CHAPTER 1280

GC General Commercial District

1280.01 PURPOSE

   It is the purpose of the "GC" District to provide appropriate and convenient locations for shopping and convenience goods and services for the entire community which tend to generate large volumes of vehicular traffic.

1280.02 PRINCIPALLY PERMITTED USES

   Principally permitted uses shall be as follows:
   A.   Automated Teller Machines (ATM's).
   B.   Commercial Planned Developments.
   C.   Commercial Recreation.
   D.   Financial Institution.
   E.   Medical Clinic.
   F.   Office, Business or Professional.
   G.   Mixed Use Planned Developments.
   H.   Public Park or Recreation Area.
   I.   Public Recreation Facility (indoor or outdoor).
   J.   Public, Non-Profit or Private Cultural Facilities.
   K.   Recording, Radio or Television Studios.
   L.   Restaurant.
   M.   Restaurant, Fast Food
   N.   Retail Business.

1280.03 ACCESSORY PERMITTED USES

   Accessory permitted uses shall be as follows:
   A.   Child Day Care Center.
   B.   Attached or Detached Garage and Storage Structures.
   C.   Drive-in or Drive Through.
   D.   Fences and Walls.
   E.   Heliports.
   F.   Parking Structure.
   G.   Private Swimming Pools, Tennis Courts and Basketball Courts.
   H.   Satellite Dishes.
   I.   Signs.
   J.   Uses, buildings or structures customarily incidental to a principal permitted use or conditionally permitted use located on the same lot therewith.

1280.04 CONDITIONALLY PERMITTED USES

   Conditionally permitted uses are as follows:
   A.   Assisted Living Facilities.
   B.   New Automobile Dealer.
   C.   Automobile Repair and Service.
   D.   Automobile Service Stations.
   E.   Bar or Tavern.
   F.   Car Wash.
   G.   Check Cashing Business.
   H.   Clubs.
   I.   Commercial Entertainment (indoors).
   J.   Corporate or Business Training Facility.
   K.   Convenience Store.
   L.   Convention or Conference Center.
   M.   Day Care Center, Adult or Child.
   N.   Educational Institution.
   O.   Funeral Home.
   P.   Government Facilities, Offices and Services.
   Q.   Hotel/Motel.
   R.   Personal Services.
   S.   Private Recreational Club.
   T.   Public Recreational Facilities.
   U.   Public Utilities.
   V.   Religious Places of Worship.
   W.   Senior Independent Living Facility.
   X.   Used Car Sales.
   Y.   Veterinary Facility/Small Animal Clinic.

1280.05 MINIMUM LOT AREA AND WIDTH

   There shall be no minimum lot area or width for properties in this district provided, however, that all other requirements of this district are met.

1280.06 YARD SETBACKS

   The yard setback requirements for properties in this district shall be as follows:
   A.   The minimum front yard setback for uses in this district shall be 15 feet.
   B.   The minimum side yard setback for uses in this district shall be one-half (1/2) the building height each side or a minimum of 10 feet each side if adjoining a residential district.
   C.   The minimum rear yard setback for uses in this district shall be the height of the building or a minimum of 25 feet if adjoining a residential district.

1280.07 HEIGHT REQUIREMENTS

   The maximum height requirements for buildings within this district are as follows:
   A.   Principally permitted uses shall not exceed a height of 40 feet.
   B.   Accessory permitted uses shall not exceed a height of 10 feet.

1280.08 LAND USE INTENSITY

   The maximum lot coverage for properties in this district shall be as follows:
   A.   The main building and related accessory structures of all other uses shall not cover more than 50% of the lot.
   B.   In no case shall the impervious surface cover more than 70% of the lot.

1280.09 OFF-STREET PARKING AND LOADING

   Off-street parking and loading shall be required as specified in Chapter 1290, Off-Street Parking and Loading.

1280.10 CHECK CASHING BUSINESSES CONDITIONAL USE LOCATIONS BY POPULATION DENSITY.

   Check cashing businesses are not permitted within one thousand (1,000) feet of another check cashing business or Financial Institution as described in Section 1261.43 and the number of said businesses shall not exceed one (1) per five thousand (5,000) residents of the population of the City of Maple Heights as governed by the most recent census.
