CHAPTER 6

MANUFACTURING ZONES

10-6A-1: USES PERMITTED:

The following uses shall be permitted in the industrial Light Manufacturing LM Zone:
Cannabis related facilities (See Chapter 14 for additional requirements).
Machine shops.
Maintenance shops.
Manufacturing.
Processing food; except the processing of food from animal or vegetable wastes or fats, reduction of garbage, or slaughtering of animals, poultry, or fish.
Processing, material; except the processing of material from animal or vegetable wastes or fats, reduction of garbage, or slaughtering of animals, poultry, or fish.
Signs. Any object, device, display or structure, or part thereof which is used to advertise, identify, display, direct, or attract attention to an object, place, person, institution, organization, business, product, service, event, or location by any means including words, letters, figures, designs, symbols, fixtures, colors, motion, illumination or projected images. The term "sign" includes, but is not limited to, every projecting sign, freestanding sign, ground sign, pole sign, window sign, vehicle sign, awning, canopy, marquee, changeable copy sign, illuminated sign, flashing sign, animated sign,a temporary sign, portable sign, pennant, banner, streamer, or any other attention-getting device, or other display, whether affixed to or separate from any building.
Storage shall include warehouses and distribution establishments but shall not include truck parking areas as defined in section 10-1-3 of this Title.

10-6A-2: ACCESSORY USES PERMITTED:

Accessory uses incidental to the main use and on the same Zoned premises including, but not limited to, offices, garages, parking areas, storage, central heating, and air conditioning plants; facilities used solely for operating, servicing, or maintaining improvements on said premises; overnight accommodations for security and protective personnel; restaurant, and amenities for employees shall be permitted in the Light Manufacturing LM Zone. 10-6A-3: CONDITIONAL USES PERMITTED:

Conditional uses as set forth in section 10-2-5 of this Title shall be permitted in the Light Manufacturing LM Zone. (1985 Code § 9-6A-3; amd. Ord. 22-04, 4-11-2022)

10-6A-4: SITE AND STRUCTURE REQUIREMENTS:

   A.   Building Height: No building or structure (except a water tower or standpipe) shall be erected or structurally altered to exceed a height of three (3) stories, nor shall it exceed forty five feet (45') in height except as provided in this Title, or provided:
      1.   Buildings or structures may be erected to a height of sixty feet (60'), provided:
         a.   The building or structure is part of a Zoning lot exceeding one hundred fifty (150) acres;
         b.   The building or structure is set back not less than six hundred feet (600') from any adjoining Park District; and
         c.   The building or structure is set back not less than three hundred feet (300') from a perimeter arterial highway and/or three hundred feet (300') from any residential use.
      2.   Structures used for outdoor lighting or radio antennas may be erected to a height of one hundred feet (100') provided:
         a.   If outdoor lighting is erected, only "down" lights with the light housing constructed so that no part of the light source protrudes below the bottom of the light frame or shield;
         b.   All light fixtures exceeding forty five feet (45') in height are located not less than one hundred fifty feet (150') from a perimeter street or highway and/or three hundred feet (300') from any residential use; and
         c.   If radio antennas are erected, any part of the antenna or supporting structure exceeding fifty five feet (55') in height must be located not less than one hundred fifty feet (150') from a perimeter street or highway and/or three hundred feet (300') from any residential use.
   B.   Areas:
      1.   Lot Coverage: The maximum ground area occupied by all buildings shall be not more than eighty percent (80%) of the area of the lot or tract on which a building permit has been issued, provided that the following shall always prevail.
      2.   Yards:
         a.   Front Yard:
            (1)   There shall be a front yard having a depth of not less than ten feet (10') where there shall be no structure of any kind, open storage of materials, equipment, or parking of vehicles, provided, however, that twenty five percent (25%) of the frontage of the building facing the front yard may be used for loading dock purposes.
            (2)   Said front yard shall be maintained with a green strip.
            (3)   Buildings constructed in which more than twenty five percent (25%) of the frontage of the building facing the street is used for loading dock purposes shall be set back so that a ten foot by twenty five foot (10' x 25') green strip shall be maintained.
            (4)   Driveways entering upon a public street shall not exceed ninety feet (90') in width.
         b.   Side Yard:
            (1)   There shall be a minimum side yard of not less than ten feet (10'), but where the property is adjacent to an R or R-2 Zone, there shall be a side yard of not less than twenty five feet (25') on the side nearest to the residential lot.
            (2)   The parking of any vehicle may be permitted within the side yard areas but not closer than twenty five feet (25') to any lot Zoned for residential use.
   C.   Rear Yard:
      1.   A rear yard of sixteen feet (16') is required; except that where a lot abuts upon an R or R-2 Zone, a twenty five foot (25') rear yard is required; provided, however, where the rear lot line abuts a railroad lead right of way and the property is serviced with an enclosed service track, no rear yard is required.
      2.   No materials or equipment shall be stored within twenty five feet (25') of any residential lot or lots.
      3.   The parking of any vehicles may be permitted within the rear yard area but not closer than twenty five feet (25') to any lot Zoned for residential use.
   D.   All Yard Areas and Vacant Lots: Container storage is prohibited within any yard area referred to herein or on any vacant lot. (1985 Code § 9-6A-4; Ord. 91-18, 6-21-1991; amd. Ord. 98-11, 6-8-1998; Ord. 07-05, 4-9-2007; Ord. 08-10, 7-14-2008; Ord. 22-04, 4-11-2022)

10-6A-5: ACCESSIBILITY FOR PERSONS WITH DISABILITIES:

Any industrial facility either constructed or altered after the effective date hereof shall comply with the federal and state laws in effect regarding accessibility for persons with disabilities. (Ord. 92-21, 6-8-1992; amd. 2016 Code; Ord. 22-04, 4-11-2022)

10-6A-6: CANNABIS RELATED FACILITIES:

10-6A-7: PERFORMANCE STANDARDS:

Buildings, premises, and uses permitted in this district are subject to the applicable performance standards in section 10-3-4 of this Title. (Ord. 22-04, 4-11-2022)

10-6B-1: USES PERMITTED:

The following uses shall be permitted in the industrial Heavy Manufacturing HM Zone:
Any use permitted in the Light Manufacturing LM Zone.
Public services facilities, including electric, gas, and telephone distribution substations and similar uses. Provided; however, any public service facility described herein shall have any and all buildings or structures set back not less than fifty feet (50') from a perimeter arterial highway, and said public service facility adjoining a perimeter arterial highway shall be screened with a berm not less than four and one half feet (4-1/2') in height, which berm shall include tree plantings.
Rail yards, including intermodal yards and accessory repair, office, switching, and storage facilities.
Storage shall include warehouses and distribution establishments and accessory repair, office, and maintenance. This entry shall not affect any of the territory which is the subject of a certain annexation agreement or amendments thereto by and between the Village, Brookind Corporation, and the Santa Fe Railway Company dated June 21, 1991.
Any other manufacturing or processing establishment, except as provided in section 10-6B-2 of this article; provided, it shall be so operated so as to comply with the performance standards governing toxic matter and noxious and odorous matter as set forth in the Air Pollution Control Ordinance of the Village, and the Illinois Environmental Protection Act, as amended, whichever is more stringent. 10-6B-2: USES PROHIBITED:

The processing of food or material from animal or vegetable wastes or fats, reduction of garbage, or slaughtering of animals, poultry, or fish is prohibited. (1985 Code § 9-6B-2; amd. Ord. 22-04, 4-11-2022)

10-6B-3: SITE AND STRUCTURE REQUIREMENTS:

The height and area requirements shall be the same as set forth in section 10-6A-4 of this Chapter. (1985 Code § 9-6B-3; amd. Ord. 22-04, 4-11-2022)

10-6B-4: PERFORMANCE STANDARDS:

   A.   Noise and Vibration: The standards for noise and vibration shall be the same as set forth in subsections 10-3-4 B and C of this Title.
   B.   Smoke and Particulate Matter: The standards for smoke and particulate matter shall be the same as set forth in subsection 10-3-4 D of this Title.
   C.   Fire and Explosive Hazards: The standards for fire and explosive hazards shall be the same as set forth in subsection 10-3-4 F of this Title.
   D.   Glare and Heat: The standards for glare and heat shall be the same as set forth in subsection 10-3-4 G of this Title. (1985 Code § 9-6B-4; amd. Ord. 22-04, 4-11-2022)

10-6B-5: ACCESSIBILITY FOR PERSONS WITH DISABILITIES:

Any industrial facility either constructed or altered after the effective date hereof shall be constructed or altered in compliance with the applicable sections of the federal and state laws regarding accessibility for persons with disabilities. 10-6C-1: ZONE DESIGNATED; PURPOSE:

On the Zoning map, the area defined and labeled as CA is hereby determined to be a cement and asphalt plant Zone for the purpose of operating a cement and/or asphalt plant and for the manufacture of products kindred thereto. (Ord. 09-10, 10-12-2009; amd. Ord. 22-04, 4-11-2022)

10-6C-2: USES PERMITTED:

The following uses shall be permitted in the cement and/or asphalt plant CA Zone:
Any use permitted in the Light Manufacturing LM zone and the Commercial C Zone.
Asphalt plant.
Cement plant.
Crushing and recycling operation, including a dumping/transfer site for concrete, stone, aggregates, and asphalt.
On site fueling of trucks, equipment, and vehicles.
Outdoor material and equipment storage.
Outdoor truck parking area. A business license for the operation of the parking and storage is required.
Quality control and quality assurance testing and control laboratories, equipment, and facilities for building and paving materials.
Repair facility for trucks, equipment, and vehicles including, but not limited to, oil change, wash station, painting station, and welding facility. (Ord. 09-10, 10-12-2009; amd. Ord. 22-04, 4-11-2022)

10-6C-3: SITE STANDARDS:

   A.   Berms:
      1.   On all sites in this Zone which are adjacent to non-manufacturing Zones, there shall be erected and maintained buffering earthen berms adjacent to the non-manufacturing Zones with a minimum height of twenty five feet (25') and a width no less than ten feet (10'). Erosion controlling landscaping consisting of sod, prairie grass, or ground cover shall be maintained on said berms.
      2.   All berms erected adjacent to Residential Zones shall have planted on their crown evergreen trees or shrubs, which are spaced at initial planting no further apart than twelve feet (12').
   B.   Sound Emission: All installed equipment, which causes the emission of sound beyond the boundaries of the property shall be, if necessary, screened or filtered with sufficient noise mitigation devices, walls, or other adequate screening so as to comply with the Village noise performance standards at section 10-3-4 of this Title.
   C.   Other Standards: All other Village performance standards as provided in section 10-3-4 of this Title governing noise, smoke, particulate matter, toxic and nontoxic matter, odors, fire and explosion hazards, vibration, radiation or glare, or heat in Manufacturing Zones shall apply to this Zone.
