CHAPTER 4

RESIDENCE ZONES

10-4A-1: USES PERMITTED:

The following uses shall be permitted in the Residence R Zone:
Accessory buildings.
Automobile parking space to be provided as required in Chapter 10 of this Title. Places of religious worship and home occupations as defined in section 10-1-4 of this Title with restrictions listed below.
Publicly owned buildings and lands.
Signs. One on each lot not exceeding six (6) square feet in area pertaining to the lease or sale of the building or premises on which the sign is located. See Chapter 13 for additional sign requirements.
Temporary buildings and uses for construction purposes for a period not to exceed one (1) year.
Truck gardening and other horticultural uses, where no building is involved and not operated for profit. (1985 Code § 9-4A-1; amd. Ord. 22-04, 4-11-2022)

10-4A-2: SITE AND STRUCTURE REQUIREMENTS:

   A.   Building Height: No building or structure, nor the enlargement of any building or structure, shall be hereafter erected or maintained in the Residence R Zone to exceed two and one half (2-1/2) stories, nor shall it exceed thirty five feet (35') in height.
   B.   Areas: No building or structure, nor the enlargement of any building or structure, in the Residence R Zone shall be hereafter erected or maintained unless the following described yards and lot areas are provided and maintained in connection with such building, structure or enlargement:
      1.   Yards:
         a.   Front Yard: Each lot upon which a dwelling is constructed shall have a front yard of not less than twenty feet (20'). Where lots comprising forty percent (40%) or more of the frontage between two (2) intersecting streets are developed with buildings having front yards with a variation of not more than fifteen feet (15') in depth, the average of such front yards shall establish the minimum front yard depth for the entire frontage. In no case shall a front yard of more than twenty feet (20') be required.
         b.   Side Yard:
            (1)   Interior Lots: On interior lots, there shall be a side yard on each side of a main building having a width of not less than five feet (5') or less than ten percent (10%) of the lot width, whichever is greater.
            (2)   Corner Lots: On corner lots, the side yard requirements shall be the same as for interior lots; except that there shall be maintained a side yard of not less than ten feet (10') on the side adjacent to the street, which intersects the street upon which the building or structure maintains frontage.
            (3)   Reversed Corner Lots: On a reversed corner lot, there shall be maintained a setback from the side street of not less than fifty percent (50%) of the front yard required on the lots in the rear of such corner lots, but such setback need not exceed twenty feet (20'). No accessory building on a reversed corner lot shall project beyond the front yard required on the adjacent lot to the rear, nor be located nearer than three feet (3') to the side lot line of an adjacent lot.
         c.   Rear Yard: There shall be a rear yard having an average depth of not less than thirty feet (30') and not less than six (6') feet in any one location.
   C.   Yard obstructions allowed.
      1.   All other allowances and restrictions are applicable.
         a.   Front - Bow or bay windows, trellises, fences, sidewalks, and driveways.
         b.   Side yards - AC compressors, bow or bay windows, sidewalks, driveways, generators, and chimneys.
         c.   Rear yards - AC compressors, bow or bay windows, sidewalks, driveways, generators, and chimneys.
      2.   Lot Coverage: Not more than fifty percent (50%) of the area of a lot may be covered by main buildings, structures, or accessory buildings.
      3.   Lot Area: Every dwelling erected or structurally altered shall be on a lot having an area of not less than six thousand (6,000) square feet and a width at the established building line of not less than fifty feet (50'); provided, however, that a single lot having less area and width, the title to which has been recorded before the effective date hereof, may be improved with a single-family dwelling, provided all yards and open spaces are within seventy five percent (75%) of those required herein; and provided further, the total lot area is not less than five thousand (5,000) square feet.
      4.   Accessory Buildings:
         a.   Accessory buildings shall not encroach upon the front yard. They may encroach upon the side yards, provided no buildings are closer to the lot lines than three feet (3') and provided further that on a corner lot, accessory buildings shall not encroach upon the front or side yards adjacent to the abutting streets.
         b.   Accessory buildings shall include within its definition garages, and any garage size may be used, provided that the floor dimensions do not exceed nine hundred sixty (960) square feet and a maximum height of seventeen feet (17') from the finished floor.
         c.   All newly constructed attached garages or additions to existing garages shall have the roofline conform with the main building's roof line. A secondary roofline is not allowed.
         d.   The total area of the accessory building and main building shall not exceed fifty percent (50%) of the lot size area.
         e.   The total area of a shed and a garage shall not exceed nine hundred sixty (960 square feet.
      5.   Shed shall not be closer than ten feet (10') to the primary structure, a minimum of three (3') feet from the side and rear yard, not allowed in the front yard, and have a maximum height of twelve feet (12').
   D.   Size Of Dwelling:
      1.   Every one-story dwelling erected in any Residence R Zone shall have a total ground floor area of not less than one thousand three hundred fifty (1,350) square feet, measured from the outside of the exterior walls, but excluding porches, garages, and other spaces that are not used frequently or during extended periods for living, eating, or sleeping purposes, except that rooms intended for such purposes which are "roughed in" and are to be completed within a reasonable time may be considered in computing such ground floor areas.
      2.   Every dwelling of more than one story erected in any Residence R Zone shall have a total floor area, measured from the outside of the exterior walls, of not less than one thousand six hundred eighty (1,680) square feet, including utility rooms but excluding cellars, basements, open porches, garages and other spaces that are not used frequently or during extended periods of time for living, eating or sleeping purposes; except, that rooms intended for such purposes which are "roughed in" and are to be completed within a reasonable time may be considered in computing such ground floor area.
   E.   Use of Basement: The basement can be used as additional living area but shall not be used as a separate apartment or living unit.
   F.   Home Occupation Restrictions are as follows:
      1.   No vehicles requiring greater than a B plate are allowed in the home driveway.
      2.   A maximum of one company vehicle with a B plate is allowed to park in the driveway.
      3.   The primary driver of the company vehicle shall reside in the home. (1985 Code § 9-4A-2; amd. Ord. 97-13, 4-14-1997; Ord. 00-06, 4-10-2000; Ord. 06-13, 8-14-2006; Ord. 22-04, 4-11-2022)

10-4A-3: PERFORMANCE STANDARDS:

Buildings, premises, and uses permitted in this district are subject to the applicable performance standards in section 10-3-4 of this Title. (1985 Code § 9-4A-3; amd. Ord. 22-04, 4-11-2022)

10-4B-1: USES PERMITTED:

The following uses shall be permitted in the residence and Multiple Dwelling R-2 Zone: Any use permitted in the Residence R Zone. Multiple dwellings, but not for more than three (3) dwelling units two-family dwelling structures. (1985 Code § 9-4B-1; amd. Ord. 22-04, 4-11-2022)

10-4B-2: SITE AND STRUCTURE REQUIREMENTS:

   A.   Building Height: No building shall be erected or enlarged in the Residence and Multiple Dwelling R-2 Zone to exceed two and one half (2-1/2') stories in height, and no more than one family per story shall be permitted to occupy said dwelling. The height of each dwelling in an R-2 Zone shall not exceed thirty five feet (35') to the ridgepole and twenty five feet (25') to the eaves of said dwelling.
   B.   Areas: No building shall be erected, nor shall any existing structure be enlarged or altered in the residence and Multiple Dwelling R-2 Zone unless the following yards and lot areas are provided and maintained in connection with such building, structure, or enlargement:
      1.   Minimum Floor Area: Each family dwelling unit in two-family structures erected, converted, or reconstructed in any residence and Multiple Dwelling R-2 Zone shall have a total ground floor area of not less than eight hundred fifty (850) square feet.
      2.   Setbacks:
         a.   There will be a five foot (5') setback on the minimum side of the dwelling with a minimum seventeen foot (17') paved (concrete or asphalt) drive on the maximum side of the building to extend the length of the dwelling or large enough to provide for two (2) parking spaces per dwelling unit.
         b.   The front yard is to conform with the requirements set forth for property located in an R Zone.
         c.   There will be a fifty foot (50') minimum from the rear of the dwelling to the property line establishing a minimum fifty foot (50') backyard.
         d.   See allowable obstruction in the previous section.
   C.   Lot Coverage:
      1.   The total area of an accessory building and the main building shall not exceed fifty percent (50%) of the lot size area.
      2.   Every dwelling erected or structurally altered to accommodate two-family dwelling units shall be on a lot having a width at the established building line of not less than fifty feet (50') and an area per dwelling unit of not less than one thousand five hundred (1,500) square feet.
   D.   Accessory Buildings:
      1.   An accessory building shall include, within its definition, garages, and any garage size may be used, provided that the floor dimensions do not exceed nine hundred sixty (960) square feet and a maximum height of seventeen feet (17') from the finished floor.
      2.   An accessory building may be constructed on the minimum fifty foot (50') backyard.
      3.   The maximum total combined area of a garage and a shed shall be nine hundred sixty (960) square feet.
   E.   Parking: There shall be no vehicle parking in front of the building. All such parking shall be restricted to the side or rear of the building as provided herein. (See section 10-10-1 for parking requirements)
   F.   Garbage Receptacles: Garbage receptacles shall be restricted to one designated contained area. The designated area for the garbage receptacle shall not be in front of the building. (2016 Code; amd. Ord. 22-04, 4-11-2022)
