ESTABLISHMENT OF ZONING DISTRICTS
For the purpose of this ordinance the City of Hartsville is hereby divided into the following zoning districts:
Zoning district A agricultural;
Zoning district R-1 residential;
Zoning district R-1A residential;
Zoning district R-2 residential;
Zoning district P-1 professional offices;
Zoning district B-1 central business;
Zoning district B-2/B-3 neighborhood business;
Zoning district M-1 industrial;
Zoning district M-2 industrial;
Zoning district CA campus.
The boundaries of the above zoning districts are hereby established as shown on the zoning map of the City of Hartsville which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this ordinance.
The comprehensive zoning map shall be identified by the signature of the mayor attested by the city clerk, and bearing the seal of the city under the words: "Comprehensive Zoning Map, City of Hartsville, South Carolina," together with the date of adoption of this ordinance [February 10, 1987].
If changes are made in district boundaries or other matter portrayed on the comprehensive map, such changes shall be entered on the comprehensive zoning map within five days after the amendment has been approved by the council. No amendment to this ordinance which involves zones or districts shown on the comprehensive zoning map shall become effective until after such change has been made on said map.
No changes of any nature shall be made on the official zoning map or matter shown thereon except in conformity with the procedures set forth in this ordinance. Any [un]authorized change of whatever kind by any person or persons shall be considered a violation of this ordinance and punishable as provided by law.
Regardless of the existence of purported copies of the comprehensive zoning map, which may from time to time be made or published, the comprehensive zoning map which shall be located in the planning and development office shall be the final authority as to the current zoning status of land and water areas, buildings, and other structures in the city.
Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:
(a)
Boundaries indicated as approximately following the centerlines of streets, highways, or alleys shall be construed to follow such centerlines.
(b)
Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines. No lot shall be divided longitudinally or transversely by such boundary, but the boundary shall follow the appropriate lot line.
(c)
Boundaries indicated as approximately following city limits shall be construed as following such city limits.
(d)
Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
(e)
Boundaries indicated as following the centerlines of ditches, streams, rivers, canals, lakes, or other bodies of water shall be construed to follow such centerlines.
(f)
Boundaries indicated as parallel to or extensions of features indicated in subsections (a) through (e) of this section shall be so construed. Distances not specifically indicated on the official zoning map shall be determined by the use of the scale of the map.
(g)
Where physical or cultural features existing on the ground are at variance with those shown on the official zoning map, or in other circumstances not covered by subsections (a) through (f) of this section, the zoning board of appeals shall interpret the district boundaries.
Where city limit boundaries change by virtue of annexation or some other means, the following provisions shall apply:
(a)
The land areas incorporated shall be classified zone agricultural until such time as the city council may change such classification through normal amendment procedures. When development already exists on land proposed for annexation, this classification amendment may take place with the annexation ordinance.
(b)
In all cases where annexation to the city's total land area requires adjustments in the zoning district boundaries, said adjustment shall be made on the comprehensive zoning map within five days after the effective date of annexation.
