Sections:
No amendment, supplement or change of the zoning ordinance codified in this title or the zoning district map shall become effective unless and until the following has occurred:
A.
There has been held a public hearing in relation thereto before the town zoning commission at which parties in interest and citizens have had an opportunity to be fully heard.
B.
Notice of the proposed change and of the time and place of the hearing has been published once a week for three different weeks in the official paper of the town. At least fifteen days shall elapse between the first publication and the date of the hearing.
C.
A printed notice in bold type has been posted, for not less than ten consecutive days prior to the hearing, on signs not less than one and one-half square feet in area which have been prepared, furnished, and placed by the building inspector on each block of each street adjoining the area proposed for a change in zoning classification. Said signs shall contain an accurate statement of the proposed changes and also the time and place of the public hearing as provided in subsection B of this section. The town zoning commission shall have submitted its report and recommendations upon the proposed changes and amendments to the clerk of the town council. The town council shall not hold its public hearings or take action until it has received the final report of the zoning commission. Notice of such public hearing by the town council shall give the time and place of the hearing and shall be published once a week in three different weeks in the official journal of the municipality or, if there is none, in a paper of general circulation therein. At least fifteen days shall elapse between the first publication and the date of the hearing.
D.
Any amendment that has failed to receive the approval of the planning commission shall not be passed by the town council except by the affirmative vote of three-fifths of the legislative body of the municipality.
E.
A final yea and nay vote has been taken on the proposal by the town council within one hundred twenty days dated from the introduction of an ordinance in correct form.
F.
In case, however, of a protest against any such change signed by the owners of twenty percent or more of the area of the lots included in such proposed change, or in those lots immediately adjacent extending two hundred feet therefrom, or of those lots directly opposite thereto extending five hundred feet from the street frontage of such opposite lots, such amendments shall not become effective except by the favorable vote of at least three-fifths of the governing body of the town.
