ESTABLISHMENT OF

DISTRICTS

§ 154.035 PURPOSE.

   The purpose of this subchapter is to create districts of such numbers and character necessary to achieve compatibility of uses within the Village of Marblehead and to provide opportunities for community growth.

§ 154.036 DISTRICTS.

   The village is hereby divided into the following districts:
 
Residential - 1 District
Residential - 2 District
Residential - Johnson's Island District
Business District
Manufacturing District
Institutional District

§ 154.037 ZONING MAP.

   The boundaries of the districts are hereby established as shown on a map entitled Marblehead Zoning Map: 1998, which map together with all notations, amendments, references and other information shown thereon is hereby made part of this Zoning Chapter.

§ 154.038 INTERPRETATION OF DISTRICT BOUNDARIES.

   Where uncertainty exists with respect to the boundaries of any of the districts shown on the zoning map, the following rules shall apply:
   (A)   Where district boundaries are indicated as approximately following the center line of streets or highways, street lines or highway lines such centerlines, street lines or highway right-of-way lines shall be considered to be such boundaries;
   (B)   Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be the boundaries;
   (C)   (1)   Where district boundaries are so indicated that they are approximately parallel to the centerline or street lines of streets, or the center lines of right-of-way lines of highways, such district boundaries shall be construed as being parallel thereto and of such distance therefrom as indicated on the zoning map.
      (2)   If no distance is given, such dimensions shall be determined by the use of the scale shown on the zoning map;
   (D)   Where the boundary of a district follows a railroad line, such boundary shall be deemed to be located midway between the main tracks of the railroad line;
   (E)   Where the boundary of a district follows a stream, lake or other body of water, the boundary line of the body of water shall be deemed to be the boundary of the zoning district unless otherwise indicated; and
   (F)   In unsubdivided property, the district boundary lines on the map accompanying and made a part of this Zoning Chapter shall be determined by dimension notes on the map, or by the use of the scale appearing on the map.

§ 154.039 PROHIBITION AGAINST SHORT TERM RENTAL.

   Except in the Business District or as a conditionally permitted Bed and Breakfast as defined in § 154.051, no dwelling unit, structure or other lodging unit shall be rented, leased, or otherwise let to any individual, corporation or other entity for compensation as and for lodging, sleeping or other overnight accommodation for less than 30 consecutive days in any zoning classification. Refer to Chapter 37 of the Village of Marblehead Code of Ordinances for regulations governing short-term transient rental.
