ARTICLE II

CONDITIONAL USES

Sec. 44-39.- Authorization.

The village board may authorize the zoning administrator to issue a conditional use permit for conditional uses specified in this chapter after review and a public hearing, provided such uses are in accordance with the purpose and intent of this chapter.

Sec. 44-40. - Permit.

Application for a conditional use permit shall be submitted to the zoning administrator on forms provided and shall be accompanied by a plan showing the location, size and shape of the lots involved, any proposed structures and the existing and proposed use of each structure and lot. The cost of a land use permit shall be established by the village board.

Sec. 44-41. - Review.

Both the planning and zoning commission and the village board shall review the site, existing and proposed structures, architectural plans, neighboring uses, parking areas, driveway locations, highway access, traffic generation and circulation, drainage, sewerage and water systems and the proposed operation.

Sec. 44-42. - Conditions.

Conditions related to landscaping, architectural design, type of construction, construction commencement and completion dates, sureties, lighting, fencing, operational control, hours of operation, traffic circulation, deed restrictions, access restrictions, increased yards and parking requirements may be required by the village board upon its finding that such conditions are necessary to fulfill the purposes and intent of this chapter.

Sec. 44-43. - Other provisions.

Conditional uses shall comply with all other provisions of this chapter, such as lot width and area, yards, height, parking, and loading.

Sec. 44-44. - Uses in specific districts.

(a)

In the R1, R2, and R3 districts, conditional uses include home occupations, hospitals and clinics, colleges and vocational schools, public museums, art galleries and microwave relay structures and community television antenna towers.

(b)

In the R2 district:

(1)

One or more manufactured homes are conditional uses, provided that the location of the homes must be approved and a license granted by the village board as a part of a planned manufactured home development.

(2)

A planned manufactured home development must be intended to be exclusively for residential use of manufactured homes and shall include only single-family homes, offices and a dwelling for the owner or administrator of the manufactured home development, and structures for residents of the development, including, without limitation, toilets, bathing, clothes washing facilities and similar services. Such developments are subject to the following regulations:

a.

Height. No mobile home or building shall exceed one story or 15 feet in height.

b.

Yards. Every manufactured home development shall have minimum front, side and rear yard setbacks of 40 feet.

c.

Spacing of units. Manufactured homes shall not be placed closer than 20 feet apart or within ten feet of the roadway serving such units.

d.

Area. Each manufactured home development shall have a minimum area of five acres. Each manufactured home lot shall have a minimum lot area of 3,000 square feet and a minimum lot width of 40 feet.

e.

Additional requirements. In addition to the foregoing, the village board may impose such other conditions, requirements or limitations concerning the design, development, and operation of such manufactured home developments as it may deem necessary for the protection of adjacent properties and public interest.

(c)

In the R1, R2, and R3 districts, medical and dental clinics are conditional uses.

(d)

In the C2 Highway Commercial District, the following highway-oriented uses are conditional uses:

(1)

Automotive sales and service.

(2)

Automotive parts sales.

(3)

Lumberyards.

(4)

Greenhouses.

(5)

Feed and seed stores.

(6)

Farm machinery and equipment sales.

(7)

Building supply stores.

(8)

Plant nurseries.

(9)

Meeting and gathering places (churches, event venues).

(10)

Post-secondary schools.

(e)

In the C1 district, conditional uses include adult establishments, including bookstores, motion picture theaters, mini-motion picture theaters, bath houses, massage parlors, modeling studios, body painting studios, cabarets and novelty shops.
