Historical Standards
It is the intent of this Article to ensure that all construction, remodeling, refurbishing, re-siding, application of stucco, painting, application of gutters and downspouts and any and all construction or modification to any existing building in the Town and located in the Business or Commercial Zoning District will be completed in a manner that enhances and maintains the uniqueness of the Town and maintains the small town character and historical nature of the Town.

(a)
These standards shall apply to all construction, remodeling, refurbishing, re-siding, application of stucco, painting, application of gutters and downspouts, and any and all construction or modification to any existing building within the Town and shall apply equally to any Commercial, Business, Residential-Business and Residential Zoning Districts in the Town. The standards herein set forth shall also apply to construction or application of signs and are intended to assist in upgrading the appearance of the Town and to maintain the historic character of the Town.

No new access shall be granted to any lot or parcel except upon approval by the Board of Trustees.

(a)
New buildings, reconstruction of existing buildings, re-siding of existing buildings, remodeling, refurbishing, application of stucco, painting and application of gutters and downspouts shall be compatible with existing commercial and residential structures and shall replicate early twentieth century construction, construction materials, architectural styles, height, scale, mass and the use of neutral colors consistent with existing structures in early twentieth century design and architecture. Alternative materials may include rock, brick or native stone.
(b)
The ground floor of new business or commercial buildings facing a street shall be designed to include a storefront. The front building line of all new buildings shall primarily be designed and constructed to align immediately behind the attached sidewalk of streets. Recessed doorways may be permitted to create interest on the front of the building. Outdoor seating, patios, display and landscaping areas are encouraged adjacent to sidewalks.
(c)
Restoration or renovation of existing buildings shall be encouraged. Where original facade materials, architectural detail, storefronts and entryways exist, they should not be covered or altered and shall be encouraged. Contemporary modifications may be appropriate where historic elements have been removed.
(d)
Additions to existing buildings shall be designed to be compatible with the existing building through the use of compatible architectural style, materials, height, scale, mass and color.

The maximum building height shall be 40 feet. Building height for new construction shall be of a similar height to existing adjacent buildings, but in no event shall it exceed the 40-foot height limit.

(a)
Security or privacy fencing not exceeding six feet in height, located on the rear half of the property and not visible from 8th Avenue, may be permitted if the use of the enclosed area and the design of the fence meets the intent of the commercial standards. Outside storage in the enclosed area is allowed as it may pertain to the use of the building. Decorative fencing that is at least 50 percent open is encouraged.
(b)
Fencing in the side or front yards shall be limited to six feet in height. Fencing shall not interfere with clear vision sight lines on corner lots.
(c)
All exterior fences which are made of wood shall be finished with a neutral stain and clear seal, or left in the natural color of the wood. Painted fences shall not be permitted.
(d)
Fence support posts shall be constructed inside the fence and shall not be visible from the outside of the fence. Decorative or ornamental fences support structures may be visible if approved by the Board of Trustees.

(a)
Use of approved colors is required for all new construction, remodeling, refurbishing, re-siding, application of stucco, painting, application of gutters and downspouts and any and all construction or modification of any new or existing building, whether primary or accessory structures within the Business District, the Commercial District or fronting on 8th Avenue. Signs shall comply with this Section. Colors shall be muted early twentieth century type. Reflective, neon, primary (red, blue, yellow) and secondary (purple, green, orange) colors shall not be permitted; provided, however, that such colors may be permitted by prior approval of the Town. Acceptable colors include subtle warm and cool colors, earth-tone colors and neutral colors. The intent is not to discourage color variety, but to avoid colors that are primarily used only to attract attention. Approval of a permit shall be required prior to repainting existing buildings within the district in order to ensure compliance with these provisions. Samples of proposed materials and colors shall be provided with any building permit application or upon request of the Town.
(b)
At least 20 percent of the area of any wall of any new construction visible from a public right-of-way shall contain windows and/or doors. Each window not recessed or otherwise architecturally enhanced (such as with decorative molding, sills, mullions, arches or cornices; window boxes; awnings; multi-paned windows; or bay windows) shall have at least a three-inch-wide exterior trim and be constructed of acceptable building material around the window. Overhead doors shall not be placed facing any public right-of-way.

(a)
Awnings shall reflect traditional prototypes in scale and placement but may be contemporary in design. Awning configuration shall coordinate with adjacent buildings or adjacent awnings in height, width and profile. Awnings shall not cover architectural elements or span across structural bays.

Awning color shall be muted and shall comply with the overall color scheme and comply with the color standards set forth in Section 16-10-60 above.

(a)
Landscaping. A landscape plan shall be required for all new business or commercial construction, free construction, remodeling or change of existing use.
(b)
Buffering. Buffering shall be provided between land uses of different intensities, such as between residential and commercial uses. The responsibility for buffering shall rest with the proposed land use, rather than with existing land uses. Buffering may be accomplished through the use of dense plant materials, fencing, walls, berms or a combination of these methods and shall provide visual screening between the land uses, as well as screen or mitigate other negative impacts such as noise or lighting.

(a)
Parking for nonresidential land uses shall generally be required as shown in the following chart. A waiver from the parking requirements due to the capacity of the site and nature of the use may be requested by the applicant and may be approved by the Planning and Zoning Commission or Board of Trustees, as applicable.

If the number of parking spaces required results in a fractional space, any fraction shall be counted as 1 additional parking space.

Off-street parking requirements in the above Table may be partially met by on-street parking, subject to approval by the Planning and Zoning Commission or Board of Trustees, as applicable.
(c)
Parking for the disabled shall be provided as required by the Americans with Disabilities Act (ADA) and shall be identified by an upright sign at least four and one-half feet in height.
(d)
Parking spaces shall be eight and one-half feet in width and 18 feet in length. The parking space length may be reduced to 17 feet if there is a landscaped area or sidewalk at least six feet in width to provide a two-foot overhang, as long as wheel stops are provided and the overhang does not negatively impact the adjacent landscaping or sidewalk.

Compact parking spaces eight feet in width and 16 feet in length may be used for long-term parking areas, such as for employee parking. Compact parking spaces shall not exceed 25 percent of the total amount of required parking spaces and shall be identified by an upright sign at least four and one-half feet in height, posted for every eight compact parking spaces.
(f)
Parking lots shall be screened through the use of dense shrubbery, low walls, berms or a combination of these methods a minimum of three feet in height, so that at least 50 percent of the light from headlights of vehicles in the parking lot is screened from view beyond the parking lot.
