ARTICLE I

Title

§ 450-1 Preamble.

Pursuant to the authority conferred by Article 16 of the Town Law of the State of New York and in order to encourage the most appropriate use of land; and protect and conserve the value of property; and promote the health, safety, morals and general welfare of the community, this chapter has been established to regulate the location, use, and occupancy of buildings and the use of land for trade, industry, residence, and other uses; to regulate and limit the height and bulk of buildings and other structures; to regulate and determine the area of yards and other open spaces; to regulate the density of population; and for said purposes, to divide the Town into districts; to provide for its enforcement and administration; and to prescribe penalties for the violation of its provisions; the Town Board of the Town of Maine does hereby repeal any and all existing ordinances and amendments thereto, heretofore enacted by the Town Board of Maine which pertain specifically to zoning and does hereby enact the following comprehensive amendment to the Zoning Ordinance of 1962.

§ 450-2 Short title.

This chapter may be known and may be cited as the "Town of Maine Zoning Ordinance."

§ 450-3 Amendment procedures.

The Town Board may from time to time amend, supplement, change, modify or repeal the regulations and provisions of this chapter following a public hearing and in accordance with law.
In accordance with the General Municipal Law of the State of New York §§ 239-1 and 239-m, all proposed zoning regulations, or any amendment thereof, which would change the district classification of or the regulations applying to real property lying within areas defined by the aforementioned sections, and any proposed special permits or variance affecting land or buildings within the defined areas, shall be referred to the county or regional planning agency of Broome County for review and comment prior to the final action by the appropriate Town body.

§ 450-4 Conflict with other provisions.

In interpreting and applying the provisions of this chapter, the regulations shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, comfort, prosperity and general welfare. It is not intended by this chapter to interfere with or abrogate or annul any easements, covenants, or other agreements between parties; provided, however, that where this chapter imposes a greater restriction upon the use of buildings or premises this chapter shall control.
