CHAPTER 12

OFF STREET PARKING AND LOADING

11-12-1: APPLICABILITY TO PARKING AND LOADING:

   A.   Purpose: The purpose of the requirements in this chapter is to further the appropriate provision and design of off street parking and loading areas that will:
      1.   Provide access to land uses generating large traffic volumes in a community dependent on automobile and truck transportation.
      2.   Foster safe and efficient circulation of vehicles and pedestrians both on private property and on adjacent public streets.
      3.   Minimize nuisance in residential areas from on street parking of large numbers of vehicles.
   B.   Applicability: The requirements in this chapter apply to any provision, removal, enlargement or alteration of any off street parking or loading spaces or areas accessory to any building or structure existing as of the effective date of this title, or any new spaces or areas required to be provided under this title or voluntarily provided in excess of the requirements herein. These provisions shall likewise apply to parking that is the principal use of a parcel.
   C.   Number And Size Of Required Facilities:
      1.   Numbers and sizes of off street parking and loading spaces shall be provided for all new uses and existing uses that are enlarged, expanded or changed, in conformance with the standards of section 11-12-4, “Tables”, of this chapter.
      2.   No additional spaces shall be required for expansion or change of an existing use if the standards herein would require an increase over the spaces already provided on the site of less than fifteen percent (15%).
   D.   Exception For C-4 Downtown Commercial District: In recognition of the existing character and pedestrian orientation of the City’s older downtown business areas, no off street parking or loading shall be required for individual uses located entirely within the C-4 Downtown Commercial District. This exception is made to minimize curb cuts disruptive to safe and efficient pedestrian circulation and to encourage provision of off street parking in centralized locations that serve multiple uses.
   E.   Preservation And Replacement Of Existing Spaces: No off street parking or loading spaces either provided in conformity with the provisions of this chapter or a previous ordinance or voluntarily provided in excess of what such provisions require, shall be reduced in size or number below the requirements herein, or further below such requirements, so long as the use they serve continues in operation.
   F.   Submission Of Site Plan: A site plan showing off street parking and loading facilities shall accompany an application for any of the following for any use required to provide over four (4) off street parking spaces or one or more off street loading spaces:
      1.   Building permit or Certificate of Occupancy.
      2.   Conditional use permit.
      3.   Rezoning.
      4.   Preliminary or final plat approval as provided in the Subdivision Control Ordinance.
      5.   Variance from off street parking or loading requirements.
      6.   Integrated Design District preliminary or final plan.

The City Council may waive or defer this requirement in any instance in which the specific use of the premises, and therefor the specific parking and loading requirements applicable, are not yet determined, such as in the case of a rezoning for an industrial subdivision. The site plan shall meet the requirements of section 11-4-7, table 2 of this title, in the filing procedures section herein.
   G.   Storage And Repair: No storage of any kind, nor motor vehicle repair work, except for emergency services, is permitted in any open off street parking or loading area, except those provided for single-family detached or attached dwellings.
   H.   Access: Each required off street parking space and loading space shall open directly upon an aisle or driveway of such width and design as to provide a safe and efficient means of vehicular access, and shall have vehicular access to a public thoroughfare in a manner that will least interfere with traffic movement thereupon. Dimensions of aisles and driveways shall be as provided in section 11-12-4, table 1 of this chapter.
   I.   Grading: All parking and loading areas shall be graded for proper drainage, and the volume of stormwater runoff that exceeds that existing prior to the installation of such areas shall discharge into an approved drainage system.
   J.   Maintenance: All parking and loading areas shall be maintained free of dust, trash and debris. The surfacing, curbing, lighting fixtures, signage and related appurtenances shall be maintained in good condition so long as such areas are used for parking or loading purposes.
   K.   Landscaping And Screening: All parking and loading areas shall be landscaped and screened as provided in chapter 13, “Landscaping And Screening”, of this chapter.
   L.   Parking Reductions: The Zoning Administrator is authorized to approve up to a ten percent (10%) reduction in the required number of off-street parking spaces.
   M.   Rounding of Integers: Fractional spaces shall be rounded to the nearest integer.

11-12-2: OFF STREET PARKING REQUIREMENTS:

   A.   Use Of Parking Spaces: Except as otherwise provided herein, required off street parking shall be used solely for parking for patrons, occupants, guests, visitors or employees of the premises on the same lot.
   B.   Collective Provision: Required parking spaces for different uses may be provided collectively. Except as provided herein for shopping centers, the total number of spaces so provided shall not be less than the sum of the spaces required for each separate use. No space shall serve as the required space for more than one use.
   C.   Parking For Shopping Centers: The number of parking spaces required for retail and personal service uses located in a shopping center shall be as provided for shopping centers in section 11-12-4, table 4 of this chapter, rather than the sum of the spaces required for the individual uses. Except that the number of spaces for restaurants, taverns and drive-in facilities located in a shopping center, and for any establishment occupying over fifty percent (50%) of the gross leasable area of the center, shall be as provided in section 11-12-4, table 4 of this chapter, for these individual uses and shall be added to the number of spaces required under the provisions for shopping centers for the balance of the uses in the center.
   D.   Surfacing Of Parking Areas: All open off street parking areas and related vehicular access drives and aisles shall be surfaced with a blacktop, sealcoat, brick or concrete all weather pavement. Any expansion or extension of such areas shall be surfaced with the same materials as the original installation, except that no expansion of an existing gravel parking area shall be permitted. Other than as provided for in this title, parking, displaying, maintaining and/or storing vehicles on grass is prohibited.
   E.   Wheel Guards: Where more than four (4) parking spaces abut on a sidewalk, wheel guards, bumper guards or curbs shall be installed with respect to such spaces so as to prevent parked vehicles from extending beyond the parking surface.
   F.   Fuel Sales In Parking Areas: Fuel or motor oil may be sold in an off street parking area only to users thereof and only within a completely enclosed building with no advertising sign visible from the outside, and with all fuel pumps screened from the view of the street. No fuel or oil shall be sold in a parking area in a Residential District.
   G.   Location Of Parking Spaces:
      1.   On Same Lot: Required off street parking for single-family detached and attached dwellings shall be provided on the same lot as the use served. Required parking for other uses may also be provided on a separate lot that is in the same possession, by deed or lease, so long as the nearest point of the parking area thereupon is within three hundred feet (300') walking distance of the nearest entrance to the use served.
      2.   In Yards:
         a.   Required off street parking for single-family detached and attached, and townhouse dwellings, may be located in front, side and rear yards.
         b.   It may be located forward of the actual building line opposite a front or corner side lot line the front of the dwelling faces, only if the parking is located entirely on a driveway.
         c.   Required off street parking for other uses may be located in required front, side and rear yards in all districts, subject to the requirements for parking screening strips in chapter 13, “Landscaping And Screening”, of this title.
         d.   No off street parking for any nonsingle-family residential use is permitted within any required yard abutting property in an RS District. No parking for any nonresidential use is permitted within any required yard abutting property in any Residential District.
   H.   Parking Of Recreational Vehicles And Trailers:
      1.   Residential Districts:
         a.   Only one recreational vehicle or trailer shall be permitted in the required front yard or required corner side yard, as defined in section 11-3-1 of this title.
         b.   Trailers and recreational vehicles must be properly licensed.
         c.   Additional recreational vehicles and trailers shall be maintained, kept, stored and/or parked on an approved solid parking surface no less than the minimum dimensions of the vehicle or trailer being parked thereon, but in no case shall the parking surface be less than nine feet by eighteen feet (9' x 18').
         d.   Said parking surface shall be constructed of paved, permanent, dust-free, homogenous material or brick pavers provided the parking surface does not allow grass or other vegetation to grow within, on or above the solid parking surface unless approved by the Zoning Administrator.
         e.   Said parking surface shall be required to connect to the right-of-way.
      2.   Other Districts: There shall be no restrictions on parking of recreational vehicles in Nonresidential Districts, other than those concerning outdoor storage.
   I.   Parking Of Commercial Vehicles:
      1.   Residential Districts:
         a.   No commercial vehicle, as defined in section 11-3-1 of this title, exceeding nine feet (9') in height and twenty five feet (25') in length may be parked and/or stored in a Residential Zoning District. Exterior ladders and any appurtenances on top of the vehicle shall be excluded from the height calculation. The following commercial vehicles are expressly prohibited from being parked and/or stored in a Residential Zoning District: stake bed trucks, box trucks, dump trucks, boom trucks, earth moving equipment, tow trucks, step vans, semitractor cabs with or without a trailer, and any vehicle in excess of ten thousand (10,000) pounds.
         b.   No more than one commercial vehicle, as defined in section 11-3-1 of this title, that does not exceed nine feet (9') in height and twenty five feet (25') in length may be parked and/or stored on a premises in a Residential Zoning District in accordance with the regulations for parking and/or storing of vehicles in a Residential Zoning District contained in this title.
      2.   Nonresidential Districts: No commercial vehicle, as defined in section 11-3-1 of this title, may be parked or stored in a Commercial or Office District, other than in a completely enclosed garage unless it is used in a business located on the same premises or is being parked temporarily by a customer, supplier, contractor or visitor, or for loading, unloading, moving, or construction, maintenance or repair of the premises.
   J.   Driveways: Refer to title 12, chapter 9, “Driveways And Parking Lots”, of this Code.
   K.   Bicycle Parking: All uses providing over twenty five (25) spaces shall provide space and facilities for bicycle parking. This provision is not applicable to properties zoned Business Park or Industrial District classifications.

11-12-3: OFF STREET LOADING REQUIREMENTS:

   A.   Location Of Loading Spaces: All required loading spaces shall be located:
      1.   On the same lot as the use to be served, except when collectively provided as central loading facilities in conformance with the requirements herein.
      2.   Twenty five feet (25') or more from the right-of-way lines of the nearest point of intersection of any streets.
      3.   Outside of required front and side yards.
      4.   In such a manner that no portion of a vehicle shall project into a street.
   B.   Surfacing Of Loading Areas: All open off street loading spaces and related vehicular access drives and aisles shall be surfaced with a hard surfaced, all weather pavement capable of bearing a live load of two hundred (200) pounds per square foot.
   C.   Collective Provision: Loading spaces required for individual lots may be collectively provided in central facilities; provided, that all of the following requirements are met:
      1.   The number of spaces provided is not less than that required by the total floor space for each category of use served.
      2.   Each lot served has direct access to the central facilities without crossing streets at grade.
      3.   The central facilities are not more than five hundred feet (500') from any lot they serve.
      4.   Any tunnel or ramp between the central facilities and any lot served is at least seven feet (7') wide and has a vertical clearance of at least seven feet (7').
      5.   Written covenants and easements approved by the City and recorded with the County provide for the retention, maintenance and use of such facilities.

   D.   Loading Within Health Care District:
      1.   Sufficient space for loading and unloading shall be provided on each building site to accommodate trucks that serve or are likely to serve that building.
      2.   Improvements shall be designed and located on each building site so that vehicles may not be loaded or unloaded on or from any street.
      3.   For buildings that are larger than thirty thousand (30,000) square feet in area, loading docks may be exterior, but shall not face a public street and shall be screened from view from the public street. If a loading dock faces a Residential District it must be interior and enclosed.
      4.   For buildings that are less than thirty thousand (30,000) square feet in area, exterior loading docks may face a public street, but shall be set back a minimum of seventy feet (70') from the public right-of-way. Loading docks that open only to a yard which is adjacent to a Residential District must be interior and enclosed. Exterior loading docks shall be designed so that they do not restrict pedestrian entrances.
