CHAPTER 23

GENERAL PROVISIONS

§ II-23.001 COMPLAINTS REGARDING VIOLATIONS.

   Whenever a violation of this title occurs, or is alleged to have occurred, any person may file a complaint. The complaining party shall fully complete and submit a complaint form, which is available from the County Planning Department or the county website.

§ II-23.002 PENALTIES.

   In addition to all other remedies available to the county to prevent, correct, or abate ordinance violations, a violation of this title is also punishable by a fine and/or imprisonment pursuant to SDCL § 7-18A-2 as provided below:
   (A)   A fine not to exceed $500 for each violation or by imprisonment for a period not to exceed 30 days for each violation, or by both such fine and imprisonment;
   (B)   Each day the violation continues shall constitute a separate violation; and
   (C)   The date of the first violation shall be the date upon which the property owner first received notice of the violation.

§ II-23.003 SEVERABILITY CLAUSE.

   This title and the various parts, chapters, sections, and divisions thereof are hereby declared to be severable. If any part, sentence, division, section, or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, it is hereby provided that the remainder of this title shall not be affected thereby.

§ II-23.004 SAVING CLAUSE.

   These regulations shall in no manner affect pending actions either civil or criminal, founded on or growing out of any regulations hereby repealed. These regulations shall in no manner affect rights or causes of action, either civil or criminal, not in suit that may have already accrued or grown out of any regulations repealed.

§ II-23.005 PURPOSE OF CATCH HEADS.

   The catch heads appearing in connection with the sections of these regulations are inserted simply for convenience to serve the purpose of an index. The introductory statements found at the beginning of each section are to serve as general references only. The catch heads, introductory statements, and illustrative examples of zoning terms shall be wholly disregarded by any person, office, court, or other tribunal in construing the terms and provisions of these regulations.

§ II-23.006 EFFECTIVE DATE.

   These regulations shall be in full force and effect from and after its passage and publication as provided by law.
