A MULTIFAMILY APARTMENT DISTRICT
§ 27-1601 Statement of Intent.

The specific intent of this district is to permit the continued development and/or redevelopment of multifamily apartments in selected areas of the Borough, and to provide for new construction or conversion of existing apartments into elderly housing.
§ 27-1602 Permitted Uses.
§ 27-1603 Special Exceptions.

The following uses may be permitted by the Zoning Hearing Board as special exceptions if they conform to the standards and criteria listed in § 27-1606, below, and § 27-611.
A.
Elderly housing, consisting of:
(1)
Apartment Housing Units. Multifamily dwellings in which each group of living units is associated with one or more common areas designed for the exclusive benefit of the group. Each living unit shall contain at a minimum a separate bedroom and a complete bathroom. Each living unit shall provide cooking, dining, bathing and toilet facilities. Common areas may also be provided for recreation, relaxation, clothes washing and similar activities. The requirements of this section are met if at least 80% of the dwelling units are occupied by at least one person 55 years of age or older.
(2)
Personal Care Congregate Facilities. Premises, or a portion thereof, in which food, shelter, and personal assistance are provided for a period exceeding 24 consecutive hours for residents requiring supervision and assistance in such matters as dressing, bathing, diet, or medication prescribed for administration, but not requiring hospitalization or skilled care. Facilities shall include a living/sleeping area and a toilet, although a shared bath will be permitted.
§ 27-1604 Dimensional Standards.

The following standards shall apply to any permitted or conditional use in the A District:

A. | For each studio or one bedroom unit, a lot of 2,500 square feet. | ||
B. | For each unit with two or more bedrooms, a lot area of 3,000 square feet. | ||
C. | For elderly housing, a density of 15 units per acre. | ||
4. | Front yard setback: | 30 feet. | |
5. | Side yard setback: | 20 feet for each side yard. | |
6. | Rear yard setback: | 40 feet. | |
7. | Maximum building coverage: | 25% of lot area. | |
8. | Maximum impervious coverage: | 65% of lot area. | |
9. | Minimum landscaped area: | 30% of lot area. | |
10. | Maximum building height: | 35 feet. | |
11. | Minimum building separation: | ||
A. | Between ends of buildings, or end of one building and side (long dimension) of another: 20 feet. | ||
B. | Between parallel sides of buildings: 65 feet. | ||
§ 27-1605 Design Standards.

Each apartment unit shall contain a minimum of 500 square feet of floor area plus an additional 100 square feet for each additional bedroom in excess of one.
2.
No parking shall be permitted within front yard areas.
§ 27-1606 Special Exception Standards.

The tract to be developed shall be in a single ownership or under a single development plan.
2.
The traffic impacts of the development shall not exceed those of conventional apartment development. The Borough may require a traffic study to document these impacts.
3.
The applicant must guarantee occupancy only by persons 62 years or older, their spouses or companions, or by persons 55 years of age or older if the housing meets the criteria of the Civil Rights Act of 1968, as amended, or any succeeding legislation.
A.
The guarantee shall be in a form acceptable to Borough Council, upon recommendation by the Borough Solicitor.
B.
The guarantee shall be a covenant running with the land, applicable to the applicant and his heirs, successors and assigns.
C.
If, at any time, elderly residents cannot be guaranteed, the property shall be converted to comply with the standard apartment requirements of this district.
D.
Safety and Convenience Features. Proposed developments shall comply with the most recent edition of Minimum Property Standards, Volume I, "Housing for the Elderly," issued by the U.S. Department of Housing and Urban Development.
