The "RS" Suburban Residential District is designed to provide a single-family dwelling zone at a density of not less than ten thousand (10,000) square feet per dwelling unit.

Two-family and multi-family dwelling developments having more than one (1) principal residential structure on a single zoning lot having an area of less than five (5) acres; provided that any existing structure which is to remain on such lot shall comply with all current applicable zoning requirements.
9.
Multiple-family dwelling units having separate ownership and separate utilities from attachment to utility company's facilities, provided that all bulk regulations are met except for side yard setback requirements between the units and that such developments have covenants or restrictions which run with the land upon which the units are located. These covenants or restrictions shall specify methods for dealing with common expenses among owners within a residential structure and other maintenance agreements consistent with shared property or easements.

D.
Lot Size Requirements.
1.
Minimum lot area.
a.
Single-family dwellings: Five thousand (5,000) square feet.
b.
Single-family attached or two-family dwellings: Three thousand (3,000) square feet per family, but not less than five thousand (5,000) square feet.

(Note: Side yard requirements increase for buildings greater than forty (40) feet in height.)

a.
Minimum front yard: Twenty-five (25) feet on all sides abutting a street, or an established building setback line.
b.
Minimum side yard:
(1)
Residential buildings: Ten percent (10%) of the lot width shall be provided on each side of the zoning lot but not less than eight (8) feet on each side of the zoning lot, except that residential buildings which have the entrances to two (2) or more units facing the side yard shall have a minimum side yard of ten (10) feet on the side of the building on which such entrances are located. For structures with more than two (2) living units, parking spaces will be set back a minimum of six (6) feet from the side yard boundary and four (4) feet from any side of a building.
(2)
All other permitted and conditional uses shall have a side yard on each side of fifteen (15) feet, except accessory uses which shall be permitted and governed by Chapter 410 of this Title.
(3)
There shall be an additional side yard setback of one (1) foot for each two (2) feet of height over forty (40) feet.
c.
Minimum rear yard: Twenty-five (25) feet.

Maximum lot coverage: Forty percent (40%).
F.
Family Day Care Exceptions. Day care homes, group day care homes, or family child care homes shall only be permitted in single-family and two-family dwellings. At no time shall a day care home be permitted in any multiple-family dwelling.

Use Limitations. Each mobile home park shall be subject to the provisions of Chapter 555 of this Code which regulates, among other things, the layout of mobile home parks, required improvements, and spacing between mobile homes.

A.
This district is designed to provide for a restricted commercial alternative to multiple-family development adjacent to arterial streets and highways and, at the same time, avoid the typical strip commercial development. To achieve this end, a very limited number of non-retail businesses are permitted.
B.
Permitted Uses.

Books, stationery and periodicals (no adult bookstores).
2.
Business and professional offices, provided that storage space accessory to such offices shall not exceed fifty percent (50%) of the gross floor area of the principal structure.

1.
Maximum structure height: Thirty (30) feet.
2.
Yard requirements:
a.
Minimum front yard: The front yard shall be fifty-five (55) feet from the centerline of the street right-of-way, with a minimum setback of fifteen (15) feet. Where a lot fronts on a public street on more than one (1) side, the above front yard setback requirements shall apply to each yard with a street frontage.
b.
Minimum side yard: None required, except there shall be a fifteen (15) foot setback when adjacent to a residential district. However, if a setback is utilized it shall be not less than eight (8) feet.
c.
Minimum rear yard: Twenty-five (25) feet.
F.
Use Limitations.
1.
All business, service, storage and display of goods shall be conducted within a completely enclosed structure.
2.
Exterior lighting fixtures shall be shaded so that no direct light is cast upon any property located in a residential district and so that no glare is visible in any traffic on any public street.
3.
Sight obscuring screening of not less than six (6) feet in height shall be provided along all lot lines that abut a residential district.
4.
For each zoning lot, there shall be only one (1) curb cut permitted for each one hundred fifty (150) feet in width. Such curb cut shall not be greater than twenty-eight (28) feet in width.
5.
Loading areas associated with the uses permitted in this district shall not be permitted in any required front yard.

Dry cleaning and laundry receiving stations where no processing or cleaning of clothing is done on the premises.

14.
Medical and dental clinics.
15.
Restaurants, not drive-in type.

1.
Automobile service stations and tire, battery and automobile accessory stores, provided that the design of the entrance and exit drives to such uses will not create hazards for vehicular or pedestrian traffic or congestion in adjacent streets and that no body work or structural repairs shall be permitted.

D.
Lot Size Requirements.
1.
Minimum lot area: Twenty-five thousand (25,000) square feet.

Minimum lot width: One hundred (100) feet.

E.
Bulk Regulations.
1.
Maximum structure height: Forty (40) feet.

a.
Minimum front yard: The front yard shall be fifty-five (55) feet from the centerline of the street right-of-way, with a minimum setback of fifteen (15) feet. Side yard: None required, except when a side yard in this district abuts a residential district a side yard of eight (8) feet shall be provided.

Rear yard: None required, except when a rear yard in this district abuts a residential district a rear yard of eight (8) feet shall be provided.

F.
Use Limitations.
1.
All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced.
2.
All business, service, storage and display of goods shall be conducted within a completely enclosed building, except that an area equivalent to not more than five percent (5%) of the total floor area may be used for display of merchandise outside of the building. No more than two (2) motor vehicles awaiting repair or restoration shall be stored outside.
3.
Exterior lighting fixtures shall be shaded so that no direct light is cast upon any property located in a residential district.
4.
A sight-obscuring screening of not less than six (6) feet in height shall be provided along all property lines that abut a residential district.
5.
No separate business establishment shall occupy more than twenty-five thousand (25,000) square feet of floor space.

Use Limitations.
1.
All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced. No products produced in this district shall be of a nature that they would be classified as a permitted use in the "IR", "IL" or "IH" Districts if produced separately from a use permitted in this district.
2.
All business, service, storage and display of goods shall be conducted within a completely enclosed building, except as provided by this regulations.
3.
No business establishment shall offer or sell food or beverages for consumption on the premises in parked motor vehicles.
4.
Exterior lighting fixtures shall be shaded so that no direct light is cast upon any property located in a residential district and so that no glare is visible in any traffic on any public street.
5.
Drinking establishments may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.
If the front entrance of a drinking establishment is on the same street as the front entrance of a church or school, there must be a minimum separation of two hundred (200) feet between the drinking establishment and the church or school. The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a drinking establishment does not face the same street as the front entrance of the church or school or if the drinking establishment and the church or school is separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 5(a) does not apply.
c.
The structure housing a drinking establishment may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

The "CS" Service Commercial District is designed for those business and commercial uses which draw their customers from motorists on the highway, or for whom a location on a highway or arterial street is especially useful or necessary. Although some of the typical retail uses are permitted in other commercial districts, most of these permitted in this district would not blend well into a prime retail area.

4.
Farm implement sales and service.
5.
Flea markets (see Chapter 420 for parking restrictions).

D.
Lot Size Requirements.
1.
Minimum lot area: Ten thousand (10,000) square feet.

Minimum lot width: Seventy-five (75) feet.
3.
Minimum lot depth: One hundred (100) feet.
E.
Bulk Regulations.
1.
Maximum structure height: Forty (40) feet.
2.
Yard requirements:
a.
Minimum front yard: The front yard shall be fifty-five (55) feet from the centerline of the street right-of-way, with a minimum setback of fifteen (15) feet. Where a lot fronts on a public street on more than one (1) side, the above front yard requirements shall apply to each yard with a street frontage.
b.
Side yard: Although not required, if a side yard is provided, it shall be at least five (5) feet in width.
c.
Each motel and hotel shall have a minimum side yard on each side of the zoning lot of not less than ten (10) feet and a minimum rear yard of not less than twenty (20) feet.
d.
Any use located adjacent to a residential district shall provide a setback of not less than eight (8) feet.
3.
Maximum lot coverage: Fifty percent (50%).
F.
Use Limitations.
1.
No structure shall be used for residential purposes, except for the use of the owner or operator of the business located on the premises and except that accommodation may be offered to the transient public by motels and hotels.
2.
All outdoor storage, except that specified in Section 405.090, Subsection F(7) and vehicles in operating condition, and loading spaces shall be enclosed by screening. Off-street parking and loading spaces and the storage of automobiles and other motor vehicles in operating condition shall be so enclosed when such use abuts on a residential district at a side or a rear lot line or is separated from the district only by an alley.
3.
All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold on the premises where produced.
4.
Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light on any property located in a residential district.
5.
Drive-in establishments offering food or services directly to customers waiting in parked motor vehicles shall enclose the space allocated for customers and motor vehicles in the same manner as is required in this Subsection F(2) above.
6.
Gasoline pumps, air and water service and other fixtures used in connection with automobile service stations or the sale of automotive fuel shall be located not less than twelve (12) feet from the property line of any street or road on which the service station abuts.
7.
Motor vehicles, mobile homes, trailers, equipment and boats displayed for sale in the open shall be located not less than twelve (12) feet from the front property line of any street or road on which such uses abut.
8.
Screening shall be provided along all lot lines that abut a residential district.
9.
Taverns, private clubs, or drinking establishments may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.
If the front entrance of a tavern, private club or drinking establishment is on the same street as the front entrance of a church or school, there must be a minimum separation of two hundred (200) feet between the tavern, private club or drinking establishment and the church or school. The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a tavern, private club or drinking establishment does not face the same street as the front entrance of the church or school or if the tavern, private club or drinking establishment and the church or school are separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 5(a) does not apply.
c.
The structure housing a tavern, private club or drinking establishment may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

Front yard: Property located adjacent to the following various types of streets shall maintain the following yards regardless of whether it is a front, side or rear yard or any combination thereof:
1)
Arterial street: Twenty-five (25) feet from the property line or seventy-five (75) feet from the street centerline, whichever is greater.
2)
Collector street: Twenty-five (25) feet from the property line or sixty-five (65) feet from the street centerline, whichever is greater.
3)
Residential streets: Twenty-five (25) feet from the property line or fifty-five (55) feet from the street centerline, whichever is greater.
b.
No setback shall be required other than under the conditions specified in Section 405.100 Subsection E (2. a. 1, 2 and 3), except that when located adjacent to property located in a residential district, there shall be a setback of eight (8) feet.
c.
Each motel and hotel shall have a minimum side yard on each side of the zoning lot of not less than ten (10) feet and a minimum rear yard of not less than twenty (20) feet.
3.
Maximum lot coverage: Fifty percent (50%).
F.
Use Limitations.
1.
No structure shall be used for residential purposes except for a security guard or night watchman or the owner and operator of the business located on the premises.
2.
All outdoor storage shall be enclosed by screening except the storage of automobiles, including off-street parking space, and other motor vehicles in operating condition.
3.
All outdoor storage including off-street parking space shall be enclosed by screening from adjacent property that is located in a residential district.
4.
All business establishments shall be retail or service establishments dealing directly with the consumer. All goods produced on the premises shall be sold on the premises.
5.
All lighting shall be so located to avoid casting direct light upon any property located in a residential district.
6.
Screening shall be provided along all property lines that abut a residential district.
7.
Gasoline pumps, air pumps, and water service and other fixtures used in connection with automobile service stations shall be located not less than twelve (12) feet from the property line of any street or road on which the service station abuts.
8.
Motor vehicles, mobile homes, trailers, equipment and boats stored or displayed in the open shall be located not less than twelve (12) feet from the front property line of any street or road on which such uses abut.
9.
Screening of not less than six (6) feet in height shall be provided along all lot lines that abut a residential district.
10.
Taverns, private clubs, or drinking establishments may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.

The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a restaurant-club does not face the same street as the front entrance of the church or school or if the restaurant-club and the church or school are separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 6(a) does not apply.
c.
The structure housing a restaurant-club may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

No products produced in this district shall be of a nature that they would be classified as a permitted use in the "IR", "IL" or "IH" Districts if produced separately from a use permitted in this district.
2.
All business, service, storage and display of goods shall be conducted within a completely enclosed building, except as provided by these regulations.
3.
No business establishment shall offer or sell food or beverages for consumption on the premises in parked motor vehicles.
4.
Exterior lighting fixtures shall be shaded so that no direct light is cast upon any property located in a residential district and so that no glare is visible in any traffic on any public street.
5.
Drinking establishments or private clubs may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.
If the front entrance of a drinking establishment or private club is on the same street as the front entrance of a church or school, there must be a minimum separation of two hundred (200) feet between the drinking establishment or private club and the church or school. The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a drinking establishment or private club does not face the same street as the front entrance of the church or school or if the drinking establishment or private club and the church or school are separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 5(a) does not apply.
c.
The structure housing a drinking establishment or private club may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

a.
Minimum front yard: The front yard shall be fifty-five (55) feet from the centerline of the street right-of-way, with a minimum setback of fifteen (15) feet. Where a lot fronts on a public street on more than one (1) side, the above front yard requirements shall apply to each yard with a street frontage.
b.
Although not required, if a side yard is provided, it shall be at least five (5) feet in width.
c.
Each motel and hotel shall have a minimum side yard on each side of the zoning lot of not less than ten (10) feet and a minimum rear yard of not less than twenty (20) feet.
d.
Any use located adjacent to a residential district shall provide a setback of not less than eight (8) feet.
3.
Maximum lot coverage: Fifty percent (50%).

5.
If a lot in an "IR" District adjoins a residential district, screening shall be provided at the lot lines sufficient to protect on a year around basis, the privacy of adjoining residential uses.
6.
No building shall be used for residential purposes except that a watchman may reside on the premises.
7.
Exterior lighting shall be shaded so that no direct light is cast upon any property located in a residential district or upon any street where glare is visible to traffic.

There shall be no smoke, noise, dust, odor or vibration detectable beyond the property line.

Servicing and maintenance of vehicle shall be permitted only when such is necessary to the conduct of a permitted use.

All premises in an "IP" District shall be furnished with all-weather hard surface walks and, except for parking areas, the grounds shall be planted and landscaped according to a landscape plan which shall be approved by the Planning Commission and filed in the Office of the Zoning Administrator.
5.
If a lot in an "IP" District adjoins a residential district, screening shall be provided at the lot lines sufficient to protect on a year-round basis, the privacy of adjoining residential uses.
6.
No building shall be used for residential purposes except that a watchman may reside on the premises.

Where any side and/or rear yard abuts a residential district, a landscaped side and/or rear yard shall be provided along such side and/or rear yard that is eight (8) feet in width.

F.
Use Limitations.
1.
All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced. No products produced in this district shall be of a nature that they would be classified as a permitted use in the "IR", "IL" or "IH" Districts if produced separately from a use permitted in this district.
2.
All business, service, storage and display of goods shall be conducted within a completely enclosed building, except as provided by this regulations.
3.
No business establishment shall offer or sell food or beverages for consumption on the premises in parked motor vehicles.
4.
Exterior lighting fixtures shall be shaded so that no direct light is cast upon any property located in a residential district and so that no glare is visible in any traffic on any public street.
5.
Drinking establishments may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.
If the front entrance of a drinking establishment is on the same street as the front entrance of a church or school, there must be a minimum separation of two hundred (200) feet between the drinking establishment and the church or school. The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a drinking establishment does not face the same street as the front entrance of the church or school or if the drinking establishment and the church or school is separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 5(a) does not apply.
c.
The structure housing a drinking establishment may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

Conditional Uses.
1.
Animal hospitals, provided that all pens shall be in an enclosed structure when located within three (300) feet of a residential district.

Boats, travel trailers and campers - sales, service and rentals.
3.
Department store with a floor area less than twenty-five thousand (25,000) square feet.
4.
Farm implement sales and service.
5.
Flea markets (see Chapter 420 for parking restrictions).
6.
Liquor stores (package).
7.
Lumber yard.
8.
Outdoor theaters (not including adult theaters).
9.
Restricted production and repair limited to the following; alteration and custom tailoring of clothing for retail sale only; jewelry and other precious metal, watches, dentures, optical lenses, and other similar activities.

Tattoo studio.

Telephone exchanges and telephone transmission equipment structures.
12.
Truck sales, service and repair of trucks having manufacturer's rating of over one (1) ton.
D.
Lot Size Requirements.
1.
Minimum lot area: Ten thousand (10,000) square feet.
2.
Minimum lot width: Seventy-five (75) feet.
3.
Minimum lot depth: One hundred (100) feet.
E.
Bulk Regulations.
1.
Maximum structure height: Forty (40) feet.
2.
Yard requirements:
a.
Minimum front yard: The front yard shall be fifty-five (55) feet from the centerline of the street right-of-way, with a minimum setback of fifteen (15) feet. Where a lot fronts on a public street on more than one (1) side, the above front yard requirements shall apply to each yard with a street frontage.
b.
Side yard: Although not required, if a side yard is provided, it shall be at least five (5) feet in width.
c.
Each motel and hotel shall have a minimum side yard on each side of the zoning lot of not less than ten (10) feet and a minimum rear yard of not less than twenty (20) feet.
d.
Any use located adjacent to a residential district shall provide a setback of not less than eight (8) feet.
3.
Maximum lot coverage: Fifty percent (50%).
F.
Use Limitations.
1.
No structure shall be used for residential purposes, except for the use of the owner or operator of the business located on the premises and except that accommodation may be offered to the transient public by motels and hotels.
2.
All outdoor storage, except that specified in Section 405.090, Subsection F(7) and vehicles in operating condition, and loading spaces shall be enclosed by screening. Off-street parking and loading spaces and the storage of automobiles and other motor vehicles in operating condition shall be so enclosed when such use abuts on a residential district at a side or a rear lot line or is separated from the district only by an alley.
3.
All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold on the premises where produced.
4.
Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light on any property located in a residential district.
5.
Drive-in establishments offering food or services directly to customers waiting in parked motor vehicles shall enclose the space allocated for customers and motor vehicles in the same manner as is required in this Subsection F(2) above.
6.
Gasoline pumps, air and water service and other fixtures used in connection with automobile service stations or the sale of automotive fuel shall be located not less than twelve (12) feet from the property line of any street or road on which the service station abuts.
7.
Motor vehicles, mobile homes, trailers, equipment and boats displayed for sale in the open shall be located not less than twelve (12) feet from the front property line of any street or road on which such uses abut.
8.
Screening shall be provided along all lot lines that abut a residential district.
9.
Taverns, private clubs, or drinking establishments may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.
If the front entrance of a tavern, private club or drinking establishment is on the same street as the front entrance of a church or school, there must be a minimum separation of two hundred (200) feet between the tavern, private club or drinking establishment and the church or school. The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a tavern, private club or drinking establishment does not face the same street as the front entrance of the church or school or if the tavern, private club or drinking establishment and the church or school are separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 5(a) does not apply.

Arterial street: Twenty-five (25) feet from the property line or seventy-five (75) feet from the street centerline, whichever is greater.
2)
Collector street: Twenty-five (25) feet from the property line or sixty-five (65) feet from the street centerline, whichever is greater.
3)
Residential streets: Twenty-five (25) feet from the property line or fifty-five (55) feet from the street centerline, whichever is greater.
b.
No setback shall be required other than under the conditions specified in Section 405.100 Subsection E (2. a. 1, 2 and 3), except that when located adjacent to property located in a residential district, there shall be a setback of eight (8) feet.
c.
Each motel and hotel shall have a minimum side yard on each side of the zoning lot of not less than ten (10) feet and a minimum rear yard of not less than twenty (20) feet.
3.
Maximum lot coverage: Fifty percent (50%).
F.
Use Limitations.
1.
No structure shall be used for residential purposes except for a security guard or night watchman or the owner and operator of the business located on the premises.
2.
All outdoor storage shall be enclosed by screening except the storage of automobiles, including off-street parking space, and other motor vehicles in operating condition.
3.
All outdoor storage including off-street parking space shall be enclosed by screening from adjacent property that is located in a residential district.
4.
All business establishments shall be retail or service establishments dealing directly with the consumer. All goods produced on the premises shall be sold on the premises.
5.
All lighting shall be so located to avoid casting direct light upon any property located in a residential district.
6.
Screening shall be provided along all property lines that abut a residential district.
7.
Gasoline pumps, air pumps, and water service and other fixtures used in connection with automobile service stations shall be located not less than twelve (12) feet from the property line of any street or road on which the service station abuts.
8.
Motor vehicles, mobile homes, trailers, equipment and boats stored or displayed in the open shall be located not less than twelve (12) feet from the front property line of any street or road on which such uses abut.
9.

Taverns, private clubs, or drinking establishments may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:

The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a restaurant-club does not face the same street as the front entrance of the church or school or if the restaurant-club and the church or school are separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 6(a) does not apply.
c.
The structure housing a restaurant-club may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

Gasoline pumps, air and water service and other fixtures used in connection with automobile service stations shall be located not less than twelve (12) feet from the property line of any street or road on which the service station abuts.

Boats stored or displayed in the open shall be located not less than twelve (12) feet from the front property line of any street or road on which such uses abut.

F.
Use Limitations.
1.
All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced. No products produced in this district shall be of a nature that they would be classified as a permitted use in the "IR", "IL" or "IH" Districts if produced separately from a use permitted in this district.
2.
All business, service, storage and display of goods shall be conducted within a completely enclosed building, except as provided by these regulations.
3.
No business establishment shall offer or sell food or beverages for consumption on the premises in parked motor vehicles.
4.
Exterior lighting fixtures shall be shaded so that no direct light is cast upon any property located in a residential district and so that no glare is visible in any traffic on any public street.
5.
Drinking establishments or private clubs may be constructed or located in the vicinity of a church, school or dwelling or mobile home only in accordance with the following regulations:
a.
If the front entrance of a drinking establishment or private club is on the same street as the front entrance of a church or school, there must be a minimum separation of two hundred (200) feet between the drinking establishment or private club and the church or school. The two hundred (200) feet separation is to be measured structure to structure.
b.
If the front entrance of a drinking establishment or private club does not face the same street as the front entrance of the church or school or if the drinking establishment or private club and the church or school are separated by a street or alley right-of-way, other than the street both structures face, separation requirement of Subsection 5(a) does not apply.
c.
The structure housing a drinking establishment or private club may be no closer than fifty (50) feet to a dwelling located in a residential district measured structure to structure.
d.
"Front entrance" as used in this Subsection shall mean the street address assigned to the premises.

Minimum lot area: Ten thousand (10,000) square feet.

Minimum lot width: Seventy-five (75) feet.
3.
Minimum lot depth: One hundred (100) feet.
E.
Bulk Regulations.
1.
Maximum structure height: Forty (40) feet.
2.
Yard requirements:
a.
Minimum front yard: The front yard shall be fifty-five (55) feet from the centerline of the street right-of-way, with a minimum setback of fifteen (15) feet. Where a lot fronts on a public street on more than one (1) side, the above front yard requirements shall apply to each yard with a street frontage.
b.
Although not required, if a side yard is provided, it shall be at least five (5) feet in width.
c.
Each motel and hotel shall have a minimum side yard on each side of the zoning lot of not less than ten (10) feet and a minimum rear yard of not less than twenty (20) feet.
d.
Any use located adjacent to a residential district shall provide a setback of not less than eight (8) feet.
3.
Maximum lot coverage: Fifty percent (50%).
F.
Use Limitations.
1.

All premises in an "IR" District shall be furnished with all weather hard surface walks and, except for parking areas, the grounds shall be planted and landscaped according to a landscape plan which shall be approved by the Planning Commission and filed in the Zoning Administrator's Office.
5.
If a lot in an "IR" District adjoins a residential district, screening shall be provided at the lot lines sufficient to protect on a year around basis, the privacy of adjoining residential uses.
6.
No building shall be used for residential purposes except that a watchman may reside on the premises.
7.
Exterior lighting shall be shaded so that no direct light is cast upon any property located in a residential district or upon any street where glare is visible to traffic.

1.
Yard requirements:
a.
Minimum front yard: Twenty-five (25) feet on all sides abutting a street, except when located adjacent to an arterial street there shall be a setback of seventy-five (75) feet from the street centerline, the greater distance to prevail.
b.
Side yard: No minimum requirements, but if a side yard abuts a residential district, a side yard of ten (10) feet shall be provided.
c.
Minimum rear yard: No minimum requirements, but if a rear yard abuts a residential district, a rear yard of ten (10) feet shall be provided.
2.
Maximum lot coverage: Seventy-five percent (75%).

Use Limitations.
1.
No retail sales or services shall be permitted, except as are incidental or accessory to a permitted use.
2.
If a lot in an "IH" District adjoins a residential district, screening shall be provided at the lot line as sufficient to protect, on a year-round basis, the privacy of the adjoining residential uses.
3.
No building shall be used for residential purposes except that a watchman or custodian may reside on the premises.

A.
The "IP" Industrial Park District is designed-to permit a broad-range of industrial activities within certain limitations. The uses permitted in this district are required to be in an enclosed structure and all premises are to be landscaped according to an approved landscape plan. All walks, drives and parking areas shall be all-weather surfaced.
B.
Permitted Uses.
1.
Agriculture, as defined in Section 400.030 of this Title.
2.
Animal shelters.
3.
Any permitted use in districts "IR", "IL", and "IH".
C.
Conditional Uses. None.
D.
Lot Size Requirements.
1.
Minimum lot area: One (1) acre.
2.
Minimum lot width: One hundred (100) feet.
3.
Minimum lot depth: One hundred fifty (150) feet.
E.
Bulk Regulations.
1.
Maximum structure height: Fifty (50) feet.
2.
Yard requirements:
a.
Front yard: Fifty (50) feet on all sides abutting a street, except when located adjacent to an arterial street there shall be a setback of fifty (50) feet from the front property line or one hundred (100) feet from the street centerline, the greater distance to prevail.
b.
Side yard: Twenty (20) feet.
c.
Rear yard: Twenty (20) feet, except no rear yard shall be required when the rear lot line abuts a railway easement or right-of-way.
3.
Maximum lot coverage: Fifty percent (50%).
F.
Use Limitations.
1.
All operations, activities and storage shall be conducted wholly inside of a building, or buildings, unless the nearest point of such operation or activity is more than two hundred (200) feet from the boundary of any other zoning district other than an "IL" or "IH" District and except that storage may be maintained outside the building in side yards or rear yards if such storage area is separated from public streets and other property (except property located in an "IL" or "IH" District) by screening of not less than six (6) feet in height.
2.
No retail sales or services shall be permitted except incidental or accessory to a permitted use.
3.
Servicing and maintenance of vehicle shall be permitted only when such is necessary to the conduct of a permitted use.
4.
All premises in an "IP" District shall be furnished with all-weather hard surface walks and, except for parking areas, the grounds shall be planted and landscaped according to a landscape plan which shall be approved by the Planning Commission and filed in the Office of the Zoning Administrator.
5.
If a lot in an "IP" District adjoins a residential district, screening shall be provided at the lot lines sufficient to protect on a year-round basis, the privacy of adjoining residential uses.
6.
No building shall be used for residential purposes except that a watchman may reside on the premises.
7.
Exterior lighting shall be shaded so that no direct light is cast upon any property located in a residential district or upon any street where glare is visible to traffic.
8.
There shall be no smoke, noise, dust, odor or vibration detectable beyond the property line.

The "AP" Airport District is designed to provide for Airports and other uses which are allied or associated with airports.
B.
Permitted Uses.

Aerial survey and other similar companies.

Aircraft and aircraft parts manufacturers.
5.
Aircraft repair shops.
6.
Airline schools.
7.
Airport hotels and motels.

Airports, provided that they are first approved by the Federal Aviation Agency.

Alcoholic liquor caterers (service location).
10.
Auto storage areas.
11.
Aviation research and testing laboratories.
12.
Aviation schools.
13.
Drinking establishment (one (1) only).
14.
Gas stations.
15.
Parking lots.
16.
Restaurants.

Taxi and bus terminals.
18.
Temporary alcohol liquor sales.
19.
Trucking terminals and other allied uses.

C.
Conditional Uses. All uses permitted as a permitted use or a conditional use in the "IR" Industrial District.
D.
Lot Size Requirements.
1.
Minimum lot area:
a.
Airports: All airports shall have a length of not less than four thousand six hundred (4,600) feet for runways and clear zones and shall be considered as providing for a minimum facility of a Basic Utility Stage 1 airport as defined by the Federal Aviation Agency. No facility shall be less than this requirement. The width shall be four hundred fifty (450) feet.
b.
All other permitted and conditional uses: One (1) acre.
2.
Minimum lot width:
a.
Airports: Four hundred fifty (450) feet.
b.
All other permitted and conditional uses: One hundred fifty (150) feet.
3.
Minimum lot depth:
a.
Airports: Three thousand one hundred (3,100) feet.
b.
All other permitted and conditional uses: One hundred fifty (150) feet.
E.
Bulk Regulations.
1.
Maximum structure height: Thirty-five (35) feet.
2.
Yard requirements:
a.
Airport Runways: Five hundred (500) feet from the end of any runway to a public road and seven hundred (700) feet from any railway right-of-way.
