Zoning Districts and Zoning Map

§ LDO-301 ZONING DISTRICTS.

For the purpose of this ordinance, the Township of Frelinghuysen is hereby divided into five (5) districts as follows:
"AR-6" Agricultural Residential (6 acres)
"VN-1" Village Neighborhood (1 acre)
"VN-2" Village Neighborhood (2 acres)
"NC" Neighborhood Commercial
"ROM" Research, Office & Manufacturing

§ LDO-302 OPTIONAL DEVELOPMENT ALTERNATIVES.

In addition to the permitted uses within each of the designated zoning districts, alternative development is permitted in accordance with the requirements of this ordinance on certain lands as follows:

In the "VN-1," "VN-2," and "AR-6" Districts in accordance with the specific requirements of this ordinance. Standards governing lot size averaging are found in Section 604 of this ordinance.

§ LDO-303 ZONING MAP AND CRITICAL AREAS MAP. [1]

The boundaries of said zoning districts are hereby established as shown on the Zoning Map, Township of Frelinghuysen, dated November 19, 2003, and revised through April 2020, which, with all explanatory matter thereon, is hereby adopted and made a part of the ordinance. An official copy of said Map, indicating the latest amendments, shall be kept up-to-date in the office of the Construction Official for the use and benefit of the public and shall have the most-current revision date shown thereon. The Zoning Map shall be the official reference as to the current zoning classification of land within the boundaries of the Township of Frelinghuysen.
Additionally, the following maps (collectively, the Critical Areas Maps) are hereby made part of this ordinance:

Surface Water Quality Map prepared November 5, 2013;

Wetlands Map prepared May 16, 2013;

Carbonate Rock Areas Map prepared October 28, 2012;

Slopes Map prepared October 29, 2013;
(f)  
Targeted Farms Map prepared November 5, 2013, and
(g)  
Natural Heritage Priority Sites Map prepared May 10, 2012.
Information depicted on the Critical Areas Maps has been prepared as accurately as possible; nevertheless, it must be understood that detailed information mapped at such a large scale may not represent the actual conditions on any particular parcel of land. Therefore, the information is not intended to take the place of specific on-site engineering data presented to the Township at the time applications are submitted for approval of a subdivision, site plan, construction permit, and/or any other application which considers the "critical areas" categories of information depicted on the maps.
Finally, while not included as a "critical areas" environmental factor per se, hydric soils have been mapped as part of the Land Use Plan portion of the Frelinghuysen Township Master Plan, and such lands shall not be developed where prohibited by this ordinance or state and/or federal law(s).

§ LDO-304 INTERPRETATION OF BOUNDARIES.

A. 
Zoning district boundary lines are intended to follow street center lines, railroad rights-of-way, streams and lot or property lines as they exist on lots of record at the time of enactment of this ordinance unless otherwise indicated by dimensions on the Zoning Map.
B. 
Any dimensions shown on the Zoning Map are in feet and are measured horizontally and, when measured from a street, are measured from the street right-of-way line even if the center line of that street is used for the location of the zoning district line.
C. 
The exact location of any disputed zoning district boundary line shall be determined by the Zoning Board of Adjustment.
D. 
The zoning standards, controls and designations apply to every structure, lot and use within each district and the district lines extend vertically in both directions from ground level.

§ LDO-305 ZONING MAP AMENDMENTS.

The Township of Frelinghuysen Zoning Map, dated April 2020, incorporates all amendments to date. The Zoning Map can be found under Attachment 11.
