17.37.010 - Initiation of amendment.

The city council may, from time to time, amend, supplement, or change this chapter and the regulation of maps appertaining thereto.

A.

City Initiation. An amendment, supplement or change may be initiated by the city council.

B.

Property Owner Initiation. Whenever the property owner of any land or building desires a reclassification of their property or change in regulations applicable thereto, they may file with the City of Libby Planning Board on forms provided by the planning board for this purpose, a petition duly signed and verified by the property owner requesting an amendment or change of regulations prescribed for such property.

C.

Filing Fee. A filing fee shall be paid to City of Libby Planning Board upon filing of each application for the purpose of defraying expenses incidental to the proceedings. No application will be regarded as being filed until such fee has been paid. The amount of the filing fee shall be set by the resolution of the city council.

17.37.020 - Investigation of amendment.

Upon the initiation of an amendment by the city council or upon petitions from a property owner, the city council shall direct the planning board to conduct an investigation of facts bearing on such initiation or petition as to provide necessary information to assure that the action of each such petition is consistent with the intent and purpose of this chapter.

17.37.030 - Review by the planning board.

Before an amendment is approved, or denied, a public meeting with the planning board shall be held.

A.

The planning board shall review the proposed amendment, supplement, or changes in the zoning boundary, at which time interested parties and citizens shall have an opportunity to be heard.

B.

The planning board shall make recommendations to approve, deny or conditionally approve the proposed amendment, supplement, or change in zoning boundary to the city council for the public hearing being held at a later date.

17.37.040 - Hearing for amendment.

Before an amendment is approved, or denied, a public hearing shall be held.

A.

The city council shall hold a public hearing on the proposed amendment, supplement, or changes in the zoning boundary, at which time interested parties and citizens shall have an opportunity to be heard.

B.

Notice of the public hearing shall be published at least once in an official paper or a paper of general circulation at least fifteen (15) days prior to the public hearing.

C.

If a protest against such changes signed by owners of twenty percent (20%) or more either of the area of lots included in such proposed change or of those lots immediately adjacent in the rear thereof extending one hundred fifty (150) feet therefrom or of those lots adjacent on either side thereof extending one hundred fifty (150) feet from the street frontage of such opposite lots such amendment shall not become effective except by the favorable vote of three-fourths of all members of city council.
