PART 14

MISCELLANEOUS PROVISIONS AND ENACTMENT

§ 27-1400 Interpretation, Purpose and Conflict.

[Ord. No. 1-70, 5/1/1968; as amended by Ord. No. 06-06, 6/6/2006]
In interpreting and applying the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of the health, safety, morals and general welfare of the Township. This chapter is not intended to interfere with or abrogate or annul other rules, regulations or ordinances of the Township, provided that where this chapter imposes a greater restriction upon the use of land or premises or upon the construction of a building or requires larger open spaces than are imposed by such other rules, regulations or ordinance, the provisions of this chapter shall control.

§ 27-1401 Repealer.

[Ord. No. 1-70, 5/1/1968; as amended by Ord. No. 06-06, 6/6/2006]
All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Nothing in this chapter shall be construed to affect any suit or proceeding now pending in any court or any rights accrued or liability incurred or any cause or causes of action accrued or existing under any ordinance repealed-by this chapter. Nor shall any right or remedy of any character be lost, impaired or affected by this chapter.

§ 27-1402 Severability and Validity.

[Ord. No. 1-70, 5/1/1968; as amended by Ord. No. 06-06, 6/6/2006]
The provisions of this chapter are severable and if any provisions, sentence, clause, section, part or application thereof shall be held illegal, invalid or unconstitutional by a court of competent jurisdiction, such illegality, invalidity or unconstitutionality shall not affect or impair any of the remaining provisions, sentences, clauses, sections or applications. It is hereby declared to be the legislative intent of the Township Supervisors, that this chapter would have been adopted had such illegal, invalid or unconstitutional provision, sentence, clause, section or part not been included therein and if such illegal, invalid or unconstitutional application had been specifically exempted therefrom.

§ 27-1403 Municipal Planning Code.

[Ord. No. 1-70, 5/1/1968; as amended by Ord. No. 06-06, 6/6/2006]
In the event of a conflict in a provision in this chapter and a provision of the Municipal Planning Code the provision of the Municipal Planning Code shall supersede the provision in this chapter.
