There is created a Planning Commission to be composed of seven (7) voting and one nonvoting member, who is a representative of the City Council, and two (2) alternate members, who are appointed by the Mayor, with the advice and consent of the City Council, from among qualified electors of the City in a manner providing balanced geographic, professional, neighborhood and community interest representation. 10-4-2: APPOINTMENT; TERM; REMOVAL; VACANCIES:
The terms of the Planning Commission shall be staggered. Each member of the Planning Commission shall serve for a term of three (3) years and until their successor is qualified and appointed; provided, that the term of the members shall be such that the terms of two (2) members shall expire one year, the terms of two (2) members shall expire in the next year, and the terms of three (3) members shall expire in the next year. Members may serve a maximum of two (2) consecutive terms. Terms of members of the Planning Commission shall begin on July 1 of each year. The Governing Body may remove any member of the Planning Commission for cause and after public hearing, if one is requested. Vacancies shall be promptly filled in the same manner as the original appointment for the remainder of the unexpired term. An unexpired term shall not be counted toward the maximum number of terms. The Mayor, with the advice and consent of the City Council, may appoint up to two (2) alternate members to the Planning Commission for a term not to exceed three (3) years. The prior term of an alternate member who subsequently becomes a full time member shall not prevent that member from serving two (2) consecutive terms. The Planning Commission shall select a Chairperson and Vice Chairperson annually, who will serve for a term of one year. The Vice Chairperson shall serve as Chairperson during any period of the Chairperson's absence, inability, refusal or failure to act. 10-4-3: POWERS AND DUTIES:
The Planning Commission shall:
A. Prepare and recommend a General Plan and amendments to the General Plan to the City Council;
B. Prepare and recommend Zoning Ordinances and maps, and amendments to Zoning Ordinances and maps, to the City Council;
C. Administer provisions of the Zoning Ordinance, where specifically provided for in the Zoning Ordinance;
D. Prepare and recommend Subdivision Ordinances and amendments to those Subdivision Ordinances to the City Council that regulates the subdivision of land in the City;
E. Recommend approval or denial of subdivision applications as provided in chapter 18 of this title;
F. Approve or deny conditional use permits;
G. Recommend an Appeal Authority for the City to the City Council;
H. Advise the City Council on matters as the City Council directs and hear or decide any matters that the City Council designates, including those powers authorized by State law;
I. Conduct such public hearings as are required by law or as may be deemed necessary by the Planning Commission;
J. Exercise any other powers that are necessary to enable the Planning Commission to perform its functions or delegated to it by the City Council. (Ord. 19-07, 9-3-2019)

The Planning Commission may adopt such rules that it deems necessary for the conduct of its proceedings. Meetings of the Planning Commission shall be held at the call of the Chairperson and at such times as the Planning Commission may determine. The Planning Commission shall keep minutes of its proceedings, showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall immediately be filed in the Office of the City Recorder, which shall be the Office of the Planning Commission, and shall be a public record.
A. Meetings: The Planning Commission shall meet as necessary and at such times as the Planning Commission may determine. Meetings shall be held at the City offices or at such other reasonable locations within the City as the Planning Commission may adjourn from time to time. Meetings shall be held in accordance with the provisions of Utah Code Annotated title 52, chapter 4, as amended, entitled Open and Public Meetings Act, or any successor statute enacted in its place.
B. Quorum: Four (4) members of the Planning Commission shall constitute a quorum. An alternate member may be counted as part of the membership for a quorum. A majority of the voting members present at a meeting at which a quorum is present shall be required for any action. No less than four (4) yes votes are required for passage of any action.

10-4-5: COMPENSATION:
The City Council may, by resolution, fix per diem compensation for the members of the Planning Commission based on meetings actually attended. Per diem compensation is set at fifty dollars ($50.00). Members of the Planning Commission may also be reimbursed for reasonable expenses incurred while acting in their official capacity. The non-voting representative of the City Council shall not receive per diem.
