- ZONING DISTRICT REGULATIONS
(A)
The following zoning districts are created in the city:
(1)
"R-1" Single family dwelling district;
(2)
"R-2" Multiple family dwelling district;
(3)
"R-3" Manufactured home dwelling district;
(4)
"C-1" Commercial office and retail district;
(5)
"C-2" Commercial district;
(6)
"LI" Light industrial district; and
(7)
"P" Public district.
(B)
No land shall be used for any use other than provided in the regulations prescribed for the district in which it is located unless otherwise provided by this chapter.

(A)
Use. Property in an "R-1" Single Family Dwelling District shall be used only for 1 single family detached dwelling unit per lot. The use may include accessory structures incidental to a single family residence. No more than 3 individuals who are unrelated by blood, legal adoption or marriage may occupy a single family dwelling unless otherwise required by law.
(B)
Area requirements.
(1)
Minimum lot area:
(a)
Internal: 5,000 square feet.
(b)
Corner: 6,000 square feet.
(c)
No R-1 development shall exceed a density of more than 8 dwelling units per gross acre.
(2)
Minimum lot frontage on a public street:
(a)
Internal: 50 feet.
(b)
Corner: 60 feet.
(3)
Minimum lot depth: 100 feet.
(4)
Minimum depth of front setback: 25 feet.
(5)
Minimum depth of rear setback: 20% of lot depth.
(6)
Minimum width of side setback:
(a)
Internal lot: 5 feet for developed existing lot or 7½ feet for undeveloped lot.
(b)
Corner lot: 15 feet.
(7)
Maximum building coverage as a percentage of lot area: 50%.
(8)
Maximum accessory building coverage of rear yard: 30%.
(9)
Maximum height of structures: 30 feet or 2½ stories, whichever is less.

The minimum lot area shall be 10,000 square feet for the first 3 dwellings units and each additional dwelling unit shall be a minimum of 3,630 square feet.
(b)
No MF-2 Development shall exceed a density of more than 12 dwelling units per gross acre.
(2)
Minimum lot frontage on a public street:
(a)
Internal: 100 feet.
(b)
Corner: 100 feet.
(3)
Minimum lot depth: 100 feet.
(4)
Minimum depth of front setback: 25 feet.
(5)
Minimum depth of rear setback shall be 10 feet. There shall be no encroachment or overhangs into this required rear yard.
(6)
Minimum width of side setback:
(a)
Internal lot: 10 feet.
(b)
Corner lot: 15 feet.
(7)
Maximum building coverage as a percentage of lot area: 50%.
(8)
Maximum accessory building coverage as a percentage of rear yard: 30%.
(9)
Maximum height of structures: 45 feet or 3 stories, whichever is less.

Minimum depth of rear setback shall be 5 feet. There shall be no encroachment or overheads into this required rear yard.

Minimum width of side setback:
(a)
Internal lot: 5 feet.
(b)
Corner lot (street side): 15 feet.
(7)
Maximum building coverage as a percentage of lot area: 50%.
(8)
Maximum accessory building coverage as a percentage of rear yard: 30%.

Maximum height of structures: 30 feet or 2½ stories, whichever is less.

Acceptable materials. Materials other than metal or aluminum must be used on the lower one-third of the front and sides of buildings that are visible from public streets or neighboring property.

Use. Property in a "C-2" Commercial District shall be used for any purpose authorized in a "C-1" Commercial Office and Retail District and for commercial purposes involving any of the following:
(1)
Outdoor storage or display of vehicles, equipment, supplies, or inventory;
(2)
On-premises storage of hazardous chemicals in bulk quantities provided that a specific use permit is required for such purpose;
(3)
Non-retail sales or service provided that a specific use permit is required for such purpose; and
(4)
Wireless telecommunications facilities as governed by the Telecommunications Act of 1996 and successor statutes.
(B)
Area requirements.
(1)
Minimum lot area:
(a)
Internal: 10,500 square feet.
(b)
Corner: 13,500 square feet.
(2)
Minimum lot frontage on a public street:
(a)
Internal: 70 feet.
(b)
Corner: 90 feet.
(3)
Minimum lot depth: 150 feet.
(4)
Minimum depth of front setback: 25 feet.
(5)
Minimum depth of rear setback shall be 10 feet with an additional 2 feet required for each story above 24 feet, up to a maximum setback of 25 feet. There shall be no encroachment or overheads into this required rear yard.
(6)
Minimum width of side setback:
(a)
Internal lot: 5 feet.
(b)
Corner lot (street side): 15 feet.
(7)
Maximum building coverage as a percentage of lot area: 50%.
(8)
Maximum accessory building coverage as a percentage of rear yard: 30%.

(5)
Minimum depth of rear setback shall be 5 feet. There shall be no encroachment or overhangs into this required rear yard.

Minimum width of side setback:
(a)
Internal lot: 25 feet.
(b)

(7)
Maximum building coverage as a percentage of lot area: 70%.
(8)

Specific use permit. A specific use permit shall be required for any use of property in a light industrial district.

(a)
Internal: 5,000 square feet.

Minimum lot frontage on a public street:
(a)
Internal: 50 feet.
(b)
Corner: 60 feet.
(3)
Minimum lot depth: 100 feet.
(4)
Minimum depth of front setback: 25 feet.
(5)
Minimum depth of rear setback shall be 5 feet. There shall be no encroachment or overhangs into this required rear yard.
(6)
Minimum width of side setback:
(a)
Internal lot: 5 feet.
(b)
Corner lot: 15 feet.
(7)
Maximum building coverage as a percentage of lot area:
(a)
Residential: 50%.
(b)
Non-residential: n/a.
(8)
Maximum accessory building coverage as percentage of rear yard: 30%.
(9)
Maximum height of structures: 45 feet or 3 stories, whichever is less.
(10)
No lot to be used for multifamily purposes shall contain an area less than this amount plus 1,500 square feet for each dwelling unit in excess of 2 dwelling units to be constructed or occupied upon such lot.

(A)
Any use of property that does not conform to the regulations prescribed in the preceding sections of this chapter shall be called a non-conforming use.
(B)
If such use is abandoned or discontinued for 2 consecutive months, the next use of the property shall conform to the existing zoning.
(C)
Any non-conforming use of property may be continued for definite periods of time, and subject to such regulations as the Planning and Zoning Committee may require for immediate preservation of the adjoining property and the ultimate removal of the non-conforming use.
(D)
A non-conforming use shall not be extended or rebuilt in case of obsolescence or actual destruction by fire or other cause. In case of partial destruction by fire or other causes, not exceeding 50% of its value, the Building Inspector shall issue a permit for reconstruction. If destruction is greater than 50%, but less than the total, the City Council may grant permit for repair after considering public welfare, character of the area surrounding the designated non-conforming use, and the conservation and preservation of property.
