ARTICLE II

- ESTABLISHMENT OF DISTRICTS

Sec. 1-1. - Number and titles.

The town of Lake Waccamaw, North Carolina, and its extraterritorial jurisdiction are hereby divided into sixteen (16) districts:

OAR Open Area/Recreation District
AF Agriculture/Forestry District
R-20 Residential District (20,000 square feet)
R-15 Residential District (15,000 square feet)
R-10 Residential District (10,000 square feet)
MFR Multiple-Family Residential District
C Commercial District
HM Hotel/Motel District
MC Marina Campground District
NB Neighborhood Business District
LI Light Industrial District
PUD Planned Unit Development District
O/I Office and Institutional District
MH/HNO Mobile Home/Manufactured Home Overlay District
LI-MHO Light Industrial Mobile Home Overlay District
SA Sailing Association District

 

Sec. 1-2. - Zoning district map.

The boundaries of the zoning districts are shown upon the map on file in the town office and made a part hereof, entitled "Official Zoning Districts, Lake Waccamaw, North Carolina." The zoning district map and all the notations, references and all amendments thereto, and other information shown thereon, is hereby made a part of this ordinance the same as if such information were all fully described and set out herein.

Creation. In the creation, by this ordinance of the respective zones, the town commission has given due and careful consideration to the peculiar suitability of each and every zone for the particular regulations applied thereto, and the necessary, proper and comprehensive groupings and arrangements of the various uses and densities of population in accordance with a well considered land use plan for the development of the town.

Zoning district map legitimacy and location. Regardless of the existence of purported copies of the zoning district map which may from time to time be made or published, the official zoning district map of the town of Lake Waccamaw shall be located in the office of the town clerk.

Amendments to the zoning district map. No changes of any nature shall be made to the zoning district map except in conformity with the procedure set forth in the ordinance.

Sec. 1-3. - Interpretation of district boundaries.

The boundaries of each district which are indicated on the zoning map of the town of Lake Waccamaw, together with all explanatory matter thereon, are hereby adopted by reference and declared to be a part of this ordinance.

Where uncertainty exists as to the boundaries of districts as shown on the zoning map, the following rules shall apply:

Boundaries following centerlines. Boundaries indicated as approximately following the centerlines of streets, highways, or alleys shall be construed to follow such centerlines.

Boundaries following lot lines. Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.

Boundaries following town limits. Boundaries indicated as approximately following town limits shall be construed as following town limits.

Boundaries following shorelines. Boundaries indicated as approximately following the centerlines of streams, creeks, or other bodies of water shall be construed to follow such centerlines excepting the lake where boundaries shall follow the shoreline.

Boundaries parallel to centerlines. Where district boundaries are so indicated that they are approximately parallel to the centerline of streets, alleys or highways, or the rights-of-way of the same, such district boundaries shall be construed as being parallel thereto and at such distance there from as indicated on the zoning map.

Boundaries dividing lots. Where a district boundary line divides a lot or tract in single ownership, the district requirements for the least restricted portion of such lot or tract shall be deemed to apply to the whole thereof, provided such extensions shall not include any part of a lot or tract more than fifty (50) feet beyond the district boundary line. The term "least restricted" shall refer to use restrictions and not to lot size.

Cases of uncertainty in boundary decisions. In the event that uncertainty exists in the interpretation of the district boundaries, the Lake Waccamaw board of adjustment shall interpret the intent of the zoning map as to the location of such boundaries.
