ARTICLE III

- APPLICATION OF REGULATIONS

Except as hereinafter provided:


Section 1. - Use.

No building or land shall hereafter be used or occupied and no building or structure or part thereof shall be erected, moved, or structurally altered except in conformity with the regulations of this Ordinance or amendments thereto for the district in which it is located.

Section 2. - Height.

No building shall hereafter be erected or altered so as to exceed the height limit of this Ordinance for the district in which it is located.

Section 3. - Lot size.

No lot, even though it may consist of one or more adjacent lots of record, shall be reduced in size so that the lot width or depth, front, side rear yards, lot area per family or other requirements of this Ordinance are not maintained.

Section 4. - Yard use limitations.

No part of a yard or other open space required about any building for the purpose of complying with the provisions of this Ordinance shall be included as a part of a yard or other open space similarly required for another building.

Section 5. - Only one principal building on any lot.

Only one principal building and its customary accessory buildings may hereafter be erected on any lot, except for mobile home parks, uses permitted within the PD Zone, and except as authorized in Article VI, nor shall any building be erected on any lot which does not abut at least 25 feet on a publicly dedicated or maintained street or such other or greater street frontage as may be required in any other provision of this zoning ordinance.

Section 6. - Properties divided by N.C. Highway 58 (Salter Path Road).

Except as specifically permitted by any provision of this Ordinance, any parcel of property separated by North Carolina Highway 58 (Salter Path Road) shall be treated as two (2) separate and distinct pieces of property, not withstanding common ownership, and dimensional limitations, use limitations, reservations of natural areas, and all other regulations in this Ordinance shall apply to each parcel of property separately rather than to the tract as a whole.

Section 7. - Continuation of requirements.

Properties used to meet design, dimensional, use, natural area reservation, and other requirements of this Ordinance in connection with an application for building permit shall continue to be used as stated for the basis of issuance of the building permit. Any violation of this provision shall be deemed a violation of this Ordinance and, the Town of Indian Beach may, along with any other remedies available in law or equity, revoke the occupancy permit issued for any building on the premises upon a violation.
