CHAPTER 1264

Yacht Club District

1264.01 PURPOSE.

   The Yacht Club District and the regulations set forth in this chapter are hereby established in order to achieve, among others, the following purposes:
   (a)   To provide in appropriate and convenient locations, zoning districts of sufficient size, but not less than ten acres, for yacht club activity, setting forth the minimum requirements for such a development;
   (b)   To provide and serve the needs of the community for this type of recreation purpose;
   (c)   To establish criteria for a planned yacht club area so it may be coordinated with surrounding developments which will constitute a benefit to such surrounding and existing property;
   (d)   To protect adjacent residential neighborhoods by excluding commercial-type uses or objectionable nuisances; and
   (e)   To promote the desirable land use and traffic patterns in accordance with the objectives of comprehensive planning.

1264.02 YACHT CLUB DEFINED.

   "Yacht Club" means an organization organized and maintained by its members for the purposes of using and enjoying private pleasure watercraft on a nonprofit basis, subject to all present and future Federal, State and local laws, ordinances and regulations pertaining to the use of private pleasure watercraft and persons belonging to such organizations or associations.

1264.03 GENERAL LIMITATIONS ON LAND USE.

   In order to carry out the purposes of this chapter the Yacht Club District and the following provisions for its regulation are hereby established.
   (a)   Buildings, land and improvements located within this District shall be used only in furtherance of the uses specifically permitted in the District.
   (b)   The uses specifically permitted are the only uses permitted therein by right. Accessory buildings or uses shall be permitted therein by right as a subordinate building or use, provided that such building or use is planned and developed integrally therewith and clearly incident thereto and located completely within the area zoned.
   (c)   There shall be not less than five acres of water area suitable for navigation and not less than ten acres of land within the District to be qualified to apply for yacht club zoning.

1264.04 BUILDINGS.

   (a)   A comprehensive plan shall be developed and approved by the Planning and Zoning Commission before any permits are issued.
   (b)   There shall be no buildings or structures less than forty feet from residentially zoned property (except for a guard structure at the club entrance).
   (c)   No building shall exceed thirty-five feet in height.
   (d)   Front setbacks from public streets shall be not less than forty feet.
   (e)   All club house buildings shall have a minimum first floor area of 5, 000 square feet.
   (f)   All rules in the NFPA Bulletin "Marinas and Boat Yards No.303, " as amended from time to time, are hereby incorporated. All buildings shall have sprinkler systems.
   (g)   No living quarters other than a caretaker's suite and/or a manager's suite shall be permitted.

1264.05 DRIVES AND PARKING AREAS.

   (a)   There shall be provided open, assigned parking spaces on the project's site, in the number of one and one-half spaces for each boat berth. No parking space shall be less than 180 square feet in area (drives, turning spaces and curves excluded). The minimum width shall be nine feet. Traffic-moving areas between parallel parking spaces shall be not less than eighteen feet wide. Parking shall be confined to designated off-street parking areas, except by special permission of the Safety Director.
   (b)   All drives shall be constructed with seven inches of concrete, twenty-four feet wide, with a turning radius approved by the Fire Chief.
   (c)   Parking areas off street shall be four-inch No.301 and one-inch No.404 asphalt.
   (d)   Traffic flow shall be approved by the City Engineer, Chief of Police and Fire Chief.

1264.06 APPURTENANT STRUCTURES.

   (a)   Swimming pools shall be subject to the requirements of the State Department of Health and the County Board of Health, and City legislation.
   (b)   All swimming pools constructed within 100 feet of residentially zoned property shall be screened with a sound absorbing material such as shrubbery or trees.
   (c)   All exterior lights shall be directed away from residential areas, and exterior lighting, including shielding, shall be of a type consistent with accepted safety measures and security requirements and so situated as to not inconvenience surrounding residential areas.
   (d)   No loud speakers or audible signal shall be permitted within the Yacht Club District except for emergency purposes.
   (e)   Machinery for lifting marine craft shall have a rated capacity not exceeding fifteen tons.
   (f)   Breakwalls shall require advance approval as may be required by Federal and State authorities, as well as the City Engineer.

1264.07 STORAGE AND DOCKAGE.

   (a)   Storage,There shall be no dry land storage area except as approved by the Safety Director and Fire Chief, and unless a permit therefor has been issued. The following minimum qualifications shall be met to qualify for the issuance of such permit.
      (1)   Fire hydrants shall be provided for the storage area, such hydrants to be not more than 300 feet apart and the system looped.
      (2)   There shall be a minimum of twelve feet between boats in winter storage.
      (3)   Boats and other material shall be stored more than 150 feet from any residentially zoned property.
      (4)   The storage area shall be screened from the public view by an ornamental fence or by a landscaped enclosure.
      (5)   There shall be no dry land storage between June 1 and September 1 of every year, except for small craft such as dinghies, canoes, rowboats and small sailboats which are normally kept out of the water, unless a special permit has been issued therefor by the Safety Director.
   (b)   Dockage.
      (1)   Docks shall be provided with a standpipe firefighting system as approved by the Fire Chief and/or the chief fire prevention officer in the City.
      (2)   All docks and/or piers shall be of a permanent nature constructed of concrete, steel or aluminum.
      (3)   There shall be no covered dock slips.

1264.08 MISCELLANEOUS REGULATIONS.

   (a)   The use of watercraft for permanent living facilities or commercial facilities is hereby prohibited.
   (b)   Servicing of watercraft is hereby defined to include normal boat, motor, drive line and propeller repair, and routine maintenance in the nature of bottom cleaning, painting and minor topside work, provided that major repairs such as construction or rebuilding of boats, installation of new bottoms or substantial additions or alterations are hereby specifically prohibited.
   (c)   The commercial sale or rental of boats is hereby prohibited.
   (d)   Wet or dry storage of members' boats is permitted as specified in this chapter.
   (e)   The removal of subaqueous soil from channels, lagoons or Lake Erie by the operation of a dredge is hereby permitted, but not to exceed that which is necessary to maintain sufficient depth in the channel or lagoons, as dictated by safe navigation and in accordance with the regulations of the Federal, State and City governments, including, with respect to the City, that such removal be in accordance with the provisions of Part Four - the Traffic Code and the City's police powers, including, but not limited to, specification of routes as required in the public interest.
   (f)   The sale of food, refreshments and novelties is hereby permitted on the premises, provided that such sales are in the furtherance of the activity of the club and only to members and members' guests.
   (g)   No garbage or rubbish shall be stored within 150 feet of any residentially zoned property. Any such storage area shall be screened.
   (h)   The activities of a yacht club in a Yacht Club District shall be limited to whatever extent is necessary so as not to damage the residential character of the surrounding areas.

1264.09 COMPLIANCE WITH OTHER CITY LAW; CONFLICTS.

   Land use in the Yacht Club District shall meet all of the requirements of Part Fourteen - the Building and Housing Code and Part Sixteen - the Fire Prevention Code, and all City ordinances regulating construction, now existing or as hereafter adopted, and in the event of a difference between any of them, the more strict shall be the governing requirement.

1264.10 FLOODLIGHTS AND EXTERIOR LIGHTS; PROJECTIONS INTO YARDS. (REPEALED)
