CHAPTER 3

ZONING DISTRICTS AND MAP

10-3-1: DISTRICTS ESTABLISHED:

In order to classify, regulate and restrict the locations of trades and industries, and the location of buildings designated for specified uses; to regulate and limit the height and bulk of buildings hereafter erected or altered; to regulate and limit the intensity of the use of lot areas; and to regulate and determine the area of yards, courts and other open spaces within and surrounding such buildings, the Village is hereby divided into classes of districts. The use and bulk regulations are uniform in each class or district, and such districts shall be known as:

10-3-2: AREAS CLASSIFIED IN DISTRICTS:

It is intended that the entire area of the Village, including all land and water areas such as lakes, parks, streets, alleys, railroad and other rights-of-way, shall be included in one of the districts established by this title. Any area within the Village that is not clearly shown on the Village zoning map as being included within any district shall be deemed to be in the Estate Residence District (E-1). 10-3-3: ZONING MAP:

The boundaries of these districts are indicated upon the zoning map of the Village, which map is hereby adopted (by reference) and made a part of this title. Planned residential developments shall not be designated on the zoning map unless and until the planned residential development(s) shall have been approved pursuant to chapter 5, article J of this title. The zoning map, with all the notations, references and other matters shown thereon, shall be on file in the Office of the Village Clerk and shall be as much a part of this title as if the notations, references and other matters set forth by said zoning map were all fully described herein. 10-3-4: DETERMINATION OF DISTRICT BOUNDARIES:

The boundaries of the various districts created by this title shall be the boundaries shown on the zoning map. Where uncertainty exists with respect to the boundaries of the various districts as shown on the zoning map, the following rules shall apply:
A.   The district boundaries are either streets or alleys, unless otherwise shown, and where the designations on the zoning map indicate that the various districts are approximately bounded by street or alley lines, the centerline of such streets or alleys shall be construed to be the boundaries of such districts.
B.   Where the district boundaries are not shown to be streets or alleys, and where the property has been or may hereafter be divided into blocks and lots, the district boundaries shall be construed to be lot lines, and where various districts are approximately bounded by lot lines, such lot lines shall be construed to be the boundaries of such districts.
C.   Where the district boundaries are not shown by the streets or alleys or lot or block lines, the district boundaries shall be determined by use of the scale shown on the map. (Ord. 87-38, 12-14-1987)

10-3-5: ZONING OF ANNEXED LAND:

Any and all territory hereafter annexed to the Village shall be, and the same is hereby declared to be, included in the Country Estate Residence District (C-E) until and unless otherwise hereafter provided by ordinance after a public hearing by the PCZBA in the manner provided by law.
