CHAPTER 14

- PARABOLIC AND DISH ANTENNAE

Section 2-2-14-1. - Permit required.

No parabolic or dish type antennae shall be made operational in the town until the building commissionser shall certify in writing that both the construction plans and the final construction meet the requirements of this code.

Section 2-2-14-2. - Definitions.

Parabolic or dish type antennae as used herein means any concave, circular or dish shaped device designed for receiving communication or television signals from a satellite or any other source.

Section 2-2-14-3. - Regulations.

All parabolic or dish type antennae located outside of the building shall meet the following requirements:

Maximum number per lot: One.

B.

Maximum height: 13 feet.

C.

Maximum diameter: Ten feet.

D.

Minimum setback from all property lines of lot: Ten feet.

E.

No antennae may be located in a front or side yard.

F.

All parabolic or dish type antennae shall be mounted so that the center of the antennae is no higher above ground level than one-half the diameter of the circle of the antennae.

G.

No parabolic or dish type antennae larger than 15 inches in diameter shall be roof mounted.

H.

All parabolic or dish type antennae shall be either the original metallic color or white or earth tone colors so as to blend with the landscape.

I.

No parabolic or dish type antennae shall bear any printing, writing, pictures, advertising, logos or depiction of any type whatsoever; provided, however, that the name and address of the owner; manufacturer or installer may appear in an area not to exceed two square feet.

Section 2-2-14-4. - Enforcement; declared a nuisance; remedies.

Any violation of this chapter is hereby declared to be a nuisance, in addition to any other relief provided by this code, the town attorney may apply to a court of competent jurisdiction for any remedy to prohibit the continuation of any violation of this code.

Section 2-2-14-5. - Penalty.

Any person, firm, or corporation violating any provision of this code shall be fined not more than $2,500.00 or the maximum amount provided for by IC 36-1-3-8(9) and (10) for each offense, and a separate offense shall be deemed committed on each day during which a violation occurs or continues to occur.

Section 2-2-14-6. - Civil penalties.

Any person, firm, or corporation violating the provisions of this chapter shall be subject to a civil penalty in the amount of $50.00 for each offense, and a separate offense shall be deemed committed on each day on which a violation occurs or continues to occur. This chapter shall be subject to the Hebron Ordinance Violations Bureau as set out in chapter 2, article VII.
