ARTICLE II
General District Regulations
§ 130-5 Enumeration of districts.
The Town of Henlopen Acres shall hereafter be divided into four districts, more particularly described and shown upon the Town of Henlopen Acres Zoning Map, in which districts shall be designated as follows:
§ 130-6 Zoning Map.

The boundaries of said districts shall be as shown upon a map designated as Map 5 within the Henlopen Acres 2014 Comprehensive Plan, attached to and made a part of this chapter, which shall be and is hereby designated as the "Town of Henlopen Acres Zoning Map." The map and all notations, references and other data shown thereon are hereby incorporated by reference into this chapter and shall be as much a part of the chapter as if fully described herein.[1]

§ 130-7 District boundaries.

Where uncertainty exists with respect to the boundaries of the various districts as shown on the Town of Henlopen Acres Zoning Map, the following rules shall govern:
A.
The district boundaries shall be the center lines of streets, avenues and lanes, unless otherwise shown; and where the designation of the Zoning Map indicates a boundary approximately upon a street line, the center line of such street shall be construed as the boundary.
B.
Where the district boundary indicates a boundary approximately upon a lot line, the lot line shall be construed as the boundary.
C.
In case of doubt or disagreement concerning the exact location of boundary lines, the determination shall lie with the Board of Adjustment.
§ 130-8 Permitted and accessory uses.
In each district only such uses, and uses accessory and incidental thereto, as are hereinafter specified, and having plans approved by the Environmental Approval Committee, will be permitted.
§ 130-9 Nonapplicability.

The provisions of this chapter shall not be applicable to governmental functions limited to sewer pumping stations, flow meters, sanitary sewer pipelines, water distribution pipelines, stormwater drainage pipelines, sanitary sewer system laterals, water system laterals, appurtenances for sanitary sewer system, necessary storage materials during periods of construction and installation of sanitary sewer lines, water distribution and transmission pipelines, stormwater drainage pipelines, temporary structures used for construction purposes but not for living quarters and auxiliary power sources for governmental functions.
