Retaining Walls — Yard | Setback Requirements |

Side Yard | A retaining wall must be set back from a side lot line a minimum of one (1) foot for every vertical foot (or part thereof) of rise but in no case shall the retaining wall exceed six (6) feet in total vertical rise. |
Rear Yard | A retaining wall must be set back from a rear lot line a minimum of four (4) feet at which point it can be up to three (3) feet in height: thereafter the wall must be setback one (1) additional foot for every vertical foot (or part thereof) of rise over three (3) feet, but in no case shall the retaining wall exceed six (6) feet in total vertical rise. |
Front Yard | A retaining wall must be set back from a front lot line a minimum of three (3) feet. No retaining wall may exceed three (3) feet in height. |
Railings or fencing required for safety on top of a retaining wall shall not be included in the calculation of overall retaining wall height. | |
On lots used for non-residential uses, the retaining wall(s) shall be as approved through the development plan process. | |
A building permit is required for a retaining wall(s) where any one (1) of the following conditions would be present after its construction. Measure retaining wall heights from the top of grade at the wall's base to grade on the retained side at the top of the wall: | |
1. The wall height would exceed 3'-0". | |
2. The wall height would exceed 2'-0" and would be surcharged by a driveway, pool, or other structure. | |
3. The wall's distance from a property line would be less than or equal to the wall's height. | |
4. The top of the wall would have a guardrail or fence on or behind it, and the combined height of the wall and guardrail or fence would exceed 6'-0". | |
All company service vehicles, fleet vehicles, trucks, equipment and/or machinery used in conjunction with a permitted use shall be stored overnight such that they are screened with a landscape buffer or are not visible from a public street. |
