Driveways and Sidewalks
§ 295-39 General provisions.
For the reasons stated in §§ 295-2 and 295-3, in particular for traffic and pedestrian safety both on and off the street, as well as to provide for possible future road widening, realignment or other improvements, all new driveways and sidewalk crossings entering onto any street shall comply with all requirements of §§ 295-40 through 295-44 below and shall be subject to the approval of the Building Inspector, except where such driveways or crossings are part of a use subject to a special use permit or a site plan, in which case they shall be subject to Board of Appeals or Planning Board approval, as required by this chapter.
§ 295-40 Driveway grades.
A.
Single-family dwellings.
(1)
Between the paved street and the required minimum setback line (the minimum yard requirement), the maximum grade for any new driveway accessory to a single-family dwelling shall be 15%, but the Planning Board shall have the discretion to allow a grade as steep as, but no steeper than, 20%.

Notwithstanding the maximum permitted grades specified in Subsection A(1) of this section, no driveway serving a single-family dwelling shall have an entrance grade in excess of 3% within 30 feet of the center line of the traveled way of the street, or within 20 feet of the front property line, whichever distance is greater.
B.
Other than single-family dwellings.
(1)
Between the paved street and the required minimum setback line (the minimum yard requirement), the maximum grade for any new driveway accessory to a permitted use, building or structure other than a single-family dwelling, and connecting to a street, shall be 8%, but the Planning Board in approving a site plan shall have the discretion to allow a grade as steep as, but no steeper than, 12%.

Notwithstanding the maximum permitted grades specified in Subsection B(1) of this section, no driveway serving a permitted use other than single-family residence shall have an entrance grade in excess of 3% within 50 feet of the center line of the traveled way of the street, or within 30 feet of the front property line, whichever distance is greater. The Planning Board may increase these requirements in situations where, because of the nature of the proposed use or other circumstances, substantial traffic volumes are anticipated.
§ 295-41 Maximum driveway size and curbcuts.

§ 295-42 Driveway alignment and location.
Any driveway entering onto a street shall be located and aligned in such a way as to minimize possible traffic hazard. The entrance portion of the driveway, as required by § 295-40 above, shall be aligned and constructed so as to permit vehicles to enter and exit at approximately right angles to the street. Driveways serving any building, structure or use other than a single-family residence shall enter the street only over a stepped curb provided by the property owner and approved by the Building Inspector.
§ 295-43 Sight distance.
Clear visibility shall be provided in both directions at all exit points so that motorists stopped on the entrance grade portion of any new driveway will have an unobstructed view of the intersected road for a reasonable distance (commensurate with the speed and volume of traffic on such road) and so that the motorist traveling on the road shall have such view of the automobile in the driveway.
§ 295-44 Sidewalks crossings or driveway entrances.
Sidewalk crossings or driveway entrances for whatever purpose shall be subject to the approval of the Village Engineer as to safety, drainage and adequacy of width, grade, sight distance and construction.
