ARTICLE VIII

SATELLITE RECEIVING ANTENNA

Sec. 114-494.- Residential districts.

A satellite receiving antenna may be located in any residential district provided that the same:

(1)

Shall be neutral in color and bear no advertising emblem or information other than the name of the manufacturer in letters not to exceed two inches in height;

(2)

Shall be compatible with the appearance and character of the neighborhood;

(3)

Shall be limited to one per lot;

(4)

Shall not exceed ten feet in diameter;

(5)

Shall not be roof-mounted;

(6)

Shall be located only in a rear yard or in the rear one-half of a side yard, a minimum of ten feet from any lot line. For corner lots, such antennas may be located in the rear yard or rear one-half of the side yard that does not face the street;

(7)

The full impact of satellite receiving antennas shall be reduced by screening. The antenna shall be screened by a fence, dense screening hedge or other live planting acceptable to the village, to a maximum height of six feet. Said fence, dense screening hedge or other live planting shall be located on or near the lot lines and shall otherwise comply with the applicable zoning requirements governing its location;

(8)

Multifamily dwellings must meet the foregoing requirements, with the following stipulations:

a.

"Lots" will mean "building";

b.

All connection wires must be either underground or concealed within the building.

Sec. 114-495. - Business districts.

A satellite receiving antenna may be located in any business district provided that the same:

(1)

Shall be neutral in color and bear no advertising emblem or information other than the name of the manufacturer in letters not to exceed two inches in height;

(2)

Shall be compatible with the appearance of the neighborhood;

(3)

Shall be limited to one per lot or per building, whichever is less;

(4)

Shall not exceed 12 feet in diameter;

(5)

If roof-mounted, shall be to a maximum height of 35 feet from the ground. Additional requirements shall apply to roof-mounted satellite receiving antennas;

(6)

If not located directly on the ground, shall not be constructed any closer to the ground than ten feet above ground level from any street adjoining the lot;

(7)

If ground-mounted, shall not be located between a building and a front lot line. The full impact of satellite receiving antennas shall be reduced by screening. If the subject parcel adjoins a residential district, all antennas shall be placed a minimum of ten feet from any lot line and effectively screened by a fence, wall, or dense screening hedge to a maximum height of six feet. Said fence, wall or dense screening hedge shall be located on or near the lot line bounding the residential district and shall otherwise comply with the applicable zoning requirements governing its location.

Sec. 114-496. - Satellite receiving antenna construction.

(a)

Permit; fee. Before proceeding with the construction, alteration, or repair of a satellite receiving antenna in the village, a permit for the same shall be first obtained by the owner or his agent from the village. A fee for such permit will be $50.00, payable at the time the permit is issued. There shall be an additional inspection fee of $20.00 also payable at the time the permit is issued.

(b)

Compliance with BOCA and FCC requirements. All satellite receiving antennas shall comply with BOCA and FCC requirements.

(c)

Conformance with village building and electrical codes. The construction and installation of all satellite receiving antenna system shall conform to applicable village building code and electrical code regulations and requirements.

(d)

Electro-magnetic interference. Each satellite receiving antenna system shall be filtered and/or shielded so as to prevent the emission of radio-frequency energy that would cause any harmful interference with the radio and/or television broadcasting or reception on adjacent properties. In the event harmful interference is caused subsequent to the granting of a building permit, the owner of the dish antenna shall promptly take steps to eliminate the harmful interference in accordance with all applicable regulations. Such harmful interference shall be removed within seven working days after notice to the owner of the same.

(e)

Construction materials. Satellite receiving antennas shall be constructed of corrosive-resistant material.

(f)

Wind resistance. Satellite receiving antennas shall be constructed and erected in a secure and a wind-resistant manner. The antenna shall be wind-resistant enough to withstand 100 mile per hour winds, with wind gusts of 135 miles per hours.

(g)

Grounding. The satellite receiving antenna must be adequately grounded for protection against a direct strike of lightning.

(h)

Certification for roof-mounted antennas. Roof-mounted satellite antennas shall have a certification from a structural engineer regarding the location stating that the structure is capable of handling the antenna and that said antenna does not provide any additional stress which the structure cannot bear.

Sec. 114-497. - Miscellaneous provisions.

(a)

Permanent/nonpermanent units. Only permanently constructed or installed satellite receiving antennas, towers, etc., are permitted. Mobile and nonpermanent units are prohibited, except for sales demonstration units. A sales demonstration permit may be obtained for a fee of $10.00. Such permit will allow for a demonstration period of seven days.

(b)

Antennas not covered by article. Antennas designed and used for amateur frequency allocations, as set by the Federal Communication Commission for licensed amateur radio operators are not included in or covered by this article.

(c)

Dish antennas. Antennas covered by this article are "dish" antennas used for reception of signals from geo-stationary synchronous satellites in the 4GHZ microwave band. This article does not apply to antenna types which may be used for reception of D.B.S. signals in the future.

(d)

Connecting cables. All connecting cables will be buried at least three inches underground. Any tower or roof cables shall be secured properly.

(e)

Final inspection; tag. After final inspection a permanent visible tag will be placed upon the structure.

(f)

Parts extending beyond lot line. No part of any tower, mast or antenna shall extend beyond the lot line of the property on which it is erected.

(g)

Tower, mast or antenna not exceed a height of 16 feet. Notwithstanding any provision contained in this article to the contrary, any ground-mounted tower, mast or antenna coming within the purview of this article shall not exceed a height of 16 feet, measured from the ground level.

(h)

Height and location. Height and location are subject to the further condition that the tower, mast or antenna cannot have a height that would permit it to extend onto neighboring property in the event the same is toppled or falls from any cause.

(i)

Homeowners' association, etc., regulations. The provisions of section 114-494(6) regulating the location of satellite receiving antennas is subject to the provisions of any valid regulation of any homeowner's association, condo association, housing cooperative and to any conveyance, conditions or restrictions contained in any plat of subdivision or otherwise recorded as to any subdivision, area or individual parcel. The provisions of section 114-494(6) shall not be determined to enlarge, annul or abrogate any such conditions, regulations or restrictions.

(j)

Right to grant variations. The zoning and planning board shall have the right to grant variations under conditions provided for in the village zoning ordinance (May 24, 1986).
