68 - CANNABIS CRAFT GROWER ORGANIZATION

As used in this Chapter 17.68, the following terms shall have the following meanings:
"Act" means the Cannabis Regulation and Tax Act (410 ILCS 705/1-1 et seq.).
"Craft grower organization" means a facility operated by an organization or business that is licensed by the Illinois department of agriculture to cultivate, dry, cure and package cannabis and perform other necessary activities to make cannabis available for sale at a dispensing organization or use at a processing organization, per the Cannabis Regulation and Tax Act, (P.A. 101-0027), as it may be amended from time-to-time, and regulations promulgated thereunder.
"Department" means the Illinois department of agriculture.
"Secretary" means the secretary of the Illinois department of agriculture.
All other terms used in this chapter shall have the meaning proscribed by the Act.

Subject to the requirements of this chapter, a craft grower organization shall be a special use only in districts located:
A.
In a "G" industrial district west of the Indiana Harbor Belt Railroad tracks and north of North Avenue; and
B.
In the "F" light manufacturing district located at the 900 block of Main Street.
Craft grower organizations shall not be a special use in any other districts.

An applicant seeking approval of a special use for a craft grower organization shall submit an application to the planning and zoning board of appeals. An applicant must meet the following requirements:
A.
Payment of a nonrefundable application fee of six hundred dollars ($600.00) for each special use for which the applicant is applying.
B.
Certification that the applicant will comply with the requirements contained in the Act and any additional requirements set forth by the department.
C.
Provide copies of all information submitted to the department and the state of Illinois in an application for a license to operate the Act.
D.
The submission of a detailed description of air treatment systems that will be installed to reduce odors at the craft grower organization facility.
E.
The submission of a site plan.
F.
The submission of a proposed host agreement detailing the ways in which the craft grower organization will make contributions to the village and the community.
G.
A statement that the craft grower organization agrees to respond to the planning and zoning board of appeals and the village board's supplemental requests for information.
H.
Such other requirements as the village may deem necessary.

No craft grower organization shall be located:
A.
Within one thousand (1,000) feet of the property boundary of any school, playground, recreation center or facility, childcare center, public park, or public library.
B.
Within one thousand five hundred (1,500) feet of the property boundary of any other craft grower organization.

Display of window or exterior signage is prohibited at any craft grower organization facility. This does not apply to any signage that may be required by state or local law, or the building address.

The site design shall incorporate adequate security measures, such as interior and exterior lighting, surveillance cameras, and/or fencing. Said security measures shall be determined based on the specific characteristics of the craft grower and of the floor plan for a craft grower organization facility and the site on which it is located, consistent with the requirements of the Act and the department.

Parking requirements shall be determined by the planning and zoning board of appeals based on anticipated parking demand and available private parking supply.
