ARTICLE III

PROVISION OF OFFICIAL ZONING MAP AND ESTABLISHMENT OF DISTRICTS

Sec. 300.- Official zoning map.

The City of Lovejoy is hereby divided into zoning districts, as shown on the official zoning map (also referred to herein as "zoning map") which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this appendix.

The official zoning map shall be identified by the signature of the mayor, attested by the clerk of the city council, and bearing the seal of the city under the following words: "This is to certify that this is the official zoning map referred to in the Zoning Ordinance of the City of Lovejoy (together with the date of adoption of this appendix) (___________)."

Sec. 301. - Amendments to maps.

If, in accordance with the provisions of this appendix, changes are made in district boundaries or other matter portrayed on the official zoning map, such changes shall be entered on the official zoning map periodically after the amendment has been approved by the city council, with an entry in the minutes of such city council's meeting as follows: "On (date) by official action of the city council, the following (change) changes (was) were made to the official zoning map: (brief description of nature of change or changes)," which entry shall be signed by the mayor and attested by the clerk.

No changes of any nature shall be made in the official zoning map or matter shown thereon except in substantial compliance with the procedures set forth in this appendix.

Regardless of the existence of purported copies of the official zoning map which may, from time to time, be made or published, the official zoning map shall be located in the office of the zoning administrator, and shall be final authority as to the current zoning status of the city.

Sec. 302. - Replacement of official zoning map.

In the event that the official zoning map becomes damaged, destroyed, lost or difficult to interpret because of the nature or number of changes and additions, the city council may by ordinance adopt a new official zoning map which shall supersede the prior official zoning map. The new official zoning map may correct drafting or other errors or omissions in the prior official zoning map, but no such correction shall have the effect of amending the original official zoning map, and this new map shall be identified by the signature of the mayor, attested by the clerk, and bearing the seal of the city under the following or similar words: "This is to certify that this official zoning map supersedes and replaces the official zoning map of the City of Lovejoy." Unless the previous official map has been lost, or has been totally destroyed, the prior map, or any significant remaining parts thereof, shall be preserved, together with all available records pertaining to its adoption or amendment.

Sec. 303. - Rules for interpretation of district boundaries.

Where uncertainty exists with respect to the location of the boundaries of any zoning district in the City of Lovejoy, the following rules shall apply:

(1)

Where district boundaries are indicated as approximately following the centerline of streets or highways, street lines, or highway right-of-way lines, such lines shall be construed to be district boundaries; provided, however, that where known, right-of-way lines shall be construed to be district boundaries and the centerlines shall be construed as the district boundaries only when the zoning administrator cannot make a determination as to the right-of-way lines.

(2)

Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries.

(3)

Where district boundaries are so indicated that they are approximately parallel to the centerlines of streets, highways or railroads, or rights-of-way of same, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the official zoning map; provided, however, that where known, right-of-way lines or dimensions exist, the right-of-way lines shall be so used only when the zoning administrator cannot make a determination as to the centerlines. If no distance is given, such dimension shall be determined by the use of the scale shown on said official zoning map.

Where a district boundary line as appearing on the official zoning map divides a lot in single ownership at the time of enactment of the ordinance from which this appendix is derived, the district requirements for the least restricted portion of such lot shall be deemed to apply to the whole thereof, provided that such extension shall not include any part of such a lot more than 35 feet beyond the district boundary line.

(5)

In the case of a through lot fronting on two approximately parallel streets that is divided by a zoning district boundary line paralleling the streets, the restrictions of the zoning district in which each frontage of the through lots lies shall apply to that portion of the through lot.

(6)

Where zoning district boundaries are in doubt, the zoning administrator or his designee shall make such interpretation using the appropriate scale from the official zoning map.

(7)

The zoning administrator may utilize the minutes and such other records as may be available to interpret the zoning map when boundary lines may be in doubt.

Sec. 304. - Districts listed.

For the purpose of this appendix, the City of Lovejoy, Georgia, is divided into zoning districts designated as follows:
