CHAPTER 12

- PENALTIES AND REMEDIES

Section 2-2-12-1. - Penalty for violations.

Any person violating any of the provisions of this code shall be guilty of a misdemeanor, and upon conviction, shall be fined not more than $2,500.00 or the maximum amount provided for by IC 36-1-3-8(9) and (10). Each day that a violation exists shall constitute a separate offense.

Section 2-2-12-2. - Injunction to restrain.

The commission, board, and the executive secretary of the board and commission, or any designated enforcement official, or any person or persons, firm or corporation, jointly or severally aggrieved may institute a suit or injunction in the circuit court of Porter County to restrain an individual or a governmental unit from violating any of the provisions of this code.

Section 2-2-12-3. - Mandatory injunction.

The commission or the board may also institute a suit for a mandatory injunction directing any individual, corporation or governmental unit to remove a structure erected in violation of the provisions of this code.

Section 2-2-12-4. - Nuisance.

Any building or structure erected, raised, or converted, or land or premises used in violation of any provisions of this code or the requirements thereof, is hereby declared to be a common nuisance, and as such may be abated in such a manner as nuisances are now or may hereafter be abated under the existing law.
