ARTICLE XXVIII

FLEX USE DISTRICT FLX

Sec. 10.2701.- Intent.

The purpose of this district is to encourage a complementary mixture of alternative uses including residential, commercial, industrial and office uses that are compatible with surrounding zoning districts and permissible uses. The intent is also to create areas of convenient access for daily consumer needs, jobs, and connection to surrounding areas.

Sec. 10.2702. - Uses permitted.

All uses shall be treated as a special land use and require Planning Commission approval. See Section 10.2703 for special land uses permitted.

Sec. 10.2703. - Special land uses permitted.

Building and structures and parts thereof may be erected, altered or used for one (1) or more of the following purposes subject to the approval of the Macomb Township Planning Commission and subject to the special land use permit procedures at Section 10.2402 of this ordinance.

A.

All uses permitted as a matter of right in the C-1, C-2, and C-3 Districts, as indicated in Section 10.1502, 10.1602 and 10.1702 respectively.

B.

All special land uses permitted as indicated in Section 10.1603.

C.

All uses permitted as a matter of right in the O-1 and O-2 Districts, as indicated in Section 10.1302 and 10.1402 respectively.

D.

All uses permitted as a matter of right in the R-2-L and R-2 Districts, as indicated in Section 10.0802 and 10.0902 respectively.

E.

All uses permitted as a matter of right in the M-1 District, as indicated in Section 10.2102.

F.

The following uses may be permitted within this district:

1.

Automobile dealerships.

2.

Drive-in and drive-through restaurants.

3.

Car wash, automatic drive-through.

4.

Health club.

5.

Vet clinic.

G.

Any use of the same general character as any of those indicated in Section 10.1703; provided that no trade or business which is determined by the Planning Commission to be harmful to the health and safety and welfare of the Township shall be permitted.

H.

Nightclub.

I.

Hospital.

J.

Animal boarding kennel.

K.

Open-air business uses, including outdoor space for sale, storage or rental of automobiles, agricultural implements, boats or recreational vehicles.

Sec. 10.2704. - Site plan review and design criteria.

All proposed structures, uses, or land shall be subject to the site plan review provisions of Section 10.2403. Additionally, all sites must adhere to the following:

A.

Any flex zoned parcel being developed that is adjacent to another flex zoned or master planned as flex zone parcel that is still vacant must use setback requirements as if the vacant parcel was residential or meet the maximum setback and buffering area required by any other zone.

B.

Any screening or landscape requirements including a masonry wall may be waived or modified by the planning commission provided the intent of the ordinance is met and if sufficient landscaping and buffering is provided.

C.

Pedestrian connectivity is highly desired. In addition to any required sidewalks the Planning Commission may require connections to existing or planned trails, pathways, multi-use pathways, or any other non-vehicular infrastructure.

Sec. 10.2705. - Site limitations.

A use shall follow the site limitations applied to such use in the respective zoning district that the use is permitted. In the event of a conflict between limitations, the most stringent requirement shall apply. No use shall be greater than four (4) stories in height.
