DAY CARE HOMES
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Day care home means family homes which receive at least three but less than nine children for less than 24 hours per day. The maximum of eight children includes the family's natural, foster, or adopted children and all other persons under the age of 12. The term does not include homes which receive only children from a single household.

Any allowed day care home within the village must be licensed by the state department of children and family services and be able to supply proof of the same to the village. In addition, a village day care home license must be obtained prior to the conducting of any day care home business within the village at a cost of $100.00 per year.

Any day care home located within the village may not do business without first obtaining a special use permit from the village in compliance with article IV pertaining to home occupations.

(a)
No day care home is permitted to do business in the village unless, in addition to the above requirements, it is located within a R-1A one-family dwelling district, a B-1 neighborhood business service district, a B-2 neighborhood commercial business district, a B-3 regional commercial business district, or a LM light manufacturing district.
(b)
These restrictions are implemented after consideration of the board of trustees of the village of the traffic congestion, fire and police department access and administrative factors in allowing day care home facilities to exists within the village while still maintaining the health, welfare and safety of its citizens and the children that frequent day care home facilities.

The village requires that as a requirement of any day care home business license issued by the village the following requirements apply in addition to the standards promulgated by the Illinois Department of Children and Family Services (title 89, chapter III, subchapter E, part 406):
(1)
An inspection by the fire and building department of the village prior to approval.
(2)
Twice per year fire inspections at a cost of $25.00 per inspection payable by the day care home facility to the village.
(3)
A properly functioning fire alarm system, which is defined as a system consisting of both smoke and fire detectors covering specific and general areas of the day care location and is to include; (1) the area designated for day care operations; (2) furnace and laundry room areas; (3) any kitchen area; (4) any bedroom area; (5) is to be interconnected, meaning one alarm activates all devices; and (6) is connected to the Lynwood Fire Department through a central station or other 24-hour monitoring system. Any area of the day care facility, in which sleeping is permitted, is to have carbon monoxide detectors included in the system. All components are to meet applicable underwriter laboratory, National Fire Protection Association and International Fire Code requirements, as adopted by the village, and are to be installed by an alarm company licensed to operate in the Village of Lynwood.
(4)
The filing with the village of a blueprint or diagram of the home in case of a fire.
(5)
The filing of an approved fire safety plan acceptable to the village fire department.
(6)
Proof of liability and home business insurance.
(7)
An approved six-foot high fence around the backyard of any day care home in which the children are allowed to play outside.
(8)
An automated sprinkler system in any area of the home that the children will be located that are in any B-1, B-2, B-3 or LM zoning district.
(9)
Any and all requirements of 225 ILCS 10/1 et seq. that are not in conflict with this article shall be followed. If a conflict exists between any requirement contained in 225 ILCS 10/1 and this article, this article's provisions shall be followed as long as permitted to do so by law.
(10)
No smoking is allowed in any day care home located within the village per 225 ILCS 10/5.5.
(11)
The use of kerosene fueled or space heaters will be prohibited under any circumstances in any day care home located within the village.
(12)
All day care home's located within the village shall have on their premises the following:
a.
A first aid kit.
b.
Fire extinguishers.
c.
Electrical covers for all electrical outlets.
d.
No fireplaces in use during day care hours.
e.
No children are allowed to play in any area of the home that is below ground level unless there exists at least two means of exiting the home from that level.
f.
No lead base paint can exist within the home.
g.
All chemicals and cleaning supplies shall be kept out of reach of any and all children.
h.
All pools shall be fenced in with a locked gate.
i.
Any pets shall be free of disease and have current vaccinations with verification from a licensed veterinarian and are to be tagged and licensed by the village.
j.
The dwelling shall be kept clean, sanitary and in good repair.
k.
No bedridden or chronically ill persons shall be present within any day care home which would affect the ability of the care giver to supervise the children.
l.
Operation of other businesses on the premises must not interfere with the care of the children.
m.
Any care giver shall be at least 18 years of age.
n.
There shall be at least one person within the home that is at all times present and is certified in first aid.
o.
No care giver may be employed outside the home during hours care is being provided.
p.
Any assistants within the home must be at least 14 years of age and five years older than the oldest child present.
q.
All care givers shall have a file of the names, addresses and telephone numbers of all children, along with a relevant medical history which include allergies and any medications the child is on.
r.
Any child being watched shall have had all immunizations required by the state department of public health.
s.
No child shall remain on the premises of any day care home for over 24 hours consecutively.
t.
If swimming is permitted, one adult is required to watch any children swimming and one adult is required to watch any children not swimming.

Anyone found guilty of violating this article shall be subject to a minimum fine of $250.00 and up to a maximum of $500.00 for each repeat violation. Each and every day that anyone is in violation of this article shall constitute a separate and distinct violation. The village reserves the right, in addition to the ability to seek a monetary fine, to seek any equitable relief available to obtain compliance with this article.
