ARTICLE VII

BOARD OF APPEALS

Sec. 98-411.- Creation; membership.

There is hereby created a zoning board of appeals to serve as a board of appeals on zoning matters. Said board shall be the zoning committee referred to in article VI of this chapter.

Sec. 98-412. - Term of members.

The members of the zoning board of appeals shall serve for the term as provided for the zoning committee in article VI of this chapter.

Sec. 98-413. - Powers and duties.

(a)

It shall be the duty of the zoning board of appeals to hear and decide, as is provided by statute, any appeal of any decision, order or interpretation by the officer whose duty it is to enforce zoning regulations, and such other powers and duties as may be delegated to it by statute or ordinance.

(b)

The zoning board of appeals, unless other provision is made in this chapter, shall hear at public hearing after notice, as is provided in article 11, division 13, of the Illinois Municipal Code (65 ILCS 5/11-13-1 et seq.), any petition for a variation of a zoning regulation and shall make its findings and conclusions thereon, and shall report to the mayor and board of trustees, in which body power to grant variations shall reside. It shall also have the power to recommend to the mayor and board of trustees changes in any ordinance or regulation affecting zoning, and shall also have power to publish rules of public procedure before the said zoning board of appeals.
