ENFORCEMENT; PENALTIES
(a)
Enforcement. The following city officials shall have the following primary responsibilities with respect to enforcement of this chapter:
(1)
Development services director. The development services director shall have the primary responsibility for the enforcement of this zoning code.
(2)
Building official. The city building official, in addition to the authority and responsibility set forth in the building codes, shall have the primary responsibility for inspecting improvements required by this zoning code, other than publicly-owned improvements, and assuring compliance with such requirements prior to issuance of a certificate of occupancy.
(3)
City engineer. The city engineer or designee shall have the primary responsibility for inspecting publicly-owned improvements required to be constructed by this zoning code.
(4)
Code enforcement officer. The city code enforcement officer(s) shall have the primary responsibility for achieving voluntary compliance with this zoning code pertaining to the health, safety, and welfare of the citizens.
(b)
Right of entry. Whenever necessary for the purpose of investigating or enforcing the provisions of the zoning code, or whenever any enforcement officer has reasonable cause to believe that there exists in any structure, or upon any premise, any condition which constitutes a violation of the zoning code, an officer of the city may enter such structure or premise at all reasonable times to inspect the same, or to perform any duty imposed upon any said officer by law. If the structure or premises is occupied, the officer shall first present proper credentials and request entry. If the structure or premises is unoccupied, the officer must first make a reasonable attempt to contact a responsible person and request entry. If entry is refused, the officer seeking entry shall have recourse to every remedy provided by law to secure entry. All permits issued by the city shall contain a written agreement whereby the permittee shall authorize entry onto the property by any duly authorized officer of the city for the purpose of inspecting and approving the improvements permitted.
(c)
Penalties. A person found to be in violation of any provision of this chapter shall be guilty of a misdemeanor, and on conviction thereof, be punished by fine in accordance with the schedule of fees approved by the city council as amended from time to time.
