The ordinance codified in this title shall be known as the ZONING ORDINANCE OF THE CITY OF JEROME, IDAHO. (Ord. 1070, 2010)
17.02.020: AUTHORITY:
This title is adopted pursuant to authority granted by title 67, chapter 65 of the Idaho Code and article 12, section 2 of the Idaho constitution, as amended or subsequently codified. (Ord. 1070, 2010)
17.02.030: INTERPRETATION, SCOPE OF REGULATIONS:
A. In their interpretations and application, the provisions of this title shall be held to be minimum requirements, adopted for the promotion of public health, safety and the general welfare.
B. The regulations for each district shall apply uniformly to each class or kind of structure or land, except as hereinafter provided.
C. Whenever the requirements of this title conflict with the requirements of any other lawfully adopted rules, regulations, ordinances or resolutions, the most restrictive or that imposing the higher standards shall govern.
D. No building, structure or land shall be used or occupied and no building or structure or part thereof shall be erected, constructed, reconstructed, moved or structurally altered except in conformity with all of the regulations herein specified for the district in which it is located.
E. No yard or lot existing at the effective date hereof shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date hereof shall meet at least the minimum requirements set forth herein. (Ord. 1070, 2010)
17.02.040: SCHEDULE OF FEES, CHARGES AND EXPENSES:
The council shall establish a schedule of fees, charges and expenses and a collection procedure for zoning permits, amendments, appeals, variances, special use permits, plan approvals and other matters pertaining to the administration and enforcement of this title requiring investigations, inspections, legal advertising, postage and other similar matters. The schedule of fees shall be posted in the office of the building official and may be altered or amended only by the council. Until all applicable fees, charges and expenses have been paid in full, no action shall be taken on any application or appeal. (Ord. 1070, 2010)
