CHAPTER 6

RESIDENCE DISTRICTS

13-6A-1: PERMITTED USES:

Churches, temples or synagogues – on a lot not less than one acre in area.
Convents, monasteries and seminaries – on lots not less than one hundred fifty feet (150') in width and eighteen thousand (18,000) square feet in area.
Group homes.
"Home occupations" as defined in section 13-2-2 of this title.
Municipal playgrounds.
Single-family detached dwellings.
Temporary buildings for uses incidental to construction work. Such buildings shall be removed upon the completion or abandonment of the construction work.
Accessory buildings and uses customarily incidental to the above uses. (1965 Code title 6 § 401.1; amd. 2009 Code)

13-6A-2: SPECIAL USES:

Daycare centers and nursery schools.
Off street parking for permitted or special uses in other districts.
Parks and playgrounds, private, not for profit – on lots not less than one acre in area.
Planned unit development.
Public buildings, including libraries, fire stations and police stations.
Recreational buildings.
Schools – elementary, junior high and high – nonboarding.
Utility uses including water filtration plants, pumping stations, and reservoirs. (1965 Code title 6 § 401.2)

13-6A-3: BULK REGULATIONS:

   A.   Lot Area:
      1.   Minimum width: Fifty feet (50').
      2.   Minimum total area: Six thousand (6,000) square feet; except, that in that part of the village bounded by 43rd Street on the south, Gage Avenue on the west, Fisherman's Terrace on the east and the line running east from the northwest corner of the lot at 4103 Gage through the northeast corner of the lot at 4102 Fisherman's Terrace on the north, wherein inclusively, the minimum total area shall be five thousand (5,000) square feet.
   B.   Setbacks:
      1.   Front Yard: Twenty five feet (25') minimum. However, where the front yard setback for fifty percent (50%) of the frontage on the same side of a street as the subject property, between two (2) intersecting streets, is less than the minimum, the front yard setback shall be not less than the average front yard setback for the existing buildings.
      2.   Rear Yard: Thirty foot (30') minimum.
      3.   Side Yard: Both side yards shall be five feet (5') or ten percent (10%) of the lot width, whichever is greater.
      4.   Corner Side Yard: Ten feet (10') or twenty percent (20%) of the lot width, whichever is greater.
   C.   Lot Coverage:
      1.   Total Lot Coverage: Maximum fifty percent (50%).
      2.   Rear Yard: Maximum of thirty percent (30%) of the rear yard covered by accessory buildings (carport, garage, storage shed, etc.). In addition, a detached garage or other accessory building shall not be constructed closer than ten feet (10') to the residential structure.
   D.   Building Height: Maximum thirty five feet (35') as measured from the average elevation of the finished grade within twenty feet (20') of the front of the proposed building.
   E.   Accessory Buildings: Residential zoned or properties utilized solely for residential purposes will be restricted to one garage and one shed per zoning lot.
      1.   Garages shall be:
         a.   A maximum of fifteen feet (15') in height.
         b.   A maximum eight foot (8') high door.
         c.   A maximum six hundred seventy six (676) square feet in area.
      2.   Sheds or other accessory storage building shall be limited to one hundred (100) square feet in area and eight feet (8') in height.
      3.   "Height", for purposes of this subsection, shall be measured from the established grade at the base of the structure to the top of the ridge of the structure. The building director shall have final jurisdiction regarding the computation of height under this subsection. (1965 Code title 6 § 401.3; amd. 2009 Code)

13-6B-1: PURPOSE:

The purpose of the R-1A single-family detached residence district is to recognize the existing areas of the village which have been developed with thirty foot (30') wide lots. It specifically is not the intention of the village to expand the existing R-1A districts or to add additional R-1A districts in other portions of the village. (1965 Code title 6 § 402.1)

13-6B-2: PERMITTED USES:

The same as allowed in the R-1 district. (1965 Code title 6 § 402.2)

13-6B-3: SPECIAL USES:

The same as allowed in the R-1 district. (1965 Code title 6 § 402.3)

13-6B-4: BULK REGULATIONS:

   A.   Lot Area:
      1.   Minimum width: Thirty feet (30').
      2.   Minimum total area: Three thousand four hundred eighty (3,480) square feet.
   B.   Setbacks: All minimum setback requirements are the same as those in the R-1 residence district; except, that the side yard setbacks shall be no less than four feet (4') or ten percent (10%) of the lot width, whichever is greater, and corner side yard setbacks shall be seven feet (7') or twenty percent (20%) of the lot width, whichever is greater.
   C.   Lot Coverage:
      1.   Total Lot Coverage: Maximum fifty percent (50%).
      2.   Rear Yard: Maximum of thirty percent (30%) of the rear yard covered by accessory buildings (carport, garage, storage shed, etc.). In addition, a detached garage or other accessory building shall not be constructed closer than ten feet (10') to the residential structure.
   D.   Building Height: Maximum thirty five feet (35') as measured from the average elevation of the finished grade within twenty feet (20') of the front of the proposed building. (1965 Code title 6 § 402.4; amd. 2009 Code)

13-6C-1: PERMITTED USES:

Any use permitted in the R-1 district.
Single-family attached dwellings.
Two-family dwellings – duplexes or two-flats. (1965 Code title 6 § 403.1)

13-6C-2: SPECIAL USES:

All special uses in the R-1 district. (1965 Code title 6 § 403.2)

13-6C-3: BULK REGULATIONS:

   A.   Lot Area:
      1.   Minimum width: Fifty feet (50').
      2.   Minimum total area: Six thousand (6,000) square feet for single-family detached dwellings, duplexes or two-flats; nine thousand (9,000) square feet for three (3) single-family attached dwellings; and ten thousand five hundred (10,500) square feet for four (4) single-family attached dwellings.
   B.   Setbacks:
      1.   Front Yard: Twenty five feet (25') minimum.
      2.   Rear Yard: Thirty feet (30') minimum.
      3.   Side Yard: Both side yards shall be five feet (5') or ten percent (10%) of the lot width, whichever is greater.
      4.   Corner Side Yard: Ten feet (10') or twenty percent (20%) of the lot width, whichever is greater.
   C.   Lot Coverage:
      1.   Total Lot Coverage: Maximum sixty five percent (65%).
      2.   Rear Yard: Maximum of forty percent (40%) of the rear yard covered by accessory buildings (carport, garage, storage shed, etc.). In addition, a detached garage or other accessory building shall not be constructed closer than ten feet (10') to the residential structure.
   D.   Building Height: Maximum twenty seven feet (27') with peaked roof, twenty one feet (21') with flat roof as measured from the average elevation of the finished grade within twenty feet (20') of the front of the proposed building (not including chimney).
   E.   Accessory Buildings: The same as those enumerated for R-1 districts. (1965 Code title 6 § 403.3; amd. 2009 Code)

13-6D-1: PERMITTED USES:

All permitted uses in an R-1 district except single-family detached dwellings.
Multiple dwellings. (1965 Code title 6 § 404.1)

13-6D-2: SPECIAL USES:

All special uses allowed in an R-1 zoning district.
Nursing homes.
Private clubs, fraternities, sororities, and lodges except those where the chief activity is a service customarily carried on as a business. (1965 Code title 6 § 404.2)

13-6D-3: BULK REGULATIONS:

   A.   Lot Area:
      1.   Minimum Width: Fifty feet (50').
      2.   Minimum Total Area: Maximum twelve (12) units per acre of land area (prorated at 3,630 square feet of land area per unit for lots less than one acre in land area).
   B.   Setbacks:
      1.   Front Yard: Thirty feet (30') minimum, plus two feet (2') for every story above the first floor.
      2.   Rear Yard: Thirty five feet (35') minimum, plus two feet (2') for every story above the first floor.
      3.   Interior Side: Ten feet (10') or fifteen percent (15%) of the lot width, whichever is greater, plus two feet (2') for every story above the first floor.
      4.   Corner Side Yard: Fifteen feet (15') or twenty five percent (25%) of the lot width, whichever is greater, plus two feet (2') for every story above the first floor.
   C.   Lot Coverage:
      1.   Total Lot Coverage: Maximum sixty five percent (65%).
      2.   Rear Yard: Maximum of forty percent (40%) of the rear yard covered by accessory buildings (carport, garage, storage shed, etc.). In addition, a detached garage or other accessory building shall not be constructed closer than ten feet (10') to the residential structure.
   D.   Building Height: Maximum thirty five feet (35') as measured from the average elevation of the finished grade within twenty feet (20') of the front of the building.
   E.   Open Land Area: Open land area shall be landscaped as required by the village board of trustees through the site plan review process.
   F.   Dwelling Units:
      1.   Dwelling units shall not be occupied by more occupants than permitted by the minimum area requirements of the following table:

Bedrooms
Minimum 70 square feet for 1 occupant. Minimum 50 square feet per each occupant, 2 or more occupants. The above space cannot be counted toward minimum sleeping area requirements.
 
      2.   Bedrooms shall not constitute the only means of access to the other bedrooms or habitable spaces and shall not serve as the only means of egress from other habitable spaces. Exceptions are units containing fewer than two (2) bedrooms.
      3.   Every bedroom shall have access to at least one water closet and one lavatory without passing through another bedroom. Every bedroom in a dwelling unit shall have access to at least one water closet and lavatory located in the same story as the bedroom or an adjacent way.
      4.   Kitchens and nonhabitable spaces shall not be used for sleeping purposes. (1965 Code title 6 § 404.3; amd. 2009 Code)
