community as a whole. These banners may be draped over a public right-of-way when approved by the city council. No banner shall be placed in a manner that will be a public nuisance or hinder the safe movement of traffic or pedestrian walkways, as determined by the city council.
      4.   Installation height to be reviewed by staff for safety and visibility. Maximum installation height allowed is twenty-five (25') feet. Banners over a walkway shall not be less than ten (10') feet high and not less than eighteen (18') feet over public streets, alleys, and parking areas.
      5.   Except for banners allowed under subsection (c) above, the maximum size of banners shall be three (3) by six (6) feet.
      6.   No other banner signs shall be permitted.
   D.   Billboard Sign:
      1.   All billboard signs over thirty-two (32) sq ft in area shall be located at least one thousand (1,000) linear feet apart.
      2.   All billboards shall have a setback of at least twenty-five (25) feet from any property line.
      3.   Along Main Street, signs shall not exceed two hundred fifty (250) sq ft in area.
      4.   In the Industrial (I-1) and Highway Commercial (HC-1) Zone, signs shall not exceed five hundred (500) sq ft in area.
      5.   Maximum installation height is twenty-five (25) feet.
      6.   Installation height shall be reviewed for safety and visibility. Illumination affecting traffic, trails, or uses on adjacent property shall be oriented away or shielded through the use of landscaping.
      7.   Permitted location for billboards are located on the Zone Map.
      8.   Billboards are allowed in the Agricultural (A-1) zone only along the I-15 corridor within one thousand (1,000) feet of I-15. Such billboards may be illuminated with up to 24-hour illumination and shall follow the regulations in this chapter for externally lighted signs.
      9.   A billboard shall not be illuminated if it is located within five hundred (500) feet of an existing structure used as any type of residential dwelling unless the illuminated face is oriented away from the dwelling.
      10.   No illumination of billboards outside of the Agricultural (A-1) Zone's I-15 corridor shall be permitted.
      11.   Each outdoor advertising structure shall be limited to one (1) sign face, except that two (2) sign faces may be permitted when said faces are mounted back to back with faces in parallel plans at distances not exceeding (4) feet apart; or that two (2) sign faces may also be permitted when said faces are mounted in a "V" configuration, provided that said faces are attached on end and have a maximum distance of thirty (30) feet apart at the other end.
      12.   All billboards shall meet the requirements of the Utah Outdoor Advertising Act.
   E.   Externally Lighted Sign:
      1.   Any lighting for an externally lighted sign shall be oriented downward and shall have full cutoff light shielding. Partial cutoff lighting, such as cutoff and semi-cutoff, shall not be permitted.
      2.   Light sources shall not be positioned in a way that they are visible from any public road, sidewalk, or trail.
      3.   The correlated color temperature shall be kept at three thousand (3,000) kelvin or lower.
      4.   Illuminance shall be kept no greater than twenty (20) footcandles per meter squared.
      5.   Uniformity (the ratio of maximum to minimum light level) shall be 4.0 or less.
      6.   Unless otherwise specified in this chapter, all signs may be illuminated, unless otherwise restricted by zone; however, no sign may utilize:
         a.   An exposed incandescent lamp with an external reflector without a sun screen or comparable diffusion;
         b.   Any exposed incandescent lamp in excess of fifteen (15) watts unless a screen is attached; or
         c.   Any revolving beacon light.
   F.   Illuminated Sign:
      1.   Flashing shall be limited to sequential, chasing, or subdued color change. No intense strobe-type flashing will be permitted.
      2.   Rotation shall be limited to eight (8) revolutions per minute.
      3.   Lights may not be used within seventy-five (75') feet of a residence, apartment, hotel, motel, or other residential structure.
      4.   An illuminated sign may not emit in the direction of any window used as part of a residence, apartment, hotel, motel, or other residential structure within two hundred (200) feet. If the sign is angled away and the light is shielded, no additional distance beyond seventy-five (75) feet is required.
      5.   Illuminance shall be kept low. To allow visibility of the sign, the amount of permitted illuminance depends on the amount of ambient lighting generally found in the area. For properties located between 900 South and 700 North, the maximum permitted footcandles per meter squared is forty (40). Due to the rural nature of areas outside those boundaries, any sign located outside that area shall have a maximum illuminance of twenty (20) footcandles per meter squared.
      6.   Internally lit signs shall have an opaque background which does not allow a light source to permeate the surface. Contrasting letters or logos shall be used.
      7.   Electronic message display signs must have an automatic dimmer to reduce sign intensity after dark.
      8.   The sign shall not cause glare or be intensely lighted at dark so that it creates a nuisance or hazard to vehicle traffic, pedestrians, or neighboring residential properties.
   G.   Marquee (Or Canopy) Sign: A marquee or canopy is a type of projecting sign and shall meet the projecting signs requirements in addition to the following:
      1.   Sign copy and corporate logos shall not exceed thirty percent (30%) of the any face of the canopy.
      2.   Changeable copy is not allowed on canopy/marquee signs except for theaters or similar public assembly uses.
      3.   Signs painted on or affixed to canopies which are part of the building shall be considered part of the total allowed area of wall signs and projecting signs for the walls from which the canopy projects.
      4.   Signs with a changeable copy (read boards) located on marquees of theaters or similar public assembly uses may combine the total allowable area for all building faces as permitted for wall signs in this title so long as there are no wall signs placed upon building faces other than the face to which the marquee is attached.
   H.   Monument Sign:
      1.   Maximum height of six (6) feet.
      2.   Flush to the ground with either no light fixtures or low-intensity light fixtures only.
      3.   Only one sign per five hundred (500') feet of frontage allowed.
      4.   The maximum sign area is sixty-four (64) square feet.
      5.   Multi-tenant projects shall include a space for each tenant.
   I.   Nameplate Sign:
      1.   No more than one (1) per business pedestrian entrance.
      2.   Sign shall be affixed to a wall and has a maximum sign area of two (2) square feet per sign.
   J.   Pole Sign:
      1.   A maximum of one (1) pole sign may be permitted for each parcel.
      2.   The maximum height of the sign shall be determined by zone and proximity to I-15.

      3.   The maximum sign face area is one hundred (100) square feet.
      4.   Each pole sign shall include a landscaping planter box of at least forty (40) square feet, shall be completely landscaped and maintained with a mix of attractive vegetation or landscaping otherwise approved by the city.
      5.   The sign shall be at least one hundred (100) feet from any residence unless the residence is located within a commercial or industrial zoning district.
      6.   Any lighting shall be downward-facing and fully shielded to prevent light pollution.
      7.   Sign lighting shall not be permitted within two hundred (200) feet of any residence and shall be turned off between the hours of ten o’clock (10:00) P.M. and six o’clock (6:00) A.M. when the sign is within five hundred (500) feet of any property used for residential purposes.
   K.   Project Sign: A project sign shall only apply for multiple tenant projects of at least two (2) acres.
      1.   No more than one (1) project sign per project.
      2.   Maximum height of thirty (30) feet with a maximum sign face area of three hundred (300) square feet.
      3.   No other pole or freestanding signs (except A-Frame signs) are permitted for the project.
      4.   If additional space is needed to advertise each tenant, a monument sign may be erected on the project premises.
   L.   Projecting Sign: Any sign attached to a building or structural wall and extending horizontally outward from such wall more than twenty-four (24). The bottom of the sign shall be at least nine (9) feet above grade level.
      1.   Signs painted on or affixed to canopies that are freestanding shall be considered part of the total allowable area of freestanding signs for that use.
      2.   In the General Commercial (GC), Highway Commercial (HC), and Industrial (I-1) zones, each separate building may utilize one projecting sign, subject to the following conditions:
         a.   The maximum size allowed is twenty (20) square feet, or as otherwise determined by the available frontage of the lot; whichever is less.
         b.   The sign may not project out from the plane of the building more than four (4) feet.
         c.   The sign may not exceed the height of the building facade.
         d.   For buildings with multiple tenants, the owner shall decide what portion of the projecting sign will be allotted to each tenant.
         e.   The projecting sign will be included in the total allowable sign area per lot, as defined by this chapter.
         f.   All other provisions of this chapter must be met, including lighting requirements, motion/animation requirements, height, and clearance requirements, etc.
   M.   Roof Sign:
      1.   Only one (1) roof sign is permitted per building.
      2.   The sign shall be placed on the pitch of the roof and below the roof peak.
      3.   A roof sign maximum size shall be one hundred (100) square feet.
      4.   Sign supports shall not be visible from a public street or sidewalk.
   N.   Special Event Sign: Any sign for a special event or temporary use shall be limited to forty-five (45) days unless otherwise specified in the ordinance.
   O.   Wall Sign:
      1.   The sign shall not extend more than twenty-four (24) inches from the wall.
      2.   Only one (1) wall sign allowed per building face.
      3.   Only low-intensity light fixtures are permitted. Lighting shall be downward-facing and shielded toward the sign.
      4.   The maximum size of the sign face shall be fifteen (15) percent of the building face, not to exceed five hundred (500) square feet.
      5.   The sign shall not extend above the roof line.

10-24-5: EXCEPTIONS:

   This chapter shall not apply to signs used exclusively for:
   A.   The display of official notices used by any court or public body or official, or the posting of notices by any public officer in the performance of a duty, or by any person giving legal notice.
   B.   Directional, warning, or information signs of a public or semi-public nature, directed and maintained by an official body or public utility.
   C.   Barber poles not to exceed six (6) feet in height, located on private property and bearing no advertising copy or message.
   D.   Any sign of a non-commercial nature when used to protect the health, safety, or welfare of the general public.
   E.   Any official flag, pennant, or insignia of any nation, state, city, or other political unit.
   F.   Any signs and elements of commercial signs that convey only time, temperature, or weather conditions, provided that the sign does not convey any commercial or other messaging.
   G.   Campaign signs for the purpose of announcing the candidacy of any person or persons seeking public office, provided that such signs shall be removed within ten (10) days following the election. However, campaign signs shall not be placed on any publicly owned property and shall receive the permission of the private property owner prior to placement.
   H.   Streamers and pennants provided that the streamers and pennants are kept in good repair, free from torn or frayed lines or pennants. Streamers and/or pennants in poor repair shall be removed immediately upon the request of Fillmore City or be subject to the penalties of this chapter.

10-24-6: LOCATION STANDARDS:

   The following restrictions shall apply to all signs:
   A.   Except for A-Frame signs, no sign shall be erected in such a manner that any portion of the sign or its support will extend over a public or private walkway with a minimum vertical clearance of less than ten (10) feet.
   B.   No sign shall extend over an adjoining property line without providing to the city written permission of the adjoining owner.
   C.   No sign shall be erected, altered, or relocated so as to interfere with or restrict access to a window, fire escape, or required exit.
   D.   No sign or sign structure will be permitted which constitutes a safety hazard.

10-24-7: SPECIAL PURPOSE SIGNS:

   In addition to any other permitted sign(s), signs for special purposes set forth in this section shall be permitted as provided herein:
   A.   Directional Signs: On-premise directional signs may be erected for the purpose of facilitating or controlling the efficient or safe movement of pedestrians or vehicles on or into private property and shall be located on the properties to which they pertain. No such sign shall exceed six (6) square feet.
   B.   Real Estate Signs: Signs advertising real estate for sale or an open house for a home for sale may be placed on private property in all districts with the consent of the owner, lessee, or occupant. The signs may state the name of the person or firm sponsoring the open house. The signs shall not exceed (6) square feet. Real estate signs shall not require a zoning or building permit.
   C.   Signs For Churches: In all zones, a church may erect:
      1.   One (1) wall sign on the premises to identify the name of the organization and announce activities thereof. A wall sign shall not exceed an area of thirty-two (32) square feet and may be mounted upon a freestanding, ornamental masonry wall. The sign shall not obstruct the vision of a corner lot.
      2.   One monument on-premise sign.
   D.   Signs Advertising New Development: One (1) development promotional sign may be placed on the premises of each subdivision, planned residential development, condominium, or other type of construction project. The promotional sign may have an area of thirty-two (32) square feet. One (1) on-premise sign shall be permitted per entrance or access to a development with a maximum of four (4) development signs per development. Two (2) directional signs may be located off-site to contain only the name and direction of any subdivision or planned residential development. The signs may have a maximum area of twelve (12) square feet each and shall not be located in the right-of-way of any public street. All signs shall be removed within thirty (30) days of the sale of all lots or dwelling units in the development.
   E.   Signs for children's seasonal entrepreneur projects, such as the selling of lemonade, shall not be regulated by this code except that they are to be on-premise signs and shall not be placed on or over a public way.
   F.   Temporary Uses: In all zones that allow temporary uses as a permitted or conditional use, the temporary use shall be permitted to install one on-premise sign to identify the business and indicate the type of business being conducted providing the following provisions are satisfied:
      1.   The permitted sign is to be an on-premise freestanding sign.
      2.   The sign shall not project over a public way, sidewalk, or parking surface.
      3.   A freestanding sign shall not be more than three feet (3') high.
      4.   The sign area shall not exceed sixteen (16) square feet.
      5.   The sign shall not be an animated/illuminated sign or contain any flashing lights or moving parts.
   G.   Garage Sales: Any sign advertising a garage sale shall not be placed on or over a public way and shall be removed within twenty-four (24) hours of the conclusion of the garage sale.

10-24-8: NON-CONFORMING SIGNS:

   All signs that have been made non-conforming by the adoption of provisions contained within this chapter shall be subject to the following regulations:
   A.   Any sign or portion thereof declared unsafe by the city must be restored to a safe condition or removed within thirty (30) days of written notice of the unsafe condition.
   B.   A non-conforming sign shall not be reconstructed, raised, moved, placed, extended, or enlarged unless said sign is changed so as to conform to all provisions of this chapter.
   C.   Non-conforming signs which have been allowed to deteriorate or which have been damaged by fire, explosion, acts of God, acts of the public enemy, or damaged by any other cause to the extent of more than sixty (60) percent of its assessed value shall if repaired or rebuilt, be repaired, or built in conformity with the regulations of this chapter or shall be removed.

10-24-9: SIGN MATRIX:
