ZONING DISTRICTS ESTABLISHED; ZONING MAP

Sec. 134-161.- Zoning districts enumerated.

For the purpose of clarification, the categories of zoning districts are listed in this section in order, with number 1 being the most restricted and number 63 being the least restricted. (Missing numbers are reserved for future use.)

Sec. 134-162. - Reserved.

Editor's note— An amendment of September 27, 2022, amended the Code by repealing former § 134-162 in its entirety. Former § 134-162 pertained to general description of zoning districts, and derived from ordinances of December 26, 1972; December 11, 1990; August 13, 1991; May 12, 1992; February 22, 1994; October 25, 1994; February 28, 1995; February 27, 1996; Juune 24, 1997; June 23, 1998; March 9, 1999; and April 13, 1999; and amendments of February 24, 2015 and February 8, 2022.

Sec. 134-163. - Zoning map.

Subject to the express provisions in this chapter, all properties shall be zoned as set forth on the official county zoning map of the county, as amended from time to time. The maps shall be kept under the custody of the county community development agency and maintained in the offices of the agency's planning division and zoning division, and shall be subject to public inspection. The official county zoning maps are incorporated in this chapter by express reference.

Sec. 134-164. - Interpretation of chapter and accompanying zoning district maps.

This section provides rules for resolving questions about the meaning or applicability of any part of this chapter. The provisions of this section are intended to ensure the consistent interpretation and application of the provisions of this chapter. The zoning division manager or his/her designee is assigned the responsibility and authority to interpret the requirements of this chapter.

(a)

In interpreting allowable uses of land if a proposed land use is not specifically listed in the regulations of the district in which a property is located, the following rules shall apply:

(1)

The zoning division manager or his/her designee may determine the characteristics of, activities associated with and potential land use impacts of the proposed use are consistent with those of one or more of the uses listed in the zoning district as allowable, and will not involve a higher level of activity or density than the uses listed in the district.

(b)

In interpreting the zoning district maps, the following rules shall apply:

(1)

Where district boundaries are indicated as approximately following the boundary lines of streets, alleys, railroads, public lands or channels or bodies of water, such lines shall be construed to be such boundaries.

(2)

Where such boundaries are indicated so that they approximately follow the lines of lots or other parcels of record and are not more than ten feet distant therefrom, such lot or parcel lines shall be construed to be such boundaries.

(3)

If the rules set out in subsections (a) and (b) of this section do not apply, the location of a district boundary, unless the boundary is indicated by dimensions shown on the map, shall be determined by use of the scale appearing thereon.

Sec. 134-165. - Designated buffers.

When the board of commissioners stipulates any type of buffer larger than fifty (50) feet by its authority via (134-124) said buffer will be shown as such on the official zoning block maps of the county, and as amended from time to time. Said maps are on file in the county planning division and zoning division offices.

Sec. 134-166. - Resolution of conflicts between maps and minutes.

It is recognized that discrepancies or conflicts can occur between the official zoning maps and the official county clerk's records (minutes) of actions taken by the board of commissioners with respect to a specific parcel, either because of scriveners' errors or in amendment of the official maps. In the event of such a discrepancy or conflict, the official county clerk's record shall prevail.

Sec. 134-167. - Density calculations for projects utilizing existing county roadways.

Redevelopment projects that incorporate existing roadways, which during the redevelopment are to be abandoned by the county and/or incorporated into and utilized in the new development, may be used in calculating density. However, existing roadways that are near the proposed redevelopment site and are not to be incorporated into the project will not be used in calculating density.

Sec. 134-168. - Property zoned conservation subdivision (CS) accessory structures.

Property zoned CS does not need to have the board of commissioners approve accessory structures. Accessory structures in CS zoned districts shall follow the same accessory structure requirements as planned residential development (PRD) section 134-201.1(13).
