- SIGNS
(a)
Permit required. Except those specified in subsection (b) of this section, no signs shall hereafter be located, erected, moved, reconstructed, extended, enlarged, converted or structurally altered without a building permit and without being in conformity with the provisions of this chapter. All signs shall also meet all the structural requirements of other applicable codes and ordinances of the village.
(b)
Signs excepted. All signs must have a building permit except the following:
(1)
Signs over show windows or doors of a nonconforming business establishment announcing, without display or elaboration, only the name and occupation of the proprietor and not to exceed two feet in height and ten feet in length.
(2)
Real estate signs not to exceed eight square feet in area which advertise the sale, rental or lease of the premises upon which said signs are temporarily located.
(3)
Home occupation signs: See section 135-68(g)(2).
(4)
Bulletin boards for public charitable or religious institutions not to exceed 32 square feet in area located on the premises.
(5)
Memorial signs, tablets, names of buildings and date of erection when cut into any masonry surface or when constructed of metal and affixed flat against the structure.
(6)
Official signs, such as traffic control, parking restriction, information and notices.
(7)
Temporary signs when authorized by the building inspector for the period of construction.
(8)
No such sign mentioned above, except official signs shall be located on public road right-of-way or in, on or over public water.
(c)
Signs permitted. Signs are permitted for all commercial, business park and industrial uses subject to the following restrictions:
(1)
Wall signs placed against the exterior walls of buildings shall not extend more than 12 inches outside of a building's wall surface, shall not exceed 200 square feet in area for any one premises.
(2)
Projecting signs fastened to, suspended from, or supported by structures shall not exceed 100 square feet in area for any one premises; shall not extend more than six feet into any required yard; shall not be less than ten feet from all lot lines; shall not exceed a height of 20 feet above the mean centerline street grade; and shall not be less than ten feet above the sidewalk nor 15 feet above a driveway or an alley.
(3)
On-premises ground signs are subject to the following restrictions:
a.
Limited to one on-premises ground sign for each individual premises which advertises the business names, services offered, or products sold.
b.
On parcels having highway frontage on USH 41 of 300 feet or more, an additional on-premises ground sign will be permitted for each additional 200 feet of highway frontage on USH 41 in excess of the first 200 feet of USH 41 frontages, provided, when more than one on-premises ground sign is permitted, no on-premises ground sign shall be located closer than 200 feet from any other on-premises ground sign located on the same parcel.
c.
Such sign shall not exceed 20 feet in height.
d.
On parcels having frontage on East Avenue and or USH 41 not exceeding 1,500 feet in distance from STH 67, on-premises ground signs may be extended to 70 feet in height.
e.
Such signs shall meet all yard requirements for the district in which it is located, or a 15-foot minimum set back, whichever is less.
f.
Such sign shall not exceed 100 square feet in display area on any one side, nor 200 square feet in display area on all sides for any one sign.
g.
On parcels having Interstate frontage along I-41 on-premise ground signs located not more than 200 feet from the existing or proposed right-of-way shall not exceed 400 square feet in display area on any one side nor 800 square feet in display area on all sides for any one sign.
(4)
Off-premises ground signs shall not be located within 50 feet of the existing or proposed right-of-way of any state or county trunk highway, or any town road measured horizontally along a line normal or perpendicular to the center of the highway; and shall not be located within 750 feet of any other off-premises ground sign, located on the same side of the road shall not exceed 30 feet in height; and shall not exceed 300 square feet in display area on any one side nor 600 square feet in display area on all sides.
(5)
Roof signs shall not exceed ten feet in height above the roof and it shall meet all the yard and height requirements for the district in which they are located and shall not exceed 300 square feet on all sides for any one premises.
(6)
Directional signs may be erected for the purpose of facilitating or controlling the efficient or safe movement of pedestrians or vehicles on private property. Such signs shall not be used for advertising purposes and particularly shall not include the name of any person, firm, company, organization or any product or service except as approved to designate directions to different businesses on the same site. Such signs shall be located on the property to which they pertain, shall not exceed an area of six square feet nor a height of three feet and shall be located at least three feet within the nearest property line. Such signs shall not be permitted on R-1, R-2 or R-3 Residential Districts.
(d)
Traffic. Signs shall not resemble, imitate or approximate the shape, size, form or color of railroad or traffic signs or devices. Signs shall not obstruct or interfere with the effectiveness of railroad or traffic signs, signals or devices. No sign shall be erected, relocated or maintained so as to prevent free ingress to or egress from any door, window, or fire escape, and no sign shall be attached to a standpipe or fire escape. No sign shall be placed so as to obstruct or interfere with traffic visibility.
(e)
Electronic message signs permitted.
(1)
Electronic message signs are permitted and are defined as any sign whose message may be changed by electronic process, including such messages as copy, art, graphics, time, date, temperature, weather or information concerning civic, charitable or the advertising of products or services for sale on the premises. This also includes traveling or segmented message displays.
(2)
Electronic message sign cannot be more than 15 percent of the total square footage of display area allowed per side as stated in subsection (c)(3)f of this section.
(3)
Electronic message signs cannot have more than three lines.
(4)
Electronic message signs shall be permitted in C-2 Highway Commercial, I Industrial and BP Business Park zoning districts.
(f)
Existing signs. Signs lawfully existing at the time of the adoption or amendment of the ordinance from which this chapter is derived may be continued although the use, size, or location does not conform with the provisions of this section. However, it shall be deemed a non-conforming use or structure, and the provisions of section 135-238 shall apply.
(g)
Portable signs. No sign shall be erected which is not permanently affixed to a building, structure or the ground for more than seven days in any 30-day period except those giving public service information.
