Provisions Applicable Across Districts

§ 450-10 Application of regulations; calculating minimum front yard depths.

No building or structure shall hereafter be constructed, used or occupied, and no part of any building or structure shall hereafter be moved or altered, and no lot shall hereafter be used or occupied except in conformity with the schedule of regulations herein set forth for the district in which the same is located. Unless the construction, use, occupancy, moving or alteration of a building or structure, or the use or occupancy of a lot, is specifically permitted under the provisions of this chapter, such use, occupancy, moving or alteration is prohibited by this chapter.
Any parcel of land with an area or a width less than that prescribed for a lot in the district in which such lot is situated, which at the time of the adoption of this chapter was under one ownership, may be used as a lot for any use or purpose permitted in the district in which such lot is situated without the necessity of an area variance from the Zoning Board of Appeals, provided that the owner of such lot owns no adjoining land and provided further that all other regulations prescribed by this chapter for the district in which such lot is situated are complied with.
Notwithstanding the provisions of any other section, paragraph, subdivision or subparagraph of this chapter, the following provisions shall be applied and used in calculating and measuring the required minimum front yard depths: in all cases, the required minimum front yard depths shall be measured from the center of the road, street, or highway on which the lot fronts; and the number of feet currently set forth (for each zoning district) on the minimum lots requirements chart and in subsections relating to collector and arterial roads shall be increased by 25 feet for the purpose of determining the required minimum front yard depths.

§ 450-11 Street classifications.

For the purpose of these zoning regulations, the highways, streets, and roads of the Town of Maine have been designated as either arterial, collector, or local roads. Such designation is indicated on the Town of Maine, New York, Zoning Map, and hereby made part of such map.
The following roads are hereby designated as arterial roads for zoning purposes only:
Arterial roads:
Airport Road. CR #69.
Arbutus Road. CR #116.
Commercial Drive. CR #112.
East Maine Road (from Town of Maine line to Route 26). CR #45.
Farm to Market Road (from Town of Maine line to E. Maine Road). CR #49.
Nanticoke Road. CR #21.
Route 26.
Route 38B.
These roads primarily serve to bring people and goods rapidly to all parts of Maine and to provide access to through traffic.
The following roads are hereby designated as major collector roads for zoning purposes only:
Major collector roads:
Ames Road.
Bradley Creek Road (from Town of Maine line to Harrington Road).
Edson Road/Edison Road (from Fredericks Road to Pollard Hill Road).
Fredericks Road.
Harrington Road.
Knapp Road.
Lewis Street.
Oakdale Road.
Oak Tree Lane.
Pollard Hill Road.
Tiona Road.
Town Line Road (Town of Union).
Twining Road.
These roads are expected to carry fairly high volumes of traffic but not as much as the arterials. The primary purpose of the major collector is to provide rapid access to all parts of Maine in conjunction with the arterials. They will provide connection from minor collectors to local roads to the arterials. Access to the major collector will be available for adjoining land uses.
The following roads are hereby designated as minor collector roads for zoning purposes only:
Minor collector roads:
Ashley Road.
Avery Road (to Avery Road Extension).
Avery Road Extension.
Bailey Hollow Road.
Bradley Creek Road (from Harrington Road to Fredericks Road).
Cornell Hollow Road.
Corson Road.
Daugherty Road.
Death Valley Road (from Fredericks Road to Wyok Road).
Flint Road.
Hartwell Road.
Haskins Road.
Hayes Road.
Higby Road.
Kay Road.
King Hill Road/Church Street.
Old Newark Valley Road.
Pitkin Hill Road.
Wyok Road.
Zevan Road.
Minor collector roads generally provide access from local roads or streets and abutting land uses to higher level roads or streets.

§ 450-12 Siting of wireless telecommunications facilities.

Wireless telecommunications facilities may be sited in any zoning district according to the regulations and siting priorities defined in Article XIV, Wireless Telecommunications Facilities, of this chapter.

§ 450-13 Public utilities in residential districts.

Major installations of public utilities shall be reviewed by the Planning Board where proposed in any residential district. The Planning Board shall have the power to require any reasonable change in the site plan in order to protect the residential nature of adjoining properties. Underground utilities including telephone and electric facilities are encouraged. Developers may be asked to provide justification if underground utilities are not provided in the site plan. As used herein the term "major installations" of public utilities shall not be deemed to include installation of standard electric or telephone poles, distribution lines, underground cables, or electrical connections.

§ 450-14 One dwelling or building per lot.

Under no circumstances shall a building permit be issued for more than one dwelling, mobile home or principal building on a single lot. Under no circumstances shall more than one dwelling, mobile home or principal building be erected, constructed, occupied, used, enlarged, altered, moved or relocated on a single lot, or excavation begun therefor.

§ 450-15 Parking and storage of mobile homes and travel trailers.

No mobile home or travel trailer shall be parked on any street, road, highway, park or any other public place within the Town of Maine for any length of time in excess of 72 hours.
No mobile home shall be parked or stored on any single lot within the Town of Maine unless a building permit has been issued therefor or unless said mobile home is parked or stored on a lot owned by a mobile home dealer located in the B-1 Business District or B-2 Business District.
