- ESTABLISHMENT OF DISTRICTS
For the purpose of this ordinance, the Town of Indian Beach, establishes the following zoning districts:
(1)
General Business District (B-1).
(2)
Civic and Municipal District (CM).
(3)
General Residential District (R-15).
(4)
Single-Family Residential District (R-25).
(5)
Residential Resort District (RR).
(6)
Planned Development District (PD).
(7)
Office and Professional District (O&P).
The Town Board of Commissioners may choose not to utilize each of these zoning districts and those districts not utilized at the time of adoption of this Ordinance shall be deemed to be available for future use.
The boundaries of these districts are shown on the "Official Zoning Map" originally adopted October 26, 1974, by the Board of Town Commissioners, but amended from time to time. The official zoning map and all the notations, references, and all amendments thereto, and other information shown thereon are hereby made a part of this Ordinance. The official zoning map is on file in the Office of the Town Clerk and is available for inspection by the public.
3.1.
Where uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the zoning map, the following rules shall apply:
(a)
Where district boundaries are indicated as approximately following the center lines of streets or highways, street lines or railroad right-of-way lines of such lines extended, such center lines, street lines, or railroad right-of-way lines shall be construed to be such boundaries.
(b)
Where district boundaries are so indicated that they approximately follow lot lines, such lot lines shall be construed to be said boundaries.
(c)
Where district boundaries are so indicated that they are approximately parallel to the center lines of streets, highways or railroads, or rights-of-way of same, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the zoning maps. If no distance is given, such dimension shall be determined by the use of the scale shown in said zoning map.
(d)
Where a district boundary line divides a lot in single ownership, the district requirements for the least restricted portion of such lot shall be deemed to apply to the whole thereof provided that such extensions shall not include any part of such a lot more than thirty-five (35) feet beyond the district boundary line.
