Sec. 78-7

Remedies.

(a)

Fines. Any person who knowingly, intentionally, recklessly, or as a result of criminal negligence as these terms are defined in V.T.C.A., Penal Code art. 6.03, violates any of the provisions of this chapter shall, upon conviction thereof, be fined not less than $1.00 nor more than $2,000.00 and each day's violation shall constitute a separate offense.

(b)

Additional remedies. In case any building or structure is erected, constructed or reconstructed, structurally altered, repaired, converted or maintained, or any building, structure or land is used in violation of this chapter, the city or any proper person may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, to restrain, correct or abate such violation, to prevent the occupancy of said building, structure or land, or to prevent any illegal act, business or use in or upon such premise, including, but not limited to, all remedies provided in of the Local Government Code, § 211.012. In addition to the remedies enumerated above, the city may recover a civil penalty of $2,000.00 for each day's violation of this chapter. The imposition of any penalty hereunder shall not preclude the city or any other proper person from instituting any appropriate action or proceedings to require compliance with provisions of this chapter and with administrative orders and determinations made hereunder.
