In accordance with Article 7, Chapter 12 of the Kansas Statutes Annotated, a Planning Commission for Junction City, Kansas, is created.

A.
The Junction City Planning Commission ("Planning Commission") shall consist of five (5) persons. Of the persons first (1st) appointed by the City Commission, all shall be appointed for up to three (3) year terms. Vacancies shall be filled by appointment for the unexpired term. Persons appointed to the Planning Commission shall serve without compensation for their service but may receive reimbursement for expenses.
B.
All terms shall commence on January first (1st) and expire on December thirty-first (31st). All terms of office other than the terms of the initial appointees shall be for three (3) years. In case of the death, incapacity, resignation, or disqualification of any member, the City Commission shall appoint another member for the unexpired term of such deceased, incapacitated, resigned, or disqualified member.
C.
The Secretary or Chairman of the Planning Commission shall report attendance of members for each regularly scheduled and special meeting and any member failing to attend three (3) consecutive regular meetings without an excused absence shall be considered as disqualified hereunder.
D.
Any person shall be eligible for appointment who resides within the municipal boundaries of the incorporated City of Junction City, Kansas, and is a duly-qualified elector.
E.
A majority of the members of the Planning Commission shall hold no other public office except they be a member of the Junction City Board of Zoning Appeals or a local School District Board.
F.
All members, including the Chairman, shall have the right to take part in all discussions and to vote, except that any member who has a conflict of interest regarding any proposal or matter under consideration by the Planning Commission, shall disqualify themself from the discussion and from voting.
G.
Members of the Planning Commission shall serve without compensation but may be reimbursed for expenses actually incurred in the performance of their duties.
H.
The initial appointees to the Planning Commission shall have modified terms. One shall be appointed for an approximate one (1) year term terminating December 31, 2024. Two shall be appointed for an approximate two (2) year term terminating December 31, 2025. Two shall be appointed for an approximate three (3) year term terminating December 31, 2026. After the initial terms expire then their terms shall follow subsections (A) and (B) of 450.020.

The appointment to the Planning Commission shall be concurrent with an appointment to the Junction City Board of Zoning Appeals.

A.
The Junction City Planning Commission shall first meet no later than end of November, 2023; shall at this first meeting select a Chairperson and Vice Chairperson to serve a one (1) year term in light of 450.020(B); and shall set a date and time for its regular monthly meeting. The Junction City Planning Commission shall prepare bylaws to govern the conduct of the Planning Commission's business as required by State Statutes.
All plans, rules, regulations, and actions of the existing Metropolitan Planning Commission shall remain valid and in effect and shall be considered the actions of the Metropolitan Planning Commission established herein from such time as the new Junction City Planning Commission has organized.
B.
Said Planning Commission shall elect one (1) member as Chairperson and one (1) member as Vice-Chairperson. The terms of the Chairperson and Vice-Chairperson shall be for one (1) year and/or until their successor shall have been elected and qualified.
C.
Special meetings of the Planning Commission may be called by the Chairperson or, in their absence, by the Vice- Chairperson, or by either Governing Body on not less than two (2) days written notice, such notice to be given by mail, email, or other such communication at the address or destination given to the Secretary of the Junction City Planning Commission by such member.
D.
A quorum of the said Planning Commission shall consist of three (3) members.
E.
The Planning Commission shall designate a Secretary and may also designate an Assistant Secretary, neither of whom need be members of the Planning Commission. The Secretary or Assistant Secretary may be a City Staff member. The Secretary shall cause a proper record to be kept of all the proceedings of the Planning Commission.

The Junction City Planning Commission shall have and exercise and hereby is vested with all powers and duties provided by law for city planning jurisdictions, City Planning Commissions, and City Zoning Boards, and in addition shall have such powers and duties as are set out by resolution and ordinance. The Planning Commission as of the effective date of this ordinance shall assume, be vested with, exercise and perform all of the powers, duties, and functions heretofore vested in and exercised by the Metropolitan Planning Commission and Board of Zoning Appeals as it pertains to the incorporated municipality of the City of Junction City, Kansas, and not the incorporated portions of Geary County or other incorporated cities within Geary County. The general purpose of the Planning Commission shall be to make those studies and plans for the development of the City of Junction City that will guide the development of the municipality and promote economy and efficiency in the coordinated development of the area and the general welfare and prosperity of its people. Such plans may include but shall not be limited to recommendations for principal highways, bridges, airports, parks and recreational areas, schools and public institutions, and public utilities. Such plans shall be based on studies of physical, social, economic, and governmental conditions and trends.

All planning and zoning actions of every kind or character taken by the Metropolitan Planning Commission shall be continued in full force and effect and in no way be affected by this ordinance except that the administration and supervision of planning and zoning activities, and all powers and duties of the Metropolitan Planning Commission pertaining to the incorporated city limits of the City of Junction City, Kansas shall be transferred to the effective date of this ordinance to the Junction City Planning Commission. All matters pending before the Metropolitan Planning Commission within the municipal boundaries upon the effective date of this ordinance shall be transferred to the Junction City Planning Commission. All records, files, minutes, maps, plats, and other property of the Metropolitan Planning Commission shall be transferred to the Junction City Planning Commission on the effective date of this ordinance.

Any person, firm, or corporation requesting an action from the Junction City Planning Commission shall pay a fee as set forth in the Zoning Regulations of the City of Junction City, Kansas, at the time of filing the request. Such fee shall not be refundable. The City Commission and the Junction City Planning Commission shall be exempt from paying these fees.

There is hereby created the Junction City Board of Zoning Appeals, hereinafter referred to as the "Board", all as authorized by K.S.A. Article 7, Chapter 12, inclusive and amendments thereto.

G.
The appointment to the Board of Zoning Appeals shall be concurrent with an appointment to the Junction City Planning Commission.

The Board shall convene for its first (1st) meeting at such time and place as shall be fixed by the City Manager or their designee of the City of Junction City, Kansas, and shall proceed to organize and elect officers, adopt by-laws, and fix and determine times and places of future meetings, which said meetings shall not be less frequent than once every two (2) months.
B.
Said Board shall elect one (1) member as Chairperson and one (1) member as Vice-Chairperson. The term of the Chairperson and Vice-Chairperson shall be for one (1) year and/or until their successor shall have been elected and qualified.
C.
Special meetings of the Board may be called by the Chairperson, or, in their absence, by the Vice-Chairperson, or by the City Commission on not less than two (2) days written notice, such notice to be given by mail, electronic-mail, or other of communication at the address or destination given to the Secretary of the Board by such member.
D.
A quorum of the Board shall consist of three (3) members.
E.
The Board shall designate a Secretary who need not be a member of the Board. The Secretary shall cause a proper record to be kept of all the proceedings of the Board. Said Secretary may be an officer or employee of the City of Junction City.

It shall be the duty and function of the Board to perform such duties and functions as is prescribed for a Board of Zoning Appeals under law governing, and all of such duties, powers, and functions are transferred to the Board as of the effective date of this ordinance.
