PART 8

OFF-STREET PARKING, LOADING AND ACCESS DRIVES

§ 27-800 Off-Street Parking Requirements.

1. 
In all districts, in accordance with every use, there shall be provided at the time any new building or structure is erected or any existing building is converted to a new use, or increased in capacity, off-street parking spaces in accordance with the requirements of this section. The facilities required herein shall be available throughout the hours of operation of the particular business or use for which they are provided.
A. 
All vehicle parking spaces shall contain a minimum of 200 square feet and shall have a width of not less than 10 feet.
B. 
All parking spaces and areas shall be graded for proper drainage and shall be surfaced so as to provide a durable, dustless wearing surface, and shall be designed to provide for the orderly and safe parking or storage of vehicles. All such off-street parking spaces and areas shall be maintained in good condition. In addition, where five or more spaces are to be provided in a parking area, the applicant shall consider the surface of the parking area to be impervious when preparing his Stormwater Management Plan for the site.
C. 
Off-street parking spaces for all residential uses shall be located on the same lot as the dwelling unit(s) to be served, and may be enclosed or unenclosed. Off-street parking spaces for nonresidential uses may be located on a lot other than that containing the principal use, but shall be situated within 300 feet of the use being served. Such remote parking shall however remain under the control of the owner or operator of the use to which it is accessory and applications involving such parking areas shall include documentation which authorizes the use of said area for parking in connection with the principal use.
D. 
The required parking spaces for any number of separate uses may be combined in one lot, but the required spaces assigned to one use may not be assigned to another use at the same time, except that parking spaces required for uses whose peak attendance will be at night or on Sundays, may be assigned to a use which will be closed at night and/or on Sundays, upon recommendation of the Township Planning Commission.
E. 
Adequate provisions shall be made for ingress and egress to all parking spaces. Access to off-street parking areas shall be limited to a minimal number of well defined locations. In no case shall unrestricted access along the length of a street upon which the parking abuts be permitted, except where the parking area is less than 35 feet in depth. Parking areas shall be designed so there will be no need for motorists to back over public walkways or rights-of-way. All off-street parking areas shall be clearly marked for ease of movement and efficiency of use.
F. 
Except as may be provided otherwise in Part 3, the District Regulations, a strip of land at least 10 feet in width shall be reserved as open space between any street line and any parking area in the C-H-M District where the parking area is intended to serve five or more vehicles. In the C-H-M, and I Districts, such strip shall be at least 15 feet in width, except as may be provided otherwise in Part 3, the District Regulations. This reserve strip shall be protected by wheel bumpers or curbs and shall be planted with grass or shrubs. No parking or plantings shall however be permitted within the clear sight triangle of any intersection.
G. 
Parking areas for all nonresidential uses shall be set back in accordance with the applicable District Regulations,[1] and shall be effectively screened on each side which adjoins or faces a Residential District or use. Such screening shall consist of a fence or wall at least four feet in height, a building, or shall meet the requirements for screen plantings set forth in this chapter.

H. 
Drives providing access to off-street parking areas intended to serve five or more vehicles shall be designed to meet the criteria set forth in Chapter 22, Subdivision and Land Development, of the Code of Kelly Township.
I. 
Any lighting which is used to illuminate off-street parking spaces or areas shall be mounted and shielded in such a manner that will effectively eliminate direct glare on adjacent properties or upon public streets.
J. 
Off street parking shall be provided as set forth in Table 2 of this chapter. In the case of any building or premises, the use of which is not specifically set forth in said Table 2 the number of parking spaces required for such use shall be in compliance with the provisions of the ITE Manual. Where neither Table 2 or the ITE Manual provided for the number of parking spaces for the said use the Zoning Officer shall determine the use set forth in Table 2 or the ITE Manual which is most similar to the proposed use and the number of parking space required for the use set forth in Table 2 or the ITE Manual shall apply. In the case of mixed uses or multiple uses of one structure or premises, the total number of required parking spaces or loading spaces shall be the sum of the required spaces for the various uses computed separately.
K. 
The owner or developer of a structure or premises may request a reduction in the number of required parking spaces. The request shall be in writing, shall set forth the reasons for said reduction and shall be submitted with the owner's or developer's application for a zoning permit. The Board of Supervisors may, in their sole and absolute discretion, approve the said request if they determine that approval of said request is in the best interests of the Township.
2. 
If the Board of Supervisors approves the request for the reduction in the number of required parking spaces owner or developer shall by notation on a subdivision plan and/or a land development plan or in a separate written document establish a permanent easement of such size, location and design as would accommodate the additional parking spaces necessary to meet the requirements of this chapter. The area within the said permanent easement shall not be utilized in any way that would impact the utilization of the area for parking in full compliance with the provisions of this chapter.
3. 
If, subsequent to the approval of the reduction in the required parking spaces, the Board of Supervisors determines that additional parking is required for the use of the structure or premises the then current owner or developer shall install such parking spaces in accordance with the then applicable provisions of this chapter. Said parking spaces shall be installed within such time as the Board of Supervisors shall direct in its determination that additional parking spaces are needed. Said installation shall be in full compliance with the provisions of all applicable statutes, ordinances, laws, rules and regulation.
4. 
The approval of the request to reduce the parking requirement by the Board of Supervisors shall be conditioned upon the execution of an agreement satisfactory to the Township, setting forth the nature and conditions of the said approval. The same shall be recorded in the Office of the Recorder of Deeds in and for Union County, Pennsylvania, contemporaneously with the recording of a subdivision plan and/or land development plan.
5. 
The determination by the Board of Supervisors that additional parking is required as herein above provided shall be in the sole and absolute discretion of the Board of Supervisors. Factors to be considered, while not all inclusive, are as follows: parking of vehicles on streets, roads or rights-of-way, and/or sidewalks, access lanes, service lanes, grass or lawns, double parking or parking out side designated areas or in any manner or placed in an unsafe manner or in such a way as to create a safety hazard.

Other Uses
Drive thru facilities
A minimum of 5 spaces shall be provided for stacking at drive thru facilities. Each spaces shall be at least 25 feet in length and none of the spaces shall be located in the right-of-way or required setback.

§ 27-801 Off-Street Loading Requirements.

1. 
Off-street loading berths or other space shall be provided in connection with every commercial, industrial, or institutional building or use which requires the delivery or shipment of merchandise or materials. Such accommodations shall meet the following requirements.
A. 
Each off-street loading space or berth shall not be less than 15 feet in width, 70 feet in length, and shall have an overhead clearance of no less than 14 feet, exclusive of drives or maneuvering area. The loading area shall be located entirely on the lot being served, either inside or outside of a building, and shall be designed so that there will be no need for drivers to use or back over public walkways or rights-of-way. Provided, however, that when an applicant can, in writing and as part of an application, clearly establish to the Township's satisfaction that due to the use and types of deliveries anticipated a loading space of 70 feet in length is not needed the same may be reduced to 25 feet. Deliveries made to the site shall only be made in accordance with the representations made to the Township.
B. 
Loading areas and spaces shall be constructed at grade level whenever possible. When necessary, ramps may be permitted, with a grade not exceeding 5% and shall include protection against water impoundment or drifting snow.
C. 
The number of loading spaces required shall be as set forth below in Table 3.

§ 27-802 Driveways And Access Drives.

1. 
To minimize traffic congestion and control street access in the interest of public safety, and to encourage the appropriate development of street and road access, the following standards shall apply to the construction or creation of all new driveways or access drives.
A. 
Every building or lot shall have access to a public street or an approved private street. Where possible, residential lots shall access onto a local street rather than a collector road or arterial highway. Access shall require a driveway or highway occupancy permit in accordance with PADOT standards or Township driveway requirements, as appropriate.
B. 
Where a driveway or access drive is to be installed in conjunction with a proposed use, the zoning permit application for that use shall include a scaled drawing showing the location, construction material(s), and the sight distance proposed for the driveway or access drive.
C. 
Except in the case of single and two-family dwellings, all driveways shall be designed so that there will be no need for motorists to back over public rights-of-way.
D. 
The number of driveways or access drives provided shall be the fewest required to adequately serve the needs of the abutting property. The total number of driveways or access drives shall not exceed two per lot, except where frontages of exceptional length occur. In cases where frontages are 50 feet or less along a local street or 200 feet or less along a collector road or arterial highway, each lot shall be limited to one driveway or access drive.
E. 
A common driveway serving two adjoining lots may be permitted, provided that the lot owners involved submit to the Township a mutually-acknowledged agreement subjecting said lots to such use.
F. 
Driveways and access drives shall be constructed of a durable, all-weather material and shall be maintained in good condition.
G. 
Driveways and access drives should be located where street alignment and profiles are favorable, where there are no sharp curves or steep grades, and where sight distance related to the driveway is sufficient to avoid creating hazardous traffic conditions.
H. 
All driveways and access drives shall be installed in accordance with applicable local, state and federal ordinances, laws, statutes and regulations and in particular Chapter 22, Subdivision and Land Development.
