153.180 Erosion Control

Any land surface in the Village of Mackinaw that may be disturbed as a result of issuance of a building permit shall have erosion and sediment control measures as required by the Village Public Works Manager. The erosion and sediment measures shall be required by the Village Public Works Manager for the purpose of minimizing the erosion of sediment from a construction site. All building permits that are issued by the Village of Mackinaw shall be subject to this section. In the event that a site does not have adequate erosion control, as determined by the Village Public Works Manager, the Zoning Enforcement Officer for the Village of Mackinaw may require all construction at a construction site to cease until adequate erosion control measures are installed. 153.998 Civil Remedies

In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted or maintained, or any building, structure or land is used in violation of this chapter, the proper authorities of the village, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, maintenance or use; to main, correct or abate such violation; to prevent the occupancy of said building, structure or land; or to prevent any illegal act, conduct, business or use in or about such premises.

153.999 Penalty

Whoever violates of this chapter for which another penalty is not specifically provided shall be subject to the general penalty provision, § 10.99 of the Village Code. Each day a violation continues shall be deemed a separate offense. (Am. Ord. 833, passed 9-12-11)
