ARTICLE I

General Provisions

§ 675-1 Short title.

This chapter shall be known and cited as the "Borough of McKees Rocks Zoning Ordinance."

§ 675-2 Applicability.

No building, structure or land shall be used or occupied and no building or structure or part thereof shall be erected, constructed, reconstructed, moved, enlarged or structurally altered unless in conformity with the regulations of this chapter. However, this chapter shall not require any change to any building, structure or use legally existing at the effective date of this chapter; or to any building, structure or use planned and construction started in compliance with existing laws prior to the effective date of this chapter, and completed within one-year period after the effective date of this chapter, except as provided in § 675-17.

§ 675-3 Community development objectives.

This chapter is hereby adopted in accordance with a Comprehensive Plan which is designed to promote public health, safety, morality and the general welfare, encourage the most appropriate use of land, conserve and stabilize the value of property, provide adequate open spaces for light and air, and to prevent the spread of fire, prevent undue concentrations of population, and lessen congestion on streets and highways.

§ 675-4 Interpretation and validity.

A. 
Interpretation. In the interpretation and the application of the provisions of this chapter, they shall be held to be minimum requirements for the promotion of the health, safety, morals and general welfare. It is not intended to interfere with or abrogate or annul other rules, regulations or ordinances, provided that where this chapter imposes greater restrictions upon the use of buildings or premises, or upon the height or bulk of a building, or requires larger open spaces, the provisions of this chapter shall prevail.
B. 
Validity. If any section, subsection, sentence, clause or phrase of this chapter is for any reason held by a court of competent jurisdiction to be invalid, such a decision shall not affect the validity of the remaining portions of this chapter. The Borough Council hereby declares that it would have passed this chapter and each section or part thereof irrespective of the fact that any one or more sections or parts thereof be declared invalid.
C. 
Repealer. The Borough of McKees Rocks Zoning Ordinance No. 1107, dated October 12, 1954, and all amendments thereto are hereby repealed. All other existing ordinances or parts of ordinances in conflict with this chapter to the extent of such conflict and no further are hereby repealed.

§ 675-5 When effective.

This chapter shall take effect immediately subsequent to the adoption hereof.
