ARTICLE 14

Business Professional B-1 District

Sec. 16-14-10.- Intent.

The Business Professional (B-1) District is intended to allow for appropriately located groups of retail stores, office buildings, service establishments and civic uses serving the daily needs of the neighborhood, and of such character, scale, appearance and intensity so as to be compatible with surrounding residential areas.

Sec. 16-14-20. - Uses by right.

Uses by right are as follows:

(1)

Offices;

(2)

Pharmacies;

(3)

Schools, universities, and colleges;

(4)

Places of worship;

(5)

Child care facilities;

(6)

Assisted living facilities;

(7)

Open space, parks and trails;

(8)

Clubs;

(9)

Public buildings and facilities; and

(10)

Accessory uses, not exceeding ten percent (10%) of the NFA and wholly included within the principal building.

Sec. 16-14-30. - Special uses.

Uses permitted in accordance with an SUP are as follows:

(1)

Public buildings and facilities other than general office;

(2)

Public utilities; and

(3)

Businesses with drive-in or drive-up facilities.

Sec. 16-14-40. - Open space.

The minimum open space on a parcel shall be forty percent (40%).

Sec. 16-14-50. - Rezoning.

Every rezoning shall require an SDP.

Sec. 16-14-60. - Development standards.

Every lot shall have a minimum frontage width of one hundred (100) feet.

Sec. 16-14-70. - Setbacks.

Principal buildings shall comply with the following:

(1)

Minimum front setback: fifty (50) feet.

(2)

Minimum side setback: fifteen (15) feet on an interior lot; twenty-five (25) feet on a corner lot.

Minimum rear setback: twenty-five (25) feet.

Sec. 16-14-80. - Height.

(a)

The maximum height shall be twenty-five (25) feet at all minimum setback lines, and for each additional foot of height, an additional three (3) feet of setback on all sides.

(b)

Notwithstanding Subsection (a) hereof, buildings shall not exceed ninety-five (95) feet in height, or thirty (30) feet in height within six hundred sixty (660) feet of any lot zoned R-2.5, R-2.0, R-1.5, R-1.0, R-0.75, R-0.5, R-0.25, R-0.1 or R-0.05.
