The city shall maintain the public library established in the city as a free public library and for such purposes the city council shall include in the annual budget such sum of money as may be deemed necessary for maintaining said library. The city council, whenever it shall be determined necessary and expedient to purchase or acquire ground and building for library purposes may raise such moneys as deemed necessary for said purpose.

The public library shall be administered by the city manager and he shall control and govern the library, its reading rooms, branches and stations now established, or to be established, and for that purpose may make such rules or regulations as may be necessary and expedient and not inconsistent with the Charter of the city and the general laws of the state, together with a schedule of fines and penalties for the violation thereof, for the operation of said library. The city manager subject to the pertinent Charter provisions, is authorized to employ a librarian, library assistants and such other employees as may be required within the budget appropriation and to fix their compensation. He shall arrange for adequate insurance of the library books, furniture, fixtures and equipment with such insurers as are approved by the city council.

The librarian shall have the power to impose and collect fines for the infringement of the rules and regulations promulgated by the city manager pursuant to section 15-2, and to collect the established charges for the use of the library facilities and services by nonresidents of the city.

The library shall be maintained for the use and benefit of the inhabitants and freeholders of the city who shall have free use of said library subject only to the library's rules and regulations, and subject to the right of the librarian to exclude from the use of the library any and all persons who shall willfully violate said rules. Nonresidents may be granted permission to use the library under such conditions and upon payment of the fees prescribed by the city manager.

Whoever willfully or negligently detains or fails to return to the public library any book, magazine, pamphlet, map, manuscript, picture, microfilm, phonograph record, clipping or other property belonging to such library, or pay the reasonable value thereof, within 20 days from the date of the posting by certified mail of a notice addressed to such person at the last address furnished the public library, and which notice may be given at any time after the date on which such person, under the rules of the library, should have returned the loaned property, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not more than $200.00, or upon failure to pay such fine may be imprisoned not more than 30 days.

Whoever shall give a fictitious or incorrect name or address at the public library in order to obtain possession or use of any book, magazine, pamphlet, map, manuscript, picture, microfilm, phonograph record or clipping, the property of such library, or shall practice any deceit of any kind whatsoever to conceal or mislead in respect to identity or address or place of employment of such person shall be deemed guilty of a misdemeanor and upon conviction shall be fined not more than $50.00, or upon failure to pay such fine be imprisoned not more than 15 days.

It shall be unlawful for any person to tear, deface or mutilate or write upon or by other means injure or mar any books, pamphlets, maps, charts, paintings, pictures, photographs, periodicals, newspapers, magazines, manuscripts or exhibits or any part thereof belonging to or loaned to the public library.

The parents, guardian or custodian of any minor who shall tear, deface, mutilate or write upon or by any other means injure or mar any book, pamphlet, map, chart, painting, picture, photograph, periodical, newspaper, magazine, manuscript or exhibit, or any part thereof, belonging to or loaned to the public library shall be deemed to be guilty of a violation of this chapter.
